MINUTES OF THE TOWN COUNCIL

REGULAR MEETING

September 10, 2013

7:00 p.m.

Mayor Randy Barrett called the regular monthly meeting of the Winfield City Council to order on September 10, 2013 at 7:00 p.m. at Winfield City Hall, 1 Main Street, Winfield, WV.

ATTENDANCE

Members Attending: Randy Barrett, Mayor; Ryan Powers, Frank Bannister, Kevin Karnes, Steve Hannah and Joe Rumbaugh, members; Jackie Hunter, Recorder.

Staff Present. Gloria Chapman, City Clerk/Treasurer; Tim LaFon, City Counsel; John Hodges, Public Works Director and School Resource Officer, Mike Kordusky of the Winfield Police Department.

Public: Dana Campbell of the Comprehensive Committee, Sam Barnett of the Municipal Building Committee, and Gerald Murray of the Planning Commission were present.

Sam Barnett inquired of Council as to the noise ordinance for dogs, and for cats running loose in the City. He asked the Council to look at the ordinance Kanawha County has, and consider updating our current ordinance. He also expressed his gratitude to the Administration for the sidewalks that have been installed.

Mayor Barrett presented a plaque to Charles Keefer in appreciation of the lifetime service he has given to the City of Winfield. Mr. Keefer stated that he has enjoyed watching Winfield grow from a small town to a city during his lifetime.

Approval of Minutes. Hearing no objections or questions, the minutes of the August 13, 2013 regular meeting were approved.

FINANCIAL

Bills Paid. The bills paid for the month of August 2013 in the amount of $112,066.14 were approved as presented.

General Fund Financial Statements. Hearing no objections, the financial statement for the month of August, 2013 was approved.

Coal Severance Fund Financial Statement. Hearing no objections, the Coal Severance financial statement for the month of August 2013 was approved.

REPORTS, QUESTIONS & DISCUSSIONS

Police and Municipal Staff Report.

The Mayor reported that Chief Perrine was presently at the WV State Police Academy getting certification.

School Resource Officer, Mike Kordusky, introduced himself and his K-9, “Cadet”, to the Council. He stated that he and Cadet were certified as a team on the 21st and 22nd of August. Cadet is certified in three areas: product detection, tracking and part of the search, but not in the area of apprehension. Councilman Powers questioned if Officer Kordusky had a bulletproof vest and he was told that a bulletproof vest was part of regular gear. Officer Kordusky left a copy of the Canine Program and the first draft of some policies and changes that were being considered for the Council to review.

Mayor Barrett reported that some streets in Winfield Way and Woodland Forest needed repairs and could be funded through the special street repair fund. He stated that estimates would be ready by next month.

Wastewater System/Treatment Plant Report:

The Mayor stated that the wastewater ammonia level was up again and measured 23.8 at the last reading.

The Mayor noted that the sewer line from the Baptist Church to the west had been checked with the newly purchased flow meter to determine if the line was at capacity. He announced that there would be a meeting of the Sanitary Board September 12th at 7:30 and invited Council members to attend.

UNFINISHED BUSINESS

Third Reading and adoption of WV State Code for cell phone use while driving. Ryan Powers moved to hold Third Reading and adoption of WV State Code for cell phone use while driving. Motion carried.

NEW BUSINESS

Establishment of a City Police Commission

Ryan Powers and Steve Hanna asked about the feasibility of having a City Police Commission. Chief Perrine and the Mayor had discussed the possibility and although the Chief welcomed individual suggestions, he and the Mayor felt there was not a need for a Police commission.

Discuss emergency response to Volunteer Fire Dept.

It was a general consensus that City employees, who were also volunteer firemen, had a first allegiance to the City when on the City time clock.

Reappoint Dale Vance to Planning Commission.

Kevin Karnes moved to reappoint Dale Vance to the Planning Commission for a three-year term, commencing October, 2013. Motion carried.

Appoint Dana Campbell as new Planning Commission member.

Upon recommendation of the Mayor, Joe Rumbaugh moved to appoint Dana Campbell to the Planning Commission for a 5-year term, commencing October 2013. Motion carried.

Demolition of house at 19 Second Street.

The Mayor stated that M S Demolition had given a cost of $4800 to tear down the house at 19 Second St. to the foundation. The cost of complete demolition including the foundation would be $5600. The City would retain the money from the scrap metal. Steve Hanna moved to destroy the house and foundation at a cost of $5600. Motion carried.

Memorial Plaque for Nathan Fewell.

Ryan Powers moved to place a memorial plaque on one of the benches behind City Hall. Motion carried.

New Business (cont’d)

New Municipal Building

After discussion on whether to trade City land along Rt. 817 in front of the lagoon for the old P.J. Day Care Building and pay the difference, or to buy the building outright for a new City Hall and Police Department, it was decided to table any action until Council could decide all the ramifications. A special meeting on September 24th at 5:30 would be held to make a decision. A committee including Frank Bannister, Joe Rumbaugh and Steve Hanna will look into possibilities for the use of the City property along Rt. 817 before the special meeting.

Adopt WV State Code 8-12-13 and 7-1-3n State Building Code revisions.

Frank Bannister moved to adopt WV State Code 8-12-13 and 7-1-3n State Building Code revisions. Motion carried.

GOOD OF THE ORDER

The Mayor announced that citizens will soon be able to use credit cards to pay City bills and fines.

Joe Rumbaugh commended the Police Department on their help during the opening of school.

ADJOURNMENT

The meeting was adjourned at 8:35 p.m. until the next special meeting on September 24th at 5:30.
