Main Collective Agreement- Bargaining Council for the Restaurant, Catering and Allied Trades- Amendments

There have been some recent changes in the Main Collective Agreement of The Bargaining Council for the Restaurant, Catering and Allied Trades. This agreement is applicable to the magisterial district of Alberton, Benoni, Boksburg, Brakpan, Delmas, Germiston, Johannesburg, Kempton Park, Krugersdorp, Randburg, Randfontein, Springs and Westonaria.

It is important to note that these amendments have already been established since the 17th of September 2015 and that this agreement shall remain in force for the period ending on the 21st of May 2018. Any contravention of this agreement may result in a dispute with the Council and could ultimately result in an arbitrator who will make an appropriate award and issue an employer with a fine.

Amendments include, but are not limited to the following:

·  Minimum Wage increases (indicated in Table 1 below).

·  Employees, other than part-time, casual, special function and commission workers, annual bonus payable during December (indicated in Table 8 below).

·  When an employee launders his own uniform/overall/protective clothing an employer must reimburse the employee with R 20, 80 per week (as stated in Table 9 below).

·  Where a special-function casual employee is required to work for less than three hours on any day he shall be deemed to have worked for three hours. This has been amended from five hours to three hours.

Whenever the amount owing to the Council indicated in Table 2 above is not paid in full on the due date a penalty of 10% shall be added to the payable amount, as includes the penalty for failure to implement the minimum prescribed hourly wage.
