POLICY TITLE: Payroll Advice Statements CODE NO. 408.1

Payroll Advice Statements for full time non-certificated personnel shall be in writing and shall state the length of time the Payroll Advice Statement shall be in force and the schedule of payment. Such Payroll Advice Statement shall be approved by the Board of Directors, signed by the President and filed with the Secretary.

Full time employees will have the following paid holidays -- New Year's Day, Memorial Day, Fourth of July, Labor Day, Thanksgiving, Christmas Eve Day and Christmas Day. When the holiday falls on a weekend the employee will not be required to work on the Monday following said weekend.

All non-certificated personnel will receive four (4) paid holidays – Thanksgiving, Christmas Eve, Christmas Day and New Year’s Day

Good Friday is an unpaid vacation day.

POLICY TITLE: Insurance CODE NO. 408.4

Group health and accident insurance may be provided for full time individual non-certificated employees as provided in approved job descriptions. Dependents may be included, except that the dependents will not be covered if they are covered under a policy provided by the spouse's employer.

District employees are covered under the Workmen's compensation Act, and are entitled to its benefits under the terms of the law. Premiums for participation in the Workmen's Compensation Insurance Plan are paid entirely by the school district.

Under federal and state law, public school districts in Iowa are liable for unemployment benefits paid to former employees. The Board, upon the recommendation of the Superintendent, will select a method of financing the unemployment liability; maintain such records as may be required; and communicate such information to state agencies as the law may require.

POLICY TITLE: Vacations CODE NO. 408.5

Full time regular employees who have served a full year (12 months) are entitled to two weeks vacation with pay. After completing 10 consecutive years of employment, a full time employee is entitled to increased vacation with pay according to the following schedule:

11 years 11 days vacation

12 years 12 days vacation

13 years 13 days vacation

14 years 14 days vacation

15 years and beyond 15 days vacation

The Superintendent of Schools shall establish a vacation schedule for all non-certificated employees of the district following a plan or not approving vacation to be taken by all employees at the same time. Vacation time may not accrue from one year to the next and except in cases of emergency, employees may not be employed for extra wages during vacation periods.

Vacation time must be taken a minimum of a week at a time and prior to August 10th each year.

POLICY TITLE: Physical Examination CODE NO. 408.7

All full time and part-time employees are to present evidence of good physical health prior to their initial employment. The Board will reimburse the employee up to $50.00 toward the cost of the required physical examination that is not recoverable through the employee's medical insurance. Bus drivers shall be required to take physical examinations every other year in order to secure their permit. The Board will pay up to $50.00 for required physical examinations for bus drivers and substitute bus drivers.

The administration may request an employee to take a physical examination if it appears that the person's physical welfare is impairing his/her performance.

The MOC-Floyd Valley Community School District recognizes the importance of employee wellness to the employee and the school district. To that end the district will budget an amount annually to cover the cost of specified wellness activities as determined by the Wellness director and a wellness advisory committee. Non certificated employees employed a minimum of 25 hours per week are eligible to participate when they complete a blood screen and participate in a health risk appraisal.

POLICY TITLE: Classified Employee Wage and Overtime Compensation CODE NO. 408.12

Each non-exempt employee compensated on an hour-by-hour basis, whether full- or part-time, permanent or temporary, will be paid no less that the prevailing minimum wage. Whenever a non-exempt employee must work more than forty hours in a given work week, the employee is compensated at one and one-half times their regular hourly wage rate. This compensation is in the form of overtime pay or compensatory time. Overtime will not be permitted without prior authorization of the superintendent.

Each non-exempt employee paid on an hour-by-hour basis must complete, sign, and turn in a daily time record showing the actual number of hours worked. Failure of the employee to maintain, or falsification of, a daily time record will be grounds for disciplinary action.

It is the responsibility of the board secretary to maintain wage records.

POLICY TITLE: Bus Driver Drug and Alcohol Testing Code No. 408.10

Employees who operate school vehicles are subject to drug and alcohol testing if a commercial driver's license is required to operate the school vehicle and the school vehicle transports sixteen or more persons including the driver or the school vehicle weighs twenty-six thousand one pounds or more. For purposes of the drug and alcohol testing program, the term "employees" includes applicants who have been offered a position to operate a school vehicle.

The employees operating a school vehicle as described above are subject to pre-employment drug testing and random, reasonable suspicion, and post-accident drug and alcohol testing. Employees operating school vehicles shall not perform a safety-sensitive function within four hours of using alcohol. Employees governed by this policy shall be subject to the drug and alcohol testing program beginning the first day they operate or are offered a position to operate school vehicles and continue to be subject to the drug and alcohol testing program as long as they may be required to perform a safety-sensitive function as it is defined in the administrative regulations. Employees who violate the terms of this policy are subject to discipline up to and including termination.

It is the responsibility of the superintendent to develop administrative regulations to implement this policy in compliance with the law. The superintendent or designee will inform applicants of the requirement for drug and alcohol testing in notices or advertisements for employment. The superintendent will also be responsible for publication and dissemination of this policy and its supporting administrative regulations and forms to employees operating school vehicles. The superintendent or designee will also oversee a substance-free awareness program to educate employees about the dangers of substance abuse and notify them of available substance abuse treatment resources and programs.

POLICY TITLE: Related Rules Code No. 408.10R

This administrative regulation supports and implements the Drug and Alcohol Testing Program policy.

A. Questions regarding the drug and alcohol testing program policy, its supporting administrative regulations or the drug and alcohol testing program may be directed to the school district contact person, MOC-Floyd Valley Superintendent of Schools, District Board Secretary or Health, Wellness and Safety Coordinator.

B. Covered Drivers

1. The following requirements apply for a driver to be covered by the drug and alcohol testing program:

a. Drive a vehicle transporting sixteen or more persons, including the driver, OR drive a vehicle weighing over twenty-six thousand one pounds; and

b. Require a commercial driver's license to hold the driver position.

2. Covered drivers include:

a. Applicants seeking a position as a driver.

b. Full time, regularly employed drivers;

c. Casual, intermittent, occasional or substitute drivers;

3. Drivers are subject to the drug and alcohol testing program and its requirements throughout the year, including the times when school is not in session or when the driver is on leave.

C. Prohibited Driver Conduct

1. Drivers shall not report to duty or remain on duty with a 0.02 breath alcohol concentration or greater.

2. Drivers shall not use alcohol at least four hours prior to, or during the time they are driving a school bus performing duties as a covered driver.

3. Drivers required to take a post-accident alcohol test shall not use alcohol within eight hours following the accident or prior to undergoing a post-accident alcohol test, whichever comes first.

4. Drivers shall not refuse to submit to a drug or alcohol test. A refusal to test is considered a positive test result requiring the driver to undergo a substance abuse evaluation and subjecting the driver to discipline up to and including termination.

5. Drivers shall not report for duty or remain on duty as a bus driver performing duties as a covered driver if the driver has a positive drug or alcohol test result.

When a driver is selected to submit to a drug or alcohol test, a notification form will be filled out by Leann Evenhuis, board secretary. The driver is to pick up the notification form and proceed directly to the Orange City Medical Clinic which is designated as the district collection site. The board secretary should call the clinic after driver leaves and document the time of the call.
