MINUTES OF COUNCIL
JANUARY 9, 2007
The Batesville City Council met in regular session on January 9, at 5:30 PM at the Municipal Building. Mayor Rick Elumbaugh presided over the meeting. Councilmember Krug gave the invocation. Upon roll call the following councilmembers answered present: R.L. Carpenter, Fred Krug, Doug Matthews, Matt McDonald, David Shetron, Stephen Smart and Paula Terrell. Also present were the City Clerk and the City Attorney. Councilmember Jerry Pectol was absent.
COMMENTS FROM CITIZENS
Mayor Elumbaugh opened the floor for citizen comments. Mr. Naomi Jones addressed the council with concerns of a burned-out house located at 1970 Carol Street. Ms. Jones said the fire occurred on May 20th and to date there has been nothing done to clean up the property.

Councilmember Krug moved to approve the minutes from the previous two meetings and Councilmember seconded. All voted for.

**CONSIDER CHANGING THE NEXT COUNCIL MEETING
Mayor Elumbaugh asked the council to move the next scheduled council meeting from January 23rd to January 30th to allow more time to work on the 2007 budget. Councilmember Smart so moved and Councilmember Matthews seconded. All voted for.
**CONSIDER AN ORDINANCE TO ADOPT RULES OF PROCEDURES
Councilmember Terrell introduced an ordinance to adopt certain rules of procedures for the transaction of business of the council for 2007. Councilmember Terrell moved that the ordinance be read by title only. Councilmember Matthew seconded and the roll call count was 7 for and 0 against. City Attorney Stalker read the ordinance by title only. Councilmember Krug moved to suspend the rules for the second and third readings. Councilmember Matthews seconded and the roll call count was 7 for and 0 against. Councilmember Smart moved to adopt the ordinance and Councilmember Matthews seconded. The roll call count was 7 for and 0 against. The ordinance was given #2007-1-1. Councilmember Matthews moved to adopt the emergency clause. Councilmember Carpenter seconded and all voted for.
**CONSIDER SETTING A PUBLIC HEARING TO CLOSE AN UNUSED PORTION OF A DEDICATED STREET OFF HIGHWAY 167 AND WHITE DRIVE
Property owner Jim Butler and Attorney Steve Bell addressed the council asking to set a public hearing to close an unused portion of a dedicated street that is located east of the intersection of Highway 167 and White Drive. The council was provided a copy of the petition to vacate signed by the owners; Jim and Cindy Butler, J.D. and Cindy Allen and Jeff and Tammy Angel. Councilmember Krug moved to set the public hearing for the next scheduled council meeting of January 30th at 5:30 PM. Councilmember Matthews seconded and all voted for.
**CONSIDER AN ORDINANCE TO WAIVE COMPETITIVE BIDDING FOR CERTAIN ITEMS IN 2007
Councilmember Smart introduced an ordinance to waive the requirements of competitive bidding during the calendar year of 2007 on the purchases of used equipment, motor fuel, SB-2, hot mix asphalt, cold mix asphalt, water treatment process chemicals, property insurance and employee health insurance. Councilmember Terrell moved to read the ordinance by title only. Councilmember Matthews seconded and the roll call count was 7 for and 0 against. City Attorney Stalker read the ordinance by title only. Councilmember Matthews moved to suspend the rules for the second and third reading. Councilmember Terrell seconded and the roll call count was 7 for and 0 against. Councilmember Terrell moved to adopt the ordinance and Councilmember Matthews seconded. The roll call count was 6 for and 1 abstained (Shetron). The ordinance was given #2007-1-2. Councilmember Matthews moved to adopt the emergency clause. Councilmember Carpenter seconded and all voted for.
**CONSIDER AN ORDINANCE TO WAIVE COMPETITIVE BIDDING FOR AN AERIAL FIRE TRUCK
Councilmember Shetron introduced an ordinance to waive competitive bidding and authorize the purchase of an aerial platform apparatus for the Batesville Fire Department. City Attorney Stalker read the ordinance in full. Fire Chief Danny Russell and Assistant Fire Chief Brent Gleghorn addressed the council and explained that they can save approximately $100,000.00 by purchasing a Rosenbauer GSE Demo Cobra 104 Aerial Platform Apparatus. After a short discussion, Councilmember Matthews moved to suspend the rules for the second and third reading. Councilmember Krug seconded and the roll call count was 7 for and 0 against. Councilmember Matthews moved to adopt the ordinance and Councilmember Shetron seconded. The roll call count was 7 for and 0 against. The ordinance was given #2007-1-3. Councilmember Matthews moved to adopt the emergency clause and Councilmember Terrell seconded. All voted for.
**PAID BILLS REPORT
The council was given a copy of the paid bills report for December 2006.
COMMENTS FROM DEPARTMENT HEADS
Assistant Street Supervisor Johnny Coles addressed the council to tell them that he had a demo Trac Hoe out in the parking lot if they would like to look at it after the meeting.
COMMENTS FROM COUNCIL MEMBERS
Councilmember Terrell said the “China Committee” would be meeting mid January with Michele Buckner to work on more details of the upcoming visit of our Sister City dignitaries.

COMMENTS FROM MAYOR
Mayor Elumbaugh asked the council to set at least two dates for budget meetings. The council chose January 16th and if needed January 23rd and 25th.
The Mayor said he was looking at an option for a 30 to 50 foot bucket truck and is talking to the County Judge about the possibility of going in with the county to purchase a truck.
Mayor Elumbaugh asked the Traffic Committee to include the discussion of returning Main and College back to two way streets to their agenda. He suggested that they get input from citizens and business owners that live or have business on Main and College and also ask for guidance from the Highway Department.
There being no further business, Councilmember Krug moved that the meeting be adjourned. Councilmember Smart seconded and all voted for.
