PET PURCHASE AGREEMENT:

This agreement is entered into on

between the buyer

and the seller SacredSpirit Cattery ,

for their mutual protection and especially for the protection and well being of the cat.

For the sum of , the seller does hereby transfer to the buyer one kitten of at least 12 weeks of age.

SELLER AGREES TO:

·  have the kitten inoculated against feline panleukopenia, feline rhinotracheitis, calicivirus, chlamydia psittaci,

·  if at least 4 months of age at time of transfer, have the kitten inoculated against rabies, at buyer’s expense ($12),

·  have the kitten treated for round worms at least twice prior to delivery,

·  have the kitten examined by a licensed veterinarian, who will issue certificates of health and of vaccination,

·  provide documentation necessary to register a Breed quality kitten in TICA and/or CFA, as applicable, which will allow buyer to purchase a pedigree from the applicable organization,

·  if requested by the buyer, have a Pet quality kitten altered at buyer’s expense prior to shipment,

·  provide documentation necessary to register a Pet or Show quality kitten with TICA and/or CFA, as applicable, only after the buyer provides written evidence, signed by a licensed veterinarian, that the kitten has been altered (a Pet quality kitten will be registered as NOT FOR BREEDING and NOT FOR SHOW, a Show quality kitten will be registered as NOT FOR BREEDING), and

·  transfer the kitten to the buyer’s chosen delivery service only upon receipt of this document, signed by both buyer and seller, and upon receipt of the sum of money agreed upon in the above Pet Purchase Agreement.

SELLER’S GUARANTEE:

The seller guarantees the health and the quality of the kitten at the time of sale. If the kitten is designated above as Show quality, the seller guarantees that the kitten was free of any conspicuous genetic defects at the time of sale, but does not carry any responsibility for later development of the animal or for his or her success or failure in exhibitions.

BUYER AGREES TO:

·  if less than 4 months of age at time of transfer, have the kitten inoculated against rabies,

·  have a Pet quality kitten, if so designated above, spayed or neutered when the kitten is from 6 to 8 months of age,

·  take a Show quality kitten to exhibition(s) sponsored by the applicable registry and its affiliate clubs,

·  provide adequate nutrition,

·  provide clean, fresh water at all times,

·  provide veterinary care when necessary,

·  pay a non-refundable deposit of $150 if the kitten is to be held on Reserve for more than two weeks prior to shipment or, otherwise, pay a non-refundable fee of 30% of the cost of the kitten to defray all administrative costs associated with the purchase,

·  pay all fees for shipping and delivery, including carrier ($25), veterinary examination ($15), veterinary health certificate ($20) and, if applicable, acclimation certificate ($15), and

·  notify the seller if, for any reason, the buyer is unable to properly care for the kitten:

o  the seller reserves the right of first purchase in the event that the buyer chooses to sell the kitten

o  in the event that the kitten is to be returned to the seller, buyer will pay all fees for shipping and delivery, except the cost of the carrier will be reimbursed to the buyer.

BUYER AGREES NOT TO:

·  breed the kitten, if designated above as Pet quality,

·  sell or give the kitten to any research facility, shelter, pound, or pet store,

·  permit the kitten to roam freely outside, or

·  declaw, neglect, or otherwise abuse the kitten.

EXCEPTIONS AND CLARIFICATIONS:

BREECH OF CONTRACT:

Buyer: In the event that the buyer is found to be in default of this contract, the buyer will, at the seller’s discretion, return the kitten to the seller. The buyer will have the kitten examined by a licensed veterinarian and pay all costs to insure that the kitten is healthy and free from parasites prior to its return to the seller. Refund of the purchase price will be determined based upon the degree of violation(s). All disputes will be argued in the court system of Jefferson county in the state of Idaho.

Seller: In the event that the kitten is found to be ill within 72 hours of the transfer between buyer and seller, based upon an examination by a licensed veterinarian, a full refund will be granted or the kitten will be replaced at the discretion of the buyer. However, the seller will not accept responsibility for any viral or bacterial infections that occur after the time of sale and will not be responsible for veterinary fees incurred.
