Millewa Land Act 1911

Preamble

WHEREAS pursuant to the provisions of The Land Act 1884 and The Agricultural Colleges Act 1884 and Orders in Council dated the ninth day of December One thousand eight hundred and eighty-five[1] certain Crown lands described in the Schedule to this Act were together with certain other Crown lands permanently reserved from sale as endowments for State Agricultural Colleges and Experimental Farms:

AND WHEREAS the lands described in the Schedule to this Act were by virtue of The Agricultural Colleges Act 1884 vested in trust in trustees appointed thereunder and have (subject to the said Act and any amendment thereof and the Agricultural Colleges Act 1890 and any amendment thereof) continued to be vested in trustees appointed or continuing to act as trustees under the authority of the said Acts (hereinafter referred to as "the said trustees"):

AND WHEREAS it is expedient that the permanent reservation of the lands described in the Schedule to this Act should be revoked and that such lands should cease to be vested in the said trustees in order that the same may be dealt with as unalienated lands of the Crown:

AND WHEREAS it is expedient that in lieu of the moneys heretofore received by the said trustees as rents for the lands described in the Schedule to this Act certain payments should be made to the said trustees out of any moneys which may hereafter be provided by Parliament for the purpose:

BE IT THEREFORE ENACTED by the King's Most Excellent Majesty by and with the advice and consent of the Legislative Council and the Legislative Assembly of Victoria in this present Parliament assembled and by the authority of the same as follows (that is to say):

1.Short title and commencement

This Act may be cited as the Millewa Land Act 1911 and shall come into operation on the first day of January One thousand nine hundred and twelve.

2.Revocation of reservations

Notwithstanding anything contained in any Act—

(a)the said recited Orders in Council of the ninth day of December One thousand eight hundred and eighty-five so far only as they relate to the lands described in the Schedule to this Act shall on the commencement of this Act be and the same are hereby revoked; and

(b)the lands described in the Schedule to this Act shall on the commencement of this Act cease to be vested in the said trustees and by virtue only of this Act and without any conveyance or transfer shall be vested in His Majesty freed and discharged from any trusts limitations and restrictions whatsoever and shall be deemed to be and may be dealt with as unalienated lands of the Crown.

3.Annual payment to trustees

s. 3

(1)In each and every period of twelve months after the date of the commencement of this Act there shall be paid to the trustees for the time being under the Agricultural Colleges Acts a sum not exceeding Eight hundred and eighty-five pounds ten shillings out of any moneys which may hereafter be provided by Parliament for the purpose.

(2)Every such sum shall be dealt with by such trustees in manner provided for dealing with moneys received by such trustees as rents for lands demised by them under the authority of the said Acts.

Lands permanently reserved as endowments for State Agricultural Colleges and Experimental Farms by Orders in Council of the 9th December, 1885, vide Government Gazette of the 6th November, 1885, page 3036, and the 11th December, 1885, page 3478.

LINDSAY ISLAND—Forty-two thousand acres, more or less, county of Millewa, being the land bounded on the north by the Murray River, and on the south and south-west by the Lindsay River, and known as Lindsay Island. Excepting allotment A, parish of Warina.

MULLROO AND YELTA—Twenty-eight thousand six hundred acres, more or less, county of Millewa, parishes of Mullroo and Yelta:

Commencing at the junction of Mullroo Creek and the Murray River, bounded thence by the said creek and the Wallpolla Creek easterly to a point bearing south from the south-east angle of allotment 3 (Upper Kulnine preemptive section), parish of Yelta; thence by a line bearing north to the said angle; thence by the said allotment bearing S. 89º 55' W. forty chains; and by that allotment and a line bearing N. 0º 5' W. to the Murray River aforesaid; and thence by that river downwards to the point of commencement.
