Minutes of the meeting of BMW Committee-3 held on 15-09-09.

Agenda -1 : Action taken Report.

The actions taken with regard to decisions in the last meeting were reviewed. The details are as follows:-

  • The Trainee Engineers informed that the applications being received from the Enquiry Counter are complete. The Committee expressed its happiness about this improvement.
  • The details regarding the inspections carried out by the Trainees/ Engineers were reviewed by the Committee. The decisions in this regard are recorded in the enclosed Annexure-I. However, the Committee suggested that the pending Inspections should be exonerated urgently.
  • The status of 135 Units (Annexure-II) which were asked to submit the applications for renewal was placed before the Committee. However, it was informed letters were issued in the last week of August 09 since LDC attached was withdrawn there was a problem in dispatching the letters. The Chairman of the Committee expressed its unhappiness over the delay in issuing the letters as the previous meeting was held about two months back. The Chairman of the Committee suggested that henceforth AEE (BMW) will be responsible for ensuring the compliance of the decisions taken in the meeting BMW-3. He also suggested that the compliance of the decisions of this meeting shall be submitted within 15 days by the AEE.
  • As regards 17 Units (Annexure-III)which have claimed that they are treating less than 1000 patients per month, have already been asked to submit an affidavit in this regard. The further necessary action in this regard shall be taken after the required affidavit is submitted by them.
  • Committee reviewed the status report in respest of 33 cases where the letters were received undelivered. The Trainee has made inspection for pasting these letters. The decisions of the Committee are recorded in the Annexure-IV.
  • Committee reviewed the inspections/information conducted by trainee in respect of 21 cases ,which have claimed shifting/ closure of the Units. The decisions in these cases are recorded in the enclosed Annexure-V.
  • The status of miscellaneous cases was reviewed in respect of 24 Health Care Units. The decisions of the Committee are recorded in Annexure-VI.
  • The issue of 16 files which are not traceable was discussed. It was decided that the files may be re-constituted and placed in the next meeting of the Committee.
  • A list of Registered HCUs is provided by the DHS was placed before the Committee and it was decided that the said list may be examined by the trainees of Committee-1,2,and 3 as per their Jurisdiction and the units which have not submitted their application for renewal etc. may be identified and placed before the respective BMW Committees.
  • The status of units which were communicated the deficiencies based on the inspections by the Trainee Engineer was placed before the Committee. The decisions in respect of these units are available in Annexure-IX.
  • The details in respect of 110 Health Care Units which were issued letter for submitting applications for authorization were also reviewed. It was informed that many of the units have applied for authorization and subsequently authorization have been decided also. It was suggested that a complete status in respect of pending applications / issues may be placed. The decisions taken in respect of these cases are atAnnexure-X.

Agenda:-2 List of Drug manufacturing units

It was brought to the notice of the Committee Members that BMW Committee No –1 has transferred 83 cases of Drug Manufacturing Units to the Committee no.-3. It was also informed that the inspections have been carried out by Dr. Joshi team in respect of Drug Manufacturing Units. Further, it was submitted by the EE (BMW) that some of these units have submitted applications for authorization under BMW rules and application for CTO under Water / Air act.

The committee decided that a complete status of the inspection etc. along with the authorization under BMW Rules should be placed in the next meeting of the Committee .It was also decided that the applications received under Water and Air Act may be sent to the concerned CMC along with copy of inspection report for taking appropriate decisions by CMC.

Agenda: - 3 Fresh and renewal cases of Authorization.

24 fresh / renewal cases were placed before the Committee. The decisions in these cases are recorded in Annexure-XII.

The case of Aman Hospital, in respect of whom, aletter has been received from DHS along with a copy of complaint & some photographs showing the poor management of Bio-medical waste in the hospital. The committee decided that inspection should be done to know the full facts. The inspection should be done by a team consisting EE,AEE,Trainee and the matter to be put up administratively.
