MINUTES OF ENVIRONMENT, PARKS, RECREATION & AMENITY MUNICIPAL POLICY COMMITTEE MEETING HELD ON 28th June 2011 AT 6PM IN MEETING ROOM, COUNCIL CHAMBER, TOWN HALL, DUNDALK.

128/11Confirmation of Minutes
On the proposition of Cllr. Oliver Morgan and seconded by Cllr.Harry Todd, the minutes of the meeting held on 22nd February, 2011 were approved.
129/11Matters Arising
Cllr. Harry Todd referred to overgrown trees in the vicinity of McArdle Moore Brewery and that the problem intensified during the summer growth season. John Lawrence advised that he would ask Elias Mlimbila, Parks Superintendant to investigate.
Cllr. Eamon O’Boyle advised of a fallen tree in the Friary field and queried who was responsible for removal of same. John Lawrenceadvised that a lease arrangement was in place between DundalkTown Council and Colaroga Ltd., St. Saviours Priory, Dublin, forthese lands, and removal therefore was the responsibility of the Friary Community.
Mr. Peter McVeigh advised the members on recent developments inthe area of flooding management by Dundalk Town Council. JohnLawrence advised that there was no requirement for this committee to devise a policy in this area. The Chairman responded that DundalkTown Council need to be ready to deal with flood incidents. Mr. McVeigh further advised that Louth County Council were leadorganisation on the Water Conservation project for the whole countywhich incorporated the Dundalk area. This project is looking at highleakage levels and preparing proposals to deal with same. JohnLawrence advised the members that there was no requirement to developa policy in this area by this committee.
Cllr. Jim Ryan queried the up to date position on Culhane Street
regarding ongoing flooding problems and Peter McVeigh advisedthat there are plans in place to deal with this issue this year.
It was agreed that a Policy Paper on trees, suitability, guidance, etc., for consultancy by the members will be prepared for the next meeting.
130/11Extinguishment of Public Right of Way on a Public Road
Mr. Michael Hoey stated that having read the relevant sections of the Roads Act, the policy is near identical to the provisions of same.
John Lawrence advised that in any policy formulation where statutelaw is being considered, there can be no variation to the statute.
The members agreed to make the following amendments to the Draft Policyfollowing:
paragraph 1.7, to delete the work “adequate”.
paragraph 3.2 (a) Insert at end of sentence, “by way of signed petition”.
paragraph 3.2 (b) Delete the sentence.
It was agreed to defer decision on adopting the Draft Policy until the next meeting of the Committee which would take place in September 2011.
