MINUTES OF REGULAR COUNCIL MEETING

The Regular Monthly Council Meeting of the Tyrone Borough Council was held on Monday, January 11, 2016 @ 7:00PM at the Tyrone Borough Municipal Building, 1100 Logan Avenue, Tyrone, PA. Mayor Fink led the group in the Pledge of Allegiance and Pastor Ken Patterson, Bible Baptist Church, gave the Invocation.

CALL TO ORDER:

Mayor Fink called the meeting to order and requested roll call. Present: Council members Michelle Miller, Christy Ray, Nate Verilla, Bob Dollar, William Latchford, Charlie Mills and Mayor Fink. Absent: Council Member Courtney Rhoades. Also present were Borough Manager Phyllis Garhart; Solicitor Dan Stants; Sewer Superintendent Tim Nulton; Water Superintendent Ardean Latchford; Highway Superintendent Jim Bywater; Chief of Police John Romeo; Consulting Engineer Ann Reynolds; Code Enforcement Officer Marvin Frazell; and Administrative Assistant Kimberly Gurekovich.

PUBLIC COMMENT:

Mr. Stephen Gildea, CEO Tyrone Hospital

Mr. Gildea, CEO of Tyrone Hospital, was present at the meeting to address Borough Council regarding Penn State Hershey’s acquisition of Tyrone Hospital and requesting the Borough Council authorize the execution of a deed of correction so they may present Penn State Hershey with clean deeds. Mr. Gildea advised in the 6-1/2 years he has been CEO of the hospital, he has worked with a great board of dedicated people who have worked diligently to bring Tyrone Hospital back to a being a vital part of the Tyrone community. One to which people travel long distances for care.

Mr. Gildea advised Tyrone Hospital has been ranked best in the region for Patient/Customer care, however, healthcare is an ever changing world and smaller hospitals are being surrounded by larger healthcare companies. Smaller hospitals are having a harder time competing with the larger entities. Mr. Gildea spoke highly of Tyrone’s Breast Cancer & Women's Health Institute as well as the Orthopedic Clinic being some of the region’s top facilities. Mr. Gildea stated if Tyrone continues to have top ranked physicians and facilities, other great physicians will come.

Mayor Fink has asked for some assurance from Penn State Hershey stating Tyrone Hospital would remain a vital part of this Community. Mr. Gildea advised he could not provide that at this time. Mr. Gildea further stated that Penn State Hershey has made a

strong commitment to the Tyrone community and gave assurance that what happened to Bon Secours hospital in Altoona would not happen to Tyrone. Mr. Gildea advised the current Board of Directors will stay intact.

Solicitor Stants briefly reviewed the timeline with respect to the Hospital’s request for a Deed of Correction and advised he is working with the Hospital’s Attorney, David Pertile, to make said corrections. A draft Ordinance was provided for Council to review for possible adoption at their February meeting.

There was no further public comment.

APPROVAL OF MINUTES

It was moved and seconded the Minutes of the December 14, 2015 and January 4, 2016 Council Meetings be approved. Council unanimously approved said motion.

APPROVAL OF MONTHLY FINANCIAL REPORTS

It was moved and seconded the financial reports for the monthly accounting period ending December 31, 2015 be approved: (1) The Account Balance Report; and (2) Cash Disbursement Journal. Council unanimously approved said motion.

BOROUGH MANAGER’S MONTHLY REPORT

Resignation of Officer Barry Fry

Council was in receipt of a letter of resignation from full time officer Barry Fry. Officer Fry’s last day of employment with the Borough was January 5, 2016. It was moved and seconded that Council accept the resignation of Officer Barry Fry. Council unanimously approved said motion.

Donation for TACO Radio Auction

Council was in receipt of a request from TACO for a donation for their annual radio auction being held February 13 and 14, 2016. Council has historically given a family pool pass. It was moved and seconded that Council approve said donation. Council unanimously approved said motion.

Logan Avenue Streetscape – Core Borings

·  Core Borings – Council is in receipt of a proposal from P. Joseph Lehman for core borings within the proposed Logan Avenue Streetscape Project in the amount of $6,380. Core Borings will allow them to identify the current composition of the various material within the roadway. Council member Dollar inquired as to how may holes this would entail. Mrs. Garhart advised 4 holes per block. It was moved and seconded that Council approve said expenditure for core borings. Council unanimously approved said motion.

·  Street Signs – Council was provided with several options for Street Signage within the proposed Logan Avenue Streetscape. After some discussion, with cost and replacement availability being the biggest factors, it was moved and seconded that Council chose options #3, which consists of two 3/8” O.D. round steel post with signs mounted on top of post, this also includes a break away base and green paint. The total cost for this option is $198/pole. It was unknown at meeting time, how many posts are located within this proposed project.

·  Waiver of Ordinance No. 1240, Colored Concrete – Council was in receipt of a request from Lehman Engineers to waive the Borough’s Ordinance No., 1240 wherein it requires colored concrete within the downtown area. Said waiver request would cover Herald Street to 11th Street on Logan Avenue. It was the desire of Council to speak with property owners who previously had an issue with respect to colored sidewalk.

