May 29, 1947

Minutes of a regular meeting of the Orem City Council held May 29, 1947 in the Orem City Hall at 7:45 P.M. The following members were present: Mayor J. W. Gillman, Councilmen Roy H. Gappmayer, Woodruff Jensen, James G. Stratton, Clerk Orland E. Pyne, Councilman Williams was absent because of work and Councilman Twitchell was absent, being out of the city. MayorJ. W. Gillman was in charge of the meeting.

H. L. Vosse, Homer McEwen and Gordon Moyes were present in regard to Mr. Vosse's application for a beer license. Mr. Vosse isgoing to operate in the building formerly occupied and owned by Mr. McEwen on 18thSouth State Street, he leasing the building for a period of 5 years. He presented a completed application with the required signatures of citizens vouching for his character and also signatures of citizens living around the proposed location. Mr.Vosse was informed that he would be notified as soon as possible of the Council's decision.

Mr. Todd of the Todd Trailer Park was present concerning the case of Mr. Bird who lives next to him. Mr. Bird has constructed a barn within the commercial zone, on 16thNorth State Street since the passing of the Zoning Ordinance.He refuses to move the barn away from Mr. Todd’s Trailer Park. The Mayor informed Mr. Todd that the Board of Health would pass an ordinance and attempt,to handle theBird situation if it could not be settled any other way.

Mr. Barnett was present in regard to a taxi business in Orem. Mr. Barnett has been issued a license for one cab as of May 27th. He stated that he would put two new Nash Cars on the job in another week. The Council informed him that they would attempt to give him all the protection they could until he gets started. He was afraid that too much competition might force him out of business. He understood thatthe city could not issue e an exclusive franchise to anyone.

Ray S. Park and Richard Park were presented to discuss the Sunday closing of grocery stores. Ray stated that personally he could see nothing wrong in being open on Sunday. He was of the opinion that closing on Sunday would not help other merchants as far as business was concerned, that if they expected to make a go of it they should modernize their stores and make it invite-able. Richard presented signatures of some 500 people who desired that his store remain open on Sunday. Ray stated that he had signatures of some 1,000 people, 65% of them from Provo, desiring that he remain open on Sunday. Councilman Gappmayer expressed his opinion on Sunday closing in that he felt that Merchants should have one day of rest and in view of unfair competition they should be closed on Sunday. The council asked Ray and Richard to make an attempt to contact Mr. Varley and his associates and work out some agreement. They stated that they would do that if it was possible.

Mayor Gillman read a letter from Scott E. Wilkins and Sterling A. Harding requesting an increase in salary. They are being paid at the present time $185.00 per month. They mentioned the salaries ofPolice Officers serving in positions similar in other cities and also those serving in the Sheriff's Office in the County. The Council discussed the situation and it was decided to talk to the boys regarding certain problems and etc. before any decisions should be made in regard to salaries.

A report on the winter recreation program, Financial and otherwise, as presented by Scera was read and discussed. A letter from Provo City Attorney, Dallas Young was read concerning the Vocational School situation as to authorization of cities in giving free sites for such things.

The concrete block plant in the north part of the city was discussed. It has been reported that there has been some complaint from citizens in that area about the smoke and noise being a menace. Inspector Wickman read from the Ordinance in regard to commercial2 District which stated that Manufacturing Plants wouldbe allowed providing the noise and etc. would not be injurious to anyone.

The council discussed the need of a leak finder in the water dept.Since numerous leaks have been discovered it would save considerable time in locating them.

Mr. Wickmanpresentedfoursubdivisionplatsforapprovalofthecouncil.Inregardtosubdivisions being constructed on streets with no water lines, the council voted to hold to the policy of asking the subdivider to install a water pipe line of 4 inch size and that they, be reimbursed over a period of four years.

The Thomas Subdivision Plat was approved and accepted with the above provisions on motion of Councilman JamesG. Stratton, seconded by Councilman Roy H. Gappmayer and passed. The resolution is to be prepared along with a letterrequesting the subdivider to install the waterlines as stated above.

