1.  About Mobile FOXTEL from Telstra Special Promotions

Interaction with Mobile FOXTEL from Telstra Terms and Conditions and inconsistencies

1.1 These Terms and Conditions and the Mobile FOXTEL Terms and Conditions http://www.telstra.com.au/foxtel/docs/mobile-foxtel-from-telstra-terms-and-conditions-06-10.doc or http://www.telstra.com.au/foxtel/docs/mobile-foxtel-from-telstra-terms-and-conditions-06-10.pdf apply to your purchase of any of the Mobile FOXTEL from Telstra Special Promotions set out below

1.2 If the Mobile FOXTEL from Telstra Terms and Conditions are inconsistent with a term in these Special Promotions Terms and Conditions, then the Special Promotions Terms and Conditions apply to the extent of the inconsistency.

2.  Mobile FOXTEL from Telstra Special Subscription Passes

Offer period

2.1 Mobile FOXTEL from Telstra Special Subscription Passes are available until 31 July 2011 unless extended by us.

About Mobile FOXTEL from Telstra Special Subscription Pass

2.2 When you subscribe to a Mobile FOXTEL from Telstra Special Subscription Pass (“Pass”), you receive access to Mobile FOXTEL from Telstra Ultimate Combo pack, which includes:

(a) News and Docos pack;

(b) Sports pack;

(c) Entertainment pack;

(d) Music pack; and

(e) Kids pack.

Available Pass

2.3 If you are a Telstra 3G or Next G™ customer with a compatible handset, you can subscribe to a Pass. Passes available for purchase are:

Mobile FOXTEL from Telstra 3 Months Special Subscription Pass / 3 months / $49
Mobile FOXTEL from Telstra 6 Months Special Subscription Pass / 6 months / $89

What happens at the end of the subscription period?

2.4 At the end of your selected Pass’ subscription period we will automatically move your subscription onto a monthly Mobile FOXTEL from Telstra Ultimate Combo pack and we will charge you the applicable monthly subscription fee unless you unsubscribe prior to expiry of your selected Pack's subscription period by:

(a) using the WAP interface or Mobile FOXTEL from Telstra TV client on your handset; or

(b) calling FOH on 125 111 (postpaid) to unsubscribe (125 8888 for Prepaid customers).

Cancelling your Pass during the subscription period

2.5 You cannot cancel your Pass part way through the subscription period.

2.6 We may suspend or cancel your Pass immediately if:

(a) FOXTEL suspends or cancels the supply of Mobile FOXTEL from Telstra to us;

(b) FOXTEL directs us to cancel the supply of Mobile FOXTEL from Telstra to you;

(c) a Regulatory Event occurs; or

(d) we are notified of your death.

2.7 If we cancel your Pass for any reason listed in clause 2.6 of these Terms and Conditions, your Pass subscription fee will be refunded to you on pro-rata basis.

2.8 If we suspend your Pass for any reason listed in clause 2.6, we may provide the pro-rata refund of your Pass subscription fee at the end of your subscription period.

3.  Mobile FOXTEL from Telstra Offer

Offer period

3.1 This offer is available from 7 May 2010 until 30 June 2010 (“Offer Period”), unless otherwise determined by us.

Eligibility

3.2 To be eligible for the Special Trial Offer you must be a new Mobile FOXTEL from Telstra subscriber and during the Offer Period you must:

a) purchase a Sony Ericsson XperiaTM X10 or HTC Desire handset from Telstra ("Eligible Handset");

b) connect the Eligible Handset to the Telstra Next GTM network; and

c) download the Mobile FOXTEL from Telstra application from Android MarketTM

(“Eligible Customer”).

Special Trial Offer

3.3 As part of this special trial offer, we will waive the cost of the Mobile FOXTEL from Telstra Ultimate Combo pack for Eligible Customers for three (3) consecutive calendar months (“Special Trial Offer”) if you accept these terms.

What happens after the Special Trial Offer?

3.4 After three (3) months, you will automatically be charged the applicable monthly subscription fee for the Telstra Ultimate Combo pack unless you unsubscribe by:

a) using the WAP interface on Mobile FOXTEL from Telstra TV client on your Eligible Handset; or

b) calling us on 125 111.

Changes to your mobile service

3.5 If during the terms of the Special Trial Offer:

a) you move to a mobile plan that is not eligible for the Special Trial Offer; or

b) your mobile service is suspended as a result of your breach of Our Customer Terms; or

c) you use your SIM in a handset other than the Eligible Handset,

then the Special Trial Offer will be removed from your account and your will not be able receive the Special Trial Offer in the future.

3.6 We may suspend or cancel the Special Trial Offer immediately if:

a) FOXTEL suspends or cancels the supply of Mobile FOXTEL from Telstra to us;

b) FOXTEL directs us to cancel the supply of Mobile FOXTEL from Telstra to you;

c) a Regulatory Event occurs; or

d) we are notified of your death.

4.  Telstra Pre-Paid Mobile FOXTEL from Telstra Offer

Offer period

4.1 This offer is available from 9 August 2010 and 5 October 2010 (“Offer Period”), unless otherwise determined by us.

Eligibility

4.2 To be eligible for the Special Trial Offer you must be a new Mobile FOXTEL from Telstra subscriber and during the Offer Period you must:

a) purchase a Telstra Pre-Paid Samsung Preston ICON handset ("Eligible Handset") from Telstra;

b) connect the Eligible Handset to the Telstra Next GTM network with a new Telstra Pre-Paid number; and

c) send an SMS with the word “ULTIMATE” to 13POND and register via the URL that is sent to you via SMS from Telstra (standard SMS charges apply)

(“Eligible Customer”).

Special Trial Offer

4.3 As part of this special trial offer, we will waive the cost of the Mobile FOXTEL from Telstra Ultimate Combo pack for Eligible Customers for one (1) calendar month (“Special Trial Offer”) if you accept these terms.

What happens after the Special Trial Offer?

4.4 After one (1) month, you will be automatically moved to the Telstra Two Pack Combo (Music and Entertainment Pack) pack and charged the applicable monthly subscription fee of $12 unless you unsubscribe by:

a) using the WAP interface on Mobile FOXTEL from Telstra TV client on your Eligible Handset; or

b) calling us on 125 8880.

Changes to your mobile service

4.5 If during the term of the Special Trial Offer:

a) you move to a mobile plan that is not eligible for the Special Trial Offer; or

b) your mobile service is suspended as a result of your breach of Our Customer Terms; or

c) you use your SIM in a handset other than the Eligible Handset,

then the Special Trial Offer will be removed from your account and your will not be able receive the Special Trial Offer in the future.

4.6 We may suspend or cancel the Special Trial Offer immediately if:

a) FOXTEL suspends or cancels the supply of Mobile FOXTEL from Telstra to us;
