5. Terms and Conditions

“Applicant” means the person or entity submitting this Satellite Barring/Unbarring Nomination Form to Xantic.

“Authorised Barring/Unbarring Representative” or “ABR” means a person who has authority granted by Xantic to request a Service Bar and/or a Bar Reversal.

“Bar Reversal” means the lifting of a Service Bar by Xantic.

“End-User” means the user supplied with the Service.

“Service” means the Inmarsat Service supplied by Xantic to the Applicant.

“Service Bar” means the termination or suspension of a Service or part thereof by Xantic.

“Xantic” means Xantic (ABN 67 092 596 480 ARBN 092 596 480) having its principal Australian office in New South Wales, Australia at 79 St Hilliers Rd, Auburn, NSW, Australia.

5.1The Applicant has applied to Xantic for either:

(i)authorisation as an Authorised Barring Representative;

(ii)request for a Bar Reversal or a Service Bar;

(iii)amendment of the ACBR’s authorisation details; or

(iv)revocation of the ACBR’s authorisation.

Subject to the acceptance of this Barring/Unbarring Nomination Form, Xantic will institute a Service Bar or Bar Reversal on the conditions set out below.

5.2The Applicant understands and acknowledges that these conditions will govern any requests made to Xantic for a Service Bar or Bar Reversal.

5.3Only an Applicant who is an Authorised Barring/Unbarring Representative can request a Service Bar or a Bar Reversal.

5.4When a written application is made for a Service Bar or a Bar Reversal it shall done so by completing a Barring Request Form on a form provided by Xantic. The Authorised Barring/Unbarring Representative must provide all details required in the Barring/Unbarring Request Form as well as any other information requested by Xantic including, but not limited to, any information provided in this Barring/Unbarring Nomination Form.

5.5For any other application for a Service Bar or Bar Reversal the Applicant must provide to Xantic the 8 digit Password and sufficient identification. Xantic has the discretion to refuse such an application for a Service Bar or a Bar Reversal. Xantic may authenticate the Applicant’s identification from, but not limited to, any of the information contained in this Barring/Unbarring Nomination Form. .

5.6Xantic accepts no responsibility and expressly disclaims any and all liability for accepting an authority to institute a Service Bar or Bar Reversal on behalf of the Applicant including, but not limited to, any death, injury, disability, loss or damage to any person, property or service (including the Service).

5.7The Applicant indemnifies and holds harmless Xantic and its directors, employees or agents from any and all claims, liabilities, losses, damages, costs and expenses relating to, or arising directly or indirectly from the institution of a Service Bar or Bar Reversal at the request of the Applicant.

5.8The Applicant represents and warrants to Xantic that it has undertaken all requisite steps to ensure that it has the full legal right and entitlement to deliver, and require Xantic to institute, a Service Bar or a Bar Reversal. In the case where the Applicant is not also the End-User, this includes, but is not limited to, ensuring that it has taken proper care to ascertain that it is entitled to terminate, suspend or request its supply, through Xantic, of the Service for which a Service Bar or Bar Reversal is submitted and that it has provided Xantic with the correct Inmarsat number or numbers, code and Barring Level.

5.9Xantic will perform a Service Bar or Bar Reversal within a reasonable period after it has accepted the application for Service Bar or Bar Reversal. If Xantic does not accept the application for a Service Bar or Bar Reversal it will so notify the Applicant as promptly as practicable. If Xantic accepts the application for a Service Bar or Bar Reversal, it will notify the Applicant as promptly as practicable after the Service Bar or Bar Reversal has been completed with a Confirmation Form.

5.10If the Applicant is amending its authorisations details or revoking its authorisation to request a Service Bar or Bar Reversal Xantic will notify the Applicant by facsimile, email or telex as promptly as practicable after Xantic has amended or revoked the Applicant’s authorisation.

5.11These conditions shall be governed and interpreted in accordance with the laws of the State of New South Wales, Australia and any dispute arising under these conditions is to be heard and determined within the jurisdiction of that State.

5.12These conditions constitute the entire agreement of the parties about their subject matter and previous agreements, understandings and negotiations on the subject matter cease to have effect.