The Riding Tract Subdivision Plat was presented. It was moved by Councilman WoodruffJensen that the Riding Tract Subdivision Plat be approved and accepted subject to the approval of the Engineer as to proper grades of streets and sidewalks and the required amount of bond to be posted, seconded by Councilman James G. Stratton and passed. The resolution is to be prepared by the clerk along with a letter to the subdivider in regard to the above provisions.

It was moved by Councilman Roy H. Gappmayer that the, Valneva Subdivision Plat be approved and accepted, seconded by Councilman James G. Stratton and passed. The resolution for recording is to be prepared by the clerk.

It was moved by Councilman Woodruff Jensen that the Willet Subdivision Plat be approved and accepted, seconded by Councilman Roy H. Gappmayer and passed. A resolution is to be prepared for recording. (Copies of resolutions and letters mentioned above are attached)

The Ordinance increasing the Beer License from $150.00 to $500.00 and the Ordinance prohibiting the sale of beer on Sunday were discussed by the Council. They were prepared by the City Attorney for Council approval.

It was moved by Councilman James G. Stratton, seconded by Councilman Woodruff Jensen that Ordinance No. 81, AN ORDINANCE PROHIBITING THE SALE OR OFFERING FOR SALE OF LIGHT BEER AT WHOLESALE AND RETAIL, IN BOTTLES AND ON DRAUGHT, UPON THE FIRST DAY OF THE WEEK COMMONLY KNOWN AS SUNDAY, and that Ordinance No. 82, AN ORDINANCE AMENDING SECTION 10 OF ORDINANCE NO. 46 ENTITLED, "AN ORDINANCE PROVIDING FOR THE LICENSING OF LIGHT BEER AT WHOLESALE AND RETAIL, IN BOTTLES AND ON DRAUGHT, FIXING THE FEES THEREFORE AND REGULATING THE SAME, AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT THEREWITH. "ENTITLED ORDINCANCE WAS PASSED BY THE CITY COUNCIL OF OREM CITY, UTAH, THE 31st DAY OF MARCH A. D. 1943, be passed and approved and that the above ordinance No. 81 be published in the next issue of the Orem-Geneva Times and that Ordinance No. 82 be published sometimein June so that it will be effective July 1, 1947.

Councilman Roy H. Gappmayer reported on activities of the Centennial Committee on the June 18thand 19thcelebration.

Meeting was adjourned on motion of Councilman Woodruff Jensen, seconded by Councilman Roy H. Gappmayer and passed.

Inasmuch as the Thomas Subdivision Plat has been presented to the City Council of Orem for approval and acceptance at its meeting of May 29, 1947 and inasmuch as C. W. Thomas Jr., Subdivider has agreed to comply with Orem City Ordinance No. 75, An Ordinance regulating a subdivision of land, therefore,

BE IT RESOLVED, on motion of Councilman James G. Stratton that Orem City Council approve and accept said subdivision as per Ordinance No. 75. Motion was seconded by Councilman Roy H. Gappmayer and passed this 29th day of May, 1947.

The Orem City Council at its meeting of May 29th, 1947 approved the Thomas Subdivision Plat with the following provisions.

"In regard to Subdivisions facing streets within the city having no water lines, it was voted unanimously to hold to the policy of asking the subdivider to install the water pipe lines, they being installed with 4 inch pipe, and that the subdividers be reimbursed for said installation over a four year period.

The City Council requests that your actions be governed by the policy stated above.

Riding, Subdivider has agreed to comply with Orem City Ordinance No. 75, An Ordinance regulating a subdivision of land, therefore,

BE IT RESOLVED, on motion of Councilman Woodruff Jensen that Orem City Council approve and accept said subdivision and agree to furnish culinary water to the subdivision and to maintain the streets within the subdivision as per Ordinance No. 75. Motion was seconded by Councilman James G. Stratton and passed this 29th day of May, 1947.

"It was voted unanimously that the City Engineer's approval be obtained in regard to the proper grades on streets and sidewalks within the subdivision and that he also recommend the required amount of bond to be posted."
