MINUTES OF THE CITY COUNCIL MEETING HELD OCTOBER 30, 2012
A Special Meeting and Work Session of the City Council of the City of Hopewell, Virginia, was held Monday, October 30, 2012, at 6:30 PM in the City Council Chambers, Municipal Building, 300 North Main Street, Hopewell, Virginia.

At 7:10 PM Council convened into Open Session. Councilors responded to the question: “Were the only matters discussed in the Closed Meeting public business matters lawfully exempted from open meeting requirements; and public business matters identified in the motion to convene into Closed Session?” Upon the roll call, the vote resulted:

Motion was made by ______, seconded by Councilor ______, and unanimously approved to make the following reappointments/appointments to Boards and Commissions:
· reappoint Vanessa Justice OR appoint Patricia Dostie to the BZA for a term extending thru October 31, 2017;
· appoint ______to the Dock Commission for a term extending thru 10/31/16;
· appoint Mary Calos or Jacqueline Shepperson to the Historic Preservation Committee;
· appoint ______to Keep Hopewell Beautiful for a term extending thru October 31, 2014; appoint Mary Elizabeth Dalton OR Herndon Smith OR Gloria Bailey to the ARLS Library Board for a term extending thru October 31, 2016;

ORDINANCE NO. 2012-09 – TAXICAB RATE ORDINANCE
Motion was made by Councilor ______, and seconded by Councilor ______, to approve Ordinance No. 2012-09 on first reading. Upon the roll call, the vote resulted:

ORDINANCE NO. 2012-09
A Ordinance abolishing taxicab rates and allowing rates to be fixed and established by taxicab companies until such a time that City Council deems it necessary to set rates for taxicab companies operating in the City of Hopewell.
WHEREAS, on August 14 1990, City Council established and fixed taxi rates for taxicab companies based on four zones within the City of Hopewell; and
WHEREAS, on June 13, 2006, City Council held a public hearing to receive citizen comments regarding a request from Marshall Cab, LLC for an increase in the maximum authorized taxicab rates in the City and to reduce the City from four rate zones to two rate zones; and
WHEREAS, at that June 13, 2006 public hearing, the City Council voted to suspend the 1990 fixed taxicab rates for a nine-(9) month study period after which Council would review the issue. The motion passed four to two; and
WHEREAS, it wasn’t until August 2009 that City Council again reviewed taxicab rates and amended Hopewell City Code Section 36-46 (Display of rates of fare and corresponding zone map; charging excessive fare.). Such section provided, “the rate fixed, prescribed or established by the city council (or taxicab company in the absence of a council-set rate).” However, such action did not officially and permanently abolish the 1990 rates that were suspended for a nine-(9) month period in 2006; and
WHEREAS, without an affirmative action by City Council to permanently abolish the 1990 rates, at the expiration of the nine-(9) month suspension the rule reverted back to the 1990 rates. It was City Council’s intention to defer rate and zone establishment to the taxicab companies when Section 36-46 was amended in 2009. However, an affirmative action is necessary to officially and permanently abolish the 1990 rates and to defer the establishment of rates and zones to the taxicab companies as intended by Hopewell City Code Section 36-46.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Hopewell, Virginia, that the 1990 taxicab rates be officially and permanently abolished and that the establishment of rates and zones be deferred to the taxicab companies as intended by Hopewell City Code Section 36-46 until such a time that Hopewell City Council deems it necessary that the Council set rates for taxicab companies operating in the City of Hopewell.
This ordinance shall become effective immediately upon its passage by City Council. The requirement for a second reading of this ordinance is hereby dispensed with pursuant to Chapter IV, §8 of the Hopewell City Charter.
NATIONAL LEAGUE OF CITIES CONVENTION
Motion was made by Councilor ______, seconded by Councilor ______, and unanimously passed to designate Mayor Luman-Bailey and Councilor Pelham to attend the National League of Cities Congress of Cities and Exposition, November 28-December 1, 2012 in Boston.

AD HOC CITY PARK COMMITTEE
Presentation of Sketch Map of City Park showing where items (ship, restroom, etc.) will be placed, and Guidelines for Division of Property which Council approved several years ago.
MIKE YUNGMANN, CEO – SOUTHSIDE REGIONAL MEDICAL CENTER
Certificate of Public Need Application for Open Heart Surgery Services and the need for the community-at-large to support the application so that residents can receive lifesavings services close to home.
MARK HALEY, DIRECTOR – HRWTF
Mr. Haley provided an update on the Wastewater Treatment Plant Construction Project. Presentation of the Preliminary Engineering Report (PER) for Phase 2 Nitrogen Removal Project and a status on the sewer rehab work throughout the City.
