In response to your appeal with regard of ruling of 30 May 2003 on the case 3a/34 we submit our opinion on the health condition of the following citizens: I. Jugeli, A. Tsulukiani, O. Gureshidze, and T. Kamushadze.

In accordance with the Ruling of Tbilisi District Court on the case #3 a/34 the following citizens have passed medical examination aimed at determining their health condition: I. Jugeli, A. Tsulukiani, O. Gureshidze, and T. Kamushadze. The aforementioned people are residents of 4, Uznadze Street. There is the TEC near to their house. The documents presented show that these people are under influence of hazardous factors, namely, SO2, NO, CO2, soot, dust, noise and electromagnetic radiation.

At the institute they have passed out-patient examination at the consultative policlinic with participation of: therapeutist, neuropathologist, allergist, oculist, oto-laryngologist, and cardiologist. The relevant para-clinical tests were made: chest X-ray, electrocardiography, test on functioning of outer respiration, audiometry, general blood and urine tests etc.

Having analyzed the examination results and on the basis of submitted Form 25, the health condition of the aforementioned persons was discussed at the session of Commission on Determination of Professional Diseases on 10 July (Record #19).

Tsulukiani Avtandil, born on 2 April 1942, resident of 4, Uznadze Street, registered at the policlinic #15 since March of 1985. From his Ambulatory Card #64 it is evident that in 1985 he was under treatment with the following diagnosis: fracture of surgical neck of a right shoulder connected with episode of the loss of consciousness. In 1989 he had received ambulatory treatment and at home for a month. He fell as a result of losing of consciousness. He was treated against the diagnosis: neck osteochondrosis, vertebral- basilar deficit, periodical anemia and vertebral- basilar crisis. As the Form 27 , provided by the policlinic shows, currently the patient is suffering with the following diseases: chronic bronchitis with asthmatic syndrome, dyspnoea of the 1st degree, vertebral- basilar deficit of the 1st degree, vertebral- basilar crisis, diminished hearing in the right ear, chronic catarrhal pharyngitis, double perceptive deafness, chronic gastritis, chronic cholecystitis.

In December 2002 the citizen was examined at the policlinic of the Scientific-Research Institute of Psychiatrics. He was diagnosed with: neurotic state, asthenic syndrome.

The citizen finds that his diseases are resulted from the sanitary-hygienic conditions on the territory of his residence.

In our Institute the citizen was consulted by the therapeutist, neuropathologist, oculist, oto- laryngologist. In addition, the para-clinical examinations have been carried out (chest X-ray, audiometry, test on functioning of outer respiration, general blood test). After examination he was diagnosed with: neurotic state, asthenic syndrome, chronic bronchitis with asthmatic component, dyspnoea of the 1st degree. The commission assumes that they may be caused by the lengthy influence of hazardous factors.

Jugeli Ivane, born on 13 January 1946, resident of 4, Uznadze Street. Form 27 sent by the joint-stock company “Mkurnali-99” shows that he has lost his ambulance card (Form 25), which has been destroyed as archive material and was opened from 1966. His individual record in policlinic is formalized in 2002. Currently the citizen is diagnosed with: obesity I-II, myocardiodystrophy, arterial hypertension of the 2nd degree with the frequent crisis.

In December 2002 the citizen the citizen was examined at the policlinic of the Scientific-Research Institute of Psychiatrics. After examination the following diagnosis was made: neurotic state, astheno-psychosis.

In our Institute the citizen was consulted by the therapeutist, neuropathologist, oculist, oto- laryngologist, and cardiologist. The relevant para-clinical tests have been made (general blood test, ECG, audiometry). After examination the flowing diagnosis was made: essential hypertension with crises, myocardiodystrophy, and obesity of the 2nd degree.

He assumes that his diseases are linked with the adverse conditions on the territory of his apartment

Otar Gureshidze, born on 1 April 1947, resident of 4, Uznadze Street. He is registered at the policlinic #15 since 1984. According to his medical record (#90) he used to visit out-patient policlinic for examination time by time. The echoscope test of 2002 revealed: N/B dyskinesia and right-side renal calculus.

In December of 2002 the citizen was examined at the policlinic of the Scientific-Research Institute of Psychiatrics, where, after the relevant examination, the following diagnoses were made: neurotic state, asthenodepressive syndrome.

In our Institute the citizen was consulted by the therapeutist, neuropathologist, oculist, oto- laryngologist. The relevant para-clinical tests have been made (general blood test, audiometry). The commission assumes that they may be caused by the lengthy influence of hazardous factors.

The citizen thinks that his diseases are linked with the adverse sanitary-hygienic conditions on the territory of his apartment.

Tengiz Kamushadze, born in 1949, resident of 4, Uznadze Street, registered at the policlinic #15 since 1998. The Medical Record (#927) shows that the citizen he used to visit out-patient policlinic for examination time by time. In the record of 10 March 2003 the following diagnoses is stated: neurocirculatory dystonia, chronic vertebral- basilar deficit.

In January 2003 the citizen was examined at the policlinic of the Scientific-Research Institute of Psychiatrics, where, after the relevant examination, the following diagnoses were made: neurotic state with the clear signs of asthenodepressive syndrome.

In our Institute the citizen was consulted by the therapeutist, neuropathologist, oculist, oto- laryngologist. The relevant para-clinical tests have been made (general blood test, audiometry). He was diagnosed with: vegetoasthenic syndrome. The commission assumes that this disease may be caused by the combined lengthy influence of hazardous factors. The following diseases are also revealed: chronic hypertropic pharyngitis, hypermetropia in both eyes, presbyopia.

The citizen thinks that his diseases are linked with the adverse sanitary-hygienic conditions on the territory of his apartment.

On the basis of Ruling of 13 May 2003 of Tbilisi District Court on appointing the expertise in response to the complaints of the citizens T. Kamushadze, A. Tsulukiani, G. Gochashvili, O. Gureshidze, L. Alavidze, and I. Jugeli against respondents: “ITERA”, “SAQGAZI”, “A-E-S TELASI”, “Tbilisi TBILELECTROCENTRAL”, Mayor’s Office of Tbilisi, The Ministry of Georgia of Fuel and Energy, the Ministry of Georgia of Environment and Natural Resources. The abovementioned case on 16 May 2003 was returned without examination as it was not possible to carry out examination without the following documents: the plaintiffs would have to pass the medical examination, in addition, the relevant individual medical cards would have to be provided by the relevant policlinic, as well as any other medical record demonstrating the health condition of the people subject to medical examination.

The court provided all documents requested by the expert. Accordingly, herewith I submit the given case to be transferred to the competent expert.
