LV LIVE JOINTING ADDENDUM TO STANDARD TERMS AND CONDITIONS FOR CONSTRUCTION AND ADOPTION Version 2

The following terms and conditions apply in addition to the Standard Terms and Conditions for Construction and Adoption (“Standard Terms”), where the Independent Connections Provider is undertaking Live Jointing to Mains work on UK Power Networks’ Distribution System as part of the Contestable Works (as defined in the Standard Terms).

1Definitions and Interpretation

1.1Defined terms in the Standard Terms have the same meaning in this Addendum.

1.2Addendummeans this addendum to the Standard Terms.

1.3Approved Signal Injection Device Servicemeans the service set out in Schedule Three to this Addendum.

1.4Cable Identification Proceduremeans the ICP's procedure for cable identification, to be of no lesser standard than that set out in document reference DSR 01 018 entitled 'Identification of LV Cables', which can be found here: that the ICP is not permitted to use a signal injection device for cable identification.

1.5Confirmed SORNmeans a SORN confirmed in accordance with clause4.5below.

Daily Whereabouts Reportmeans all information required to be given to the DNO in order that the DNO has clear understanding of the location of Your Works on any given day and the individuals who will be undertaking the Works.

1.6DNO Policiesmeans any engineering or health and safety policy issued by the DNO, as amended from time to time, including, without limitation, those listed in Schedule 1.

1.7Interconnected Network means that part of London Power Networks plc’s Distribution System that is inter-connected as opposed to being radial;

1.8Letter of Acceptancemeans a letter of acceptance to work on the DNO's Distribution System issued to an employee of You following their successful completion of a test prescribed by the DNO to demonstrate craft skills sufficient to safely undertake the Works to a standard suitable for Adoption.

1.9Linking and Fusing Servicemeans temporary preconditioning work carried out by the DNO prior to live jointing activity taking place. This chargeable service involves reducing the number of LV circuits operating in parallel, and/or reducing fuse sizes, in order to minimise fault levels and potential fault clearance times whilst normally maintaining electricity supply to end user customers provided in accordance with CON 03 062LPN Linking and Fusing Service referred to in Schedule 1 to this Addendum.

1.10Low Voltage Distributing Mainsmeans as those terms are defined in theElectricity Safety, Quality and Continuity Regulations 2002.

1.11Provisional SORN means a SORN issued on a provisional basis.

1.12SORNmeans a system operation reference number electronically provided by the DNO to identify the limitations of the Works.

1.13Works are as defined in clause 2.1.

2The Works

2.1The installation of new 230/400 volt underground mains or service cables and their jointing to the DNO's Low Voltage Distributing Main in accordance with CON 08 106 (or any replacement document) as provided to you by the DNO. The Works form part of the Contestable Works and must in addition to the terms set out below comply with the Standard Terms.

2.2“Live” jointing pursuant to this Addendum is restricted to jointing of new low voltage underground mains and service cables for metered connections to the DNO's Low Voltage Distributing Mains.

2.3You are permitted only to carry out LV ‘connection activity’ for the connection of metered mains and service cables. ‘Connection activity’ is as defined within the NERS scopes of work. You are not permitted to undertake any form of ‘operational activity’.

2.4Youand any subcontractor carrying out the Works shall either hold full accreditation under the terms of the National Electricity Registration Scheme (NERS) for Safety Management System and Live Jointing Module(s) or hold partial accreditation and be taking part in the Works as part of receiving full accreditation for such modules.

2.5You shall carry out the Works in accordance with UK Power Networks’ Policies listed in Schedule 1. You should request a copy of the relevant documents from the DNO, if You have not already received them.

2.6You are not permitted to carry out the Works on the Interconnected Network,or on any part of London Power Networks plc’s Distribution System that is fused in excess of 400 amps, unless you have requested and the DNO has provided the Linking and Fusing Service in accordance with CON 03 062LPN Linking and Fusing Service. The DNO shall only be required to provide the Linking and Fusing Service upon receiving a request in writing from You.

3Health and Safety

3.1You acknowledge that no person shall be engaged in any Works activity on or near any live conductor (other than one suitably covered with insulating material so as to prevent danger) unless:

3.1.1it is unreasonable in all the circumstances for the live conductor to be dead; and

3.1.2it is reasonable in all the circumstances (as to which the DNO gives no warranty) forYou and any person to be at work on or near the live conductor while it is live.

3.2You shall take all suitable precautions (and You shall procure that all suitable precautions are taken) to prevent injury, including but not limited to:

3.2.1providing your employees with all necessary safety equipment to enable them to work in a safe manner; and

3.2.2ensuring the safety of the public by providing signing, lighting and guarding and ensuring that energised terminations are not left exposed and are effectively sealedby use of a removable seal intended only to be removed by the DNO or the electricity supplier’s appointed meter operator, so as to prevent anything other than wilful removal.

3.3You shall carry out the Works in accordance with your own safe system of work. Whilst You remainresponsible for implementing your own safe system of work, You shall ensure that such system is of no lesser standard than that set out in the DNO’s distribution safety rules and jointing manual, and other documents set out in Part 2 of Schedule 1, receipt of a copy of which You hereby acknowledge. Before commencing any Works You shall undertake a review to ensure that its safety rules are to no lesser standard than those of the DNO and that there are no conflicts and shall ensure that any potential conflicts which are identified are brought to the attention of the DNO before Works commence. You shall ensure that you check regularly on the DNO's website for updates and addenda to the DNO's distribution safety rules and such other documents.

