With reference to your brochure published in your website www.mankulangarahomestay.com, I am interested to join in the scheme for a …………… Bed Room unit during …………. season under the prescribed terms and conditions.

Terms & Conditions:

1.  I have selected a ……….. Bedroom unit in …………... season in the same.

2.  The period of stay for the above is limited for 200 days (Two Hundred days only) in total within 10 years divisible with 20 days per year (ie; Number of days per year is 20 and number of years is 10). If the contract cannot be performed within 10 years, an additional facility for an extension of 2 years is also permissible to the client concerned.

3.  The customer facility includes fully furnished houses with bath attached air conditioned bed rooms, living/dining hall, Laundry, Cleaning, Room boy service, Cable TV, Bed Sheet, Turkey Towel, Security with CCTV Camera, Full-fledged Kitchen with Cooking Gas for those who need it. Service of Cook will not be available. Additional Charges will be levied for food, if any.

Note: For 1 bedroom unit, kitchen facility will not be available.

4.  The customer must inform through e-mail regarding his proposed date of arrival and stay at least 90 days in advance and confirmation from management must be obtained through e-mail. Irrespective of the advance booking, i.e. before 90 days, in exceptional/unavoidable circumstances short notice booking is also in allowed/permitted subject to the availability and discretion of the owner of the homestay.

5.  Advance booking for stay must be at least for continuous 10 days ie. Advance booking below 10 continuous days will not be permitted.

6.  The names of the proposed persons other than you who are intending to stay must be informed through email during the time of booking.

7.  The forms relating to the rules & regulations as prepared by us from time to time must be duly signed by the respective person at the time of arrival. Also as required by the law, identity of all persons staying in the Homestay should be provided.ie, relevant pages of passport and OCI card and other ID Proofs etc.

8.  Usage of Electricity will be charged separately as per meter reading and the same is not a sale. AC will not be working at the time of power failure.

9.  The owner of the homestay is at liberty to issue 2 bed room +1 bed room for a 3 bedroom unit.

10. The eligibility to use the units is limited for 20 days in a year. But, if the client wishes to stay beyond the limited period, he can avail/use extra days subject to availability of the units at the homestay owners discretion.

11. A change in booking date can be made subject to the availability of accommodation, solely at the discretion of the management.

12. If the period of stay during a year is less than 20 days, the balance number of days can be carried forward to the remaining years.

13. Seasons will be decided from the booking date onwards. Off-season customer can continue his stay during normal season or hot season. However, that customer has to pay an additional amount of Rs. 250/- for normal season and an additional amount of Rs. 500/- for hot season per day. Normal season customer can continue his stay during hot season. But that customer has to pay an additional amount of Rs.250/- per day. This type of changes will only be allowed as per the discretion of the management. Hot season customer can continue his stay during normal season or off-season. Also normal season customer can continue his stay during off-season. But no deduction will be given for both the cases. This type changes will only be allowed at the discretion of the management.

14. The investor can offer this facility to his or her friends, relatives etc.

15. If a booking is confirmed and if the accommodation is not used, the number of days for which booking was done will be deducted from the balance available days.

16. Due to any technical reasons, if the management is not in a position to provide the required stay facility for the clients in our units, we have the full right to arrange alternate stay at other homestays within 2.5kms radius of the KSRTC Bus stand, Thiruvalla.

17. There is a provision for the client to select a nominee in the arrangement. If anything occurs to the client during the course of allotted period, the nominee can also avail the facility in the same terms and conditions applicable to the original client. The full address and identity of the nominee should be provided along with the nomination.

18. The payments to the same once made will not be refunded for any reason and the client has to complete the eligible 200 days stay within the period of twelve years (10+2=12 years).

19. In case of any unforeseen circumstances/exigencies /Act of God, if the owner of the Homestay is not able to perform his portion of the contract, he will be at liberty to return the amount paid by client proportionally for the balance period of unused years of the unit contracted and calculated at the rate of 20 days per year or 200 days minus the number of days occupied at the time of closure whichever is less. The balance amount to be paid back shall bear simple interest of 6 percent per annum for the remaining period.

(Eg: A person is eligible for 20 days in a year and in 5 years he can use 100 days). Refundable amount will be calculated as follows:

a) 200 eligible days – 100 used days, balance 100 days

b) Even if he is using only 50 days in the five year period, balance 50 days will lapse and refund will be for 100 days only.

c) In case in the above example the person entitled for 100 days in 5 years and if he uses 150 days, (ie. Over use by 50 days) the refund will be calculated as follows: 200 – 150 = 50 days.

20. Other than the initial payment, the investor does not have to pay any amount during the 10 years. Any increase in rent for accommodation for coming 10 years will not affect those who join the scheme now.

21. The amount paid by the client initially will be accounted as advance in his/her name. After availing the homestay each time, a bill will be prepared for the actual period of stay and this amount will be deducted from the outstanding advance amount.

22. All disputes shall be subject to the jurisdiction civil courts of Thiruvalla only, ie. in Pathanamthitta District of Kerala, India. The Client has no right to file any type of case / dispute outside Thiruvalla and outside India. The client and his nominee have no right to file any type of case/dispute outside Thiruvalla and outside India. Only relevant Indian rules shall be applicable for this transaction. Rule applicable in any other country shall not be applicable in this transaction and deal.

23. Above all, in an emergency situation irrespective of any sort of package and season, units will be provided to the client subject to the availability and as per the discretion of the management.

24. The client is at full liberty to nominate anybody to use his unit with a written consent and an intimation letter to the owner of the homestay concerned.

25. I have read the Brochure attached to this application and I understood all the terms and conditions prescribed in that brochure and I agree with that terms and conditions also.