Mrs. Garhart advised that two grants have been submitted on behalf of the Borough for the proposed Logan Avenue Streetscape ($1,445,034) as well as the Reservoir Park Bridge/Walking Path ($785,327). Project selection is to take place May 30, 2016. Council member Latchford voiced his concern as to how PennDOT could build a bridge that carries heavy load trucks for $1.3 million (Paper Mill) and we have an estimate for a bridge through our park for $785,000.

Logan Avenue Streetscape Storm Sewer System

The Borough is in receipt of a report from GHD advising the storm sewer system is inadequate. This should be addressed along with the streetscape so as to not dig up new streets. A meeting will be scheduled to discuss the Borough’s options and will be brought to Council at a future meeting.

Personnel and IRC Committee Members

Council member Courtney Rhoades has resigned her position on the IRC Board and Mr. Terry Richardson served on the Personnel Committee. Mrs. Garhart asked for volunteers for these positions. Council member Michelle Miller volunteered for the personnel committee. After some discussion and no other volunteers, Michelle Miller volunteered for the IRC Committee to stating she would not be able to make every meeting due to her work schedule. It was moved and seconded that Council appoint Council Member Michelle Miller to both the personnel committee and the IRC Board. A roll call vote was taken. Ayes: Council Members Ray, Verilla, Dollar, Latchford, Mills and Mayor Fink. Council member Miller abstained from voting.

Request for Use of Facilities – Faith Day – August 27, 2016

The Borough was in receipt of a request from the Tyrone Events and Promotions and Faith Day Committee. The Committees have requested to move the event to Reservoir Park (was previously in the downtown area) and with that, use of pavilion nos., 1, 2 and 3, as well as BBQ Pits, Amphitheatre and Concession Stand. Borough Manager Mrs. Garhart advised the Borough has never granted exceptions like this for any event. The Borough’s policy to reserve tables has been long standing for many years wherein folks arrive at early morning hours to stand in line for table reservations. It was suggested that Faith Day be moved to 2 weeks later at which time park reservations are not taken.

Another suggestion was to have them come stand in line like everybody else, pay the fee and split it between the Churches that are participating. Council asked the Borough Manager speak with Mrs. Griep regarding the same.

Civil Service Commission – Changes to Rules & Regulations

The Civil Service Commission held a meeting on January 7, 2016. During this meeting the Commission made several changes to Chapter 4, which included the order in which testing is done. It was a request of Chief Romeo to have the physical fitness testing done first, thus if anyone does not pass we are not paying and administering further testing. It was moved and seconded that Council approve said changes as submitted by Solicitor Oswalt. Council unanimously approved said motion.

SOLICITOR’S RERORT: Solicitor Stants had the following for Borough Council:

Ordinance No. 1370 – Amending the Sewer Use Ordinance

It was moved and seconded that Council approve Ordinance No. 1370, AN ORDINANCE OF THE BOROUGH OF TYRONE, A HOME RULE MUNICIPALITY, AMENDING ORDINANCE NUMBER 1299 ENTITLED "SEWER USE ORDINANCE" TO ESTABLISH SPECIFIC LOCAL LIMITS FOR POLLUTANTS OR CONCERN RELATING TO DISCHARGES TO THE BOROUGH'S PUBLIC SEWER SYSTEM IN ACCORDANCE WITH SECTION 29(2)(D) OF ORDINANCE NUMBER 1299; TO REPEAL INCONSISTENT ORDINANCES; AND TO ESTABLISH AN EFFECTIVE DATE.

Council unanimously approved said motion.

Resolution No. 2016-01 – Reappointment of Zoning Hearing Board Member

It was moved and seconded that Council approve Resolution No. 2016-01, reappointing Lori Eckert to continue to serve on the Zoning Hearing Board. Council unanimously approved said motion.

CONSULTING ENGINEER: Council was in receipt of Mr. Nester’s report.

CODE ENFORCEMENT: Council was in receipt of Mr. Frazell’s report.

POLICE DEPARTMENT: Council was in receipt of Chief Romeo’s report. Chief showed Council one of the department’s “Because We Care” bears. Tyrone Police Department has joined with other municipalities in the “Because We Care” program. Officers will carry bears with them and when faced with an incident involving a child, they can receive a bear. Chief is also going to work with the Daily Herald on a name our bear contest.

Chief also advised of information he provided to Council regarding the use of ATV’s, 4 wheelers, etc on Borough streets. Chief asked for input from Council members to bring this for adoption.

SEWER DEPARTMENT: Council was in receipt of Mr. Nulton’s monthly report. Mr. Nulton advised the UV project at the plant is moving along very well thanks to the weather and is very pleased with the Contractor.

WATER DEPARTMENT: Council was in receipt of Mr. Latchford’s monthly report.

HIGHWAY DEPARTMENT: Council was in receipt of Mr. Bywater’s monthly report.
