MINUTES HELENA CITY COUNCIL

REGULAR MEETING

August 4, 2014

The Council of the City of Helena met in a regular scheduled meeting on Monday night, August 4, 2014 in the Helena Municipal Building at 6:00 P.M., regular place and time for holding said meetings.

Council President Cris Nelson called the meeting to order at 6:01 P.M.

Pastor Kirksey led prayer.

The Pledge of Allegiance was led by Mike Jones.

Roll Call

Present:

Members: Mayor Hall, Cris Nelson, Leigh Hulsey, Mike Jones, Leslie Bartlett and Harold Woodman

Absent:

Visitors: Doug Jones, George Pickle, John Wilder, Jason Powers, Dan Dearing and others (list attached)

Council President Cris Nelson declared a quorum present and meeting was open for business.

5. Minutes Approved/Corrected from Prior Meeting(s)

Leigh Hulsey made a motion to approve the Pre-Council minutes and Regular Meeting Minutes from July 21, 2014 with a second by Mike Jones.

AYE: Cris Nelson, Leigh Hulsey, Mike Jones, Leslie Bartlett and Harold Woodman

NAY: None

Motion carried.

6. Bills

Leslie Bartlett made a motion to approve the bills with a second by Leigh Hulsey.

AYE: Cris Nelson, Leigh Hulsey, Mike Jones, Leslie Bartlett and Harold Woodman

NAY: None

7. Report from Mayor Hall

Mayor Hall advised the following: Updated all on the Youth Football Field and advised it would be ready for the first home game which will be the second week of September, a scheduled ribbon cutting ceremony is planned for Saturday August 9th at 10am; Went over call for service for both police and fire departments; Advised all handled the plane crash well and would like to recognize the 2 gentlemen Duane Lovelady and Ralph Watkins that moved the plane crash victims to safety in the next council meeting.

8. Approve/Deny- Amending Noise Ordinance

Cris Nelson advised the noise ordinance currently has a time limit of 11pm Sunday-Thursday and 12am on Saturday-Sunday, and at officer discretion. It has been determined by the majority of council to go with decibel readings and to change the noise ordinance times as follows: (80)
db(A) during the hours of 6:00 a.m. until 9:00 p.m. or not to exceed seventy (70) db(A)
from 9:00 p.m. until 10 p.m. Sunday through Thursday and 9:00 p.m. to 12:00 a.m. Friday and Saturday at any property line within a residential district or upon any
public street or right-of-way within or bordering upon any residential district within the corporate limits of the City After stating this Cris Nelson opened it to council/audience for comments/questions.

Mike Jones wanted it pointed out that in Section 4 of this noise ordinance it is referring to Residential District.

Janelle Hopkins-Papa Saia’s stated that she was concerned with the 9pm drop off being city wide particularly around football season and as late as games stay on.

Cris Nelson stated to her that it would not be a continuous noise and this ordinance pertained to constant noise only.

Cris Nelson also stated that at 9pm that doesn’t mean anything has to be shut down it means the Decibel reading drops down to 70.

Mike Jones stated in order for this to be enforced a valid complaint and address must be given to the police department for them to investigate.

Mike Jones gave a motion to adopt Amendment to Noise Ordinance 829-13 with a second by Leigh Hulsey.

Motion carried.

9. Kylie Woodman-Creation of the Helena Teen Council

Kylie Woodman presented and explained to the council a plan of ideas, application, and a checklist of goals in order to achieve the beginning a creation of the Helena Teen Council. (Attached to minutes) She advised that Cris Nelson has accepted being her council liaison and would like all of the council to help with the application process.

Mike Jones gave a motion to create a Helena Teen Council with a second by Leslie Bartlett.

10. Proclamation- September Gynecologic Cancer Awareness Month

Jennifer Smiley was present and advised they have around 40 cities and the State Capital on board with this Proclamation and would like the City to turn Teal the month of September. She would like to light up city hall in teal colors and possibly the bridge coming into Old Town.

Leslie Bartlett gave a motion to adopt Proclamation making September Gynecologic Cancer Awareness Month with a second by Leigh Hulsey.

11. Council Comments

Harold Woodman: Recognized Duane Lovelady and Ralph for pulling the victims from the plane crash to safety; Congratulated HBA for a huge First Friday event, and the Helena Farmers Market.

Leslie Bartlett: Advised Kylie Woodman that she did great presentation.

Mike Jones: Invited everyone to come Saturday at 10am to the ribbon cutting for the new Helena Youth Football Field; and thanks the fire, police department on a job well done with the plane crash.

Leigh Hulsey: Advised that on July 26th the parks/rec had 34 kids to attend their first tennis clinic; Fall ball and softball registration starts today; summer basketball concluded its 4 weeks of summer classes; HHS athletic director is planning on having a Helena Husky Day on Saturday August 16th at HHS for all levels of football and cheer.

Cris Nelson: Thanked all for their input into the noise ordinance; Toured the Helena High School yesterday and it was amazing; and advised she would keep the council updated on the Helena Teen Council and is looking forward to working with Kylie.

12. Adjourn

There being no further business Leslie Bartlett made a motion to adjourn meeting with a second by Mike Jones at 6:41 P.M.
