INTERNSHIP AGREEMENT

General considerations

This internship is a compulsory part of the BTS STA . This BTS is a Higher National Diploma in food sciences and is a 2 years course. It is an undergraduate course which leads to a one year Bachelor after obtaining the diploma.

The purpose of this agreement is to set up for the benefit of the designated student a training period either possible or made obligatory by the official programme of his/her education or study. This training period shall correspond to an application or an introduction or a training period in the work environment related to the teaching dispensed in the vocational training institution.

It shall be monitored and supervised by a company or organisation tutor appointed for this purpose by the head of the host organisation if he is not himself the organisation tutor. The student shall participate in the tasks specified below (purpose of the training period), which is a part of this agreement. In no case, may his/her participation to these activities be detrimental to the employment situation in the host company or organisation. The trainee shall be bound to respect professional secrecy.

Aims and objectives of the internship

Whatever the nature of this short placement, an internship is a period the duration of which is some weeks or months. During this period, the trainees are placed in a firm, a corporation, an organisation or one of the departments of an enterprise in order to:

-get in touch with practical realities and professional life (work, working conditions, working atmosphere, etc.)

-put to practical use the education received in the institution

-become aware of the duties and responsibilities which fall on the manager and his staff

Student’s duties

Article1 : The student is obliged to carry out the task set by the manager of the firm or organisation.

He must also behave in a responsible manner. The student must thus stick to the rules and regulations of the

firm and more particularly to the work schedule and the protection of health regulations. The trainee commits

him/herself to respect the instructions and carry out all tasks to the best of his/her ability, as directed by the

people in charge of the training and to abide by the different internal regulations of the receiving

country/employer.

Trainer’s duties

Article 2 : The manager must:

-give the student tasks related to his capabilities taking into account the aims of the placement

-make sure that the student is able to use the cars or machines which he may be asked to use

-guide the student and supervise his work

-give the student information and the documents which are necessary for him to make his/her work or allow him to go and look for these documents.

-give a short assessment of the work done by the student (fax/e-mail/phone)

Purpose

-
1re week: global approach of the production of tea (agronomy, botany, difficulties of production, presentation of the industry, water issues linked to tea production).

-2nd week: discovery of the plants of tea of the campus and the close neighbourhood

-3rd week: visit of companies and works at various producers (visit in particular of the factory HANQUA (black tea), of the factory MATIGARA (Green tea) and of the very renowned plantation of MAKAIBARI, the very big organic plantation and visits in the Darjeeling ( biodiversity) .

-Blogagri or Powerpoint on a theme given by the team of the university (in connection with the specialization of the students)

-A video made by the group of students highlighting the work and focusing on a specific subject linked to their course. This video will be posted on the MOVEAGRI website

Duration of training periods

This Agreement will be valid From08 June, 2015To04 July, 2015

Article 3 : Should a change occur, a new contract will have to be signed between the receiving enterprise and the institution

Work site and working hours

Article 4 : The trainee shall retain his student status throughout his/her training period and will therefore remain under the authority of the principal of the vocational training institution. He/She is bound to respect the general rules applying in the host organisation, particularly with regard to safety, working hours and discipline, subject to the specific provisions on the protection of young people at work, in application of the Directive n° 94/33/CE of 22 June 1994. The working hours should not exceed 35 hours a week.

For the duration of this Agreement the trainee will be working at the following site(s):

Financial aspects

Article 5 : As agreed between the two parts, the student will pay for transport from Delhi to the host organisation.

Accommodation (food and lodging) and local transport for work purposes will be provided by University of North Bengal - Tea Science department. The cost of training fees, accommodation and local transport for work purposes will not exceed 470 euros as agreed between the two parts. Students will pay in Rupees once they arrive at the university.

Social Security, health and accident insurance

Article 6 : The sending institution principal shall make the necessary provisions to cover his third party liability each time it is engaged. The host company or organisation shall make the necessary provisions to cover his third party liability each time it is engaged.

The student must be covered by specific insurance for the damage he might cause to the property of the head of the host organisation or company. Damage occurring outside the host company or organisation during activities that are external to the work has to be covered by the student.

The employer’s obligations continue throughout the duration of the internship agreement. In the case of an accident to the trainee, either when working or when in transit, the relevant responsible person at the receiving enterprise or organisation has an obligation to complete an accident notification and send it within 24 hours to the original employer (ie the contract signatory). Please call the contact person (see below) in case of any problem. The LEGTA has then 48 hours to send the notification by recorded delivery, with a request for acknowledgement of receipt, to the Agricultural Social Insurance Organisation (MSA).

When the duties carried out by the internship in the receiving enterprise require special health and safety checks, in line with Health and Safety legislation, the receiving enterprise is responsible for implementing these. The principal of students dispensation from the use of dangerous machines and products is also valid for the receiving enterprise for the duration of the training period abroad.

Medical and surgical assistance

In case of emergency, the student (or his legal substitute) allows the firm manager to take the initiative and ask for immediate medical assistance or surgical operation. If any accident happens, the manager of the firm binds himself by contract to send immediately all the necessary notifications to the Director of the LEGTPA FRANCOIS RABELAIS.

The teaching establishment will ensure the student repatriation in the event of the termination of the agreement by the host organisation, the non-respect of the agreement by the host organisation, illness, serious accident or death. In the case the student arbitrarily breaks this agreement, it will be up to the institution to claim the reimbursement form the student or his/her legal representative. It is recommended to take out insurance against this.

Termination of the agreement

Article 7 : The principal of the vocational training institution and the head of the host company/organisation will keep each other mutually informed of any difficulties, particularly linked to absenteeism on the part of the trainee, which might arise from the application of this agreement, and will take by mutual agreement, the appropriate steps to put an end to them. In any event, the head of the host company may decide, after having informed the principal of the vocational training institution, to terminate the training period in advance in case of serious lack of discipline on the part of the trainee. The principal of the vocational training institution may terminate the training period at any time if the host company/organisation no longer meets the labour legislation in the host country.