3.4You shall carry out the Works in accordance with HSS-40-045 to be found at

3.5Where You have requested the DNO to carry out the Linking and Fusing Service and before You putyour staff to work on the Distribution System, You shall make all appropriate checks and shall satisfy yourself that the Linking and Fusing Service carried out by the DNO has achieved the conditions required for You to commence the Works in accordance with Your own safe system of work.

3.6You shall advise the DNO in writing of the existence of asbestos and other hazardous or toxic substances in the areas in which You or the DNO will or may carry out your respective obligations and shall at your own cost remove the same.

3.7You shall ensure that all products and materials used conform with the DNO Policies (that can be found at or, where no DNO Policy exists, with relevant British or European Union Standards or Codes of Practice or which at the time of use are widely known to contractors within the European Union not to be deleterious to health and safety or to the durability of buildings and/or other structures and/or finishes and/or plant and machinery in the particular circumstances in which they are used.

3.8Before carrying out any Works in relation to any Low Voltage Distributing Main of the DNO You shall follow the Cable Identification Procedure to positively identify the DNO's Low Voltage Distributing Main without the use of a signal injection device. If You are unable to identify the DNO's Low Voltage Distributing Main with absolute certainty in accordance with the Cable Identification Procedure without the use of a signal injection device, You shall either not proceed with the Works or request the DNO to provide its Approved Signal Injection Device Service in accordance with the terms in Schedule Three.

3.9On the occurrence of a Health and Safety Incident involving the DNO’s Distribution System:

3.9.1You shall immediately inform the DNO by calling AIRLINE on 08701 963246. Incidents involving: short circuits, electrical flashover, electric shock to any person, etc. shall be reported to UK Power Networks immediately using the ‘flash call’ procedure EPN: 08701 962899, and SEPN 08433 102244; and LPN: 08701 961297;

3.9.2the DNO, acting reasonably, may at the Your cost (or the Your agent’s cost as the case may be) appoint a Health and Safety Expert appropriate to the incident to examine the facts and make reasonable recommendations for health and safety matters through such increased monitoring regime as reasonably he shall determine as being appropriate in the circumstances and You or Your agent shall providing it is reasonable, at its own cost implement and comply with such recommendations and monitoring regime; and

3.9.3the DNO may temporarily withdraw any Letter of Acceptance issued by the DNO to any individuals involved in the Health and Safety Incident.

4Programme and Commencing Works

4.1You shall not undertake Works at a Site without first obtaining the consent of the DNO, by way of the issue of a Confirmed SORN in accordance with the process set out in clauses 4.2to4.9 below, and set out in more detail in document CON 08 106 - Competitions In Connections - Procedure for ICP LV Metered Live Jointing to Mains Trials (and any revision or replacement of the same) as provided by the DNO to You. You shall comply with such document when carrying out the Works.

4.2You shall request a SORN from the DNO byproviding the proposed Programme to the DNO for approval, along with all other documents required in the document referred to in clause4.1a minimum of ten (10) Business Days in advance of the proposed start date of any section of the Works.

4.3The DNO will endeavour to respond to the request to carry out the Works within five Business Days by the issue or refusal of a Provisional SORN.

4.4You shall submit a Daily Whereabouts Report to the DNO a minimum of three days before commencement of the Works at the particular Site which shall include the name of those of its employees who are to carry out Works at each Site.

4.5Subject to the Provisional SORN having been issued, and the Daily Whereabouts Report provided in accordance with clause 4.4, the DNO shall,no later than the day before the proposed date for commencement of Works at a Site, either confirm the Provisional SORN free from conditions, or acting reasonably may:

4.5.1require that You do not carry out all or any part of the Works;

4.5.2identify any specific apparatus to which the permission does not apply;

4.5.3require that You carry out Works otherwise than in accordance with the Programme; or

4.5.4state any other restrictions or comments which it in its absolute discretion deems appropriate.

4.6The DNO is under no obligation to grant a Confirmed SORN, but will provide reasons for any refusal.

4.7You shall not commence the Works at any Site unless and until:

4.7.1the DNO approves in writing the Programme; and

4.7.2You have received a Confirmed SORN; and

4.7.3You have positively identified the DNO's Low Voltage Distributing Main with absolute certainty as required by Clause 3.8of this Addendum.

4.8Subject to the provision in writing of the Daily Whereabouts Report the DNO shall notify You from time to time of changes to the Inter-connected Network which affect Your proposed Works.

4.9The DNO acting reasonably may withdraw the SORN at any time. Withdrawal of the SORN shall be made by notice in writing, shall include written reasons for the withdrawal of the SORN, and shall have effect from the date upon which it is notified to You. The DNO shall not be liable to You for any losses incurred as a result of the withdrawal of the SORN unless the withdrawal of the SORN is made unreasonably or vexatiously.

5Carryingout theWorks

5.1You shall maintain a list of those of Youremployees or subcontractors who will be carrying out Works pursuant to the Notice and shall provide to the DNO a copy of the list, together with evidence of competency and certification of such employees at the outset of the Programme and before any new employee undertakes any part of the Works.

5.2All of Your employees (and that of Your subcontractors) carrying out all or any part of the Works shall:

5.2.1be competent and trained in the methods and practices required to undertake the Works;

5.2.2be authorised by You (without any subjection or reservation) to carry out such Works;

5.2.3have attended for its duration and passed the DNO’s network familiarisation and assessment in the three (3) months immediately before commencing the Works or shall have provided the DNO with evidence of ongoing competence and awareness;

5.2.4hold a Letter of Acceptance.

5.3The DNO shall have no authority to give any instructions to or to supervise You, provided that the DNO may issue any reasonable instructions which it considers to be necessary on safety grounds and You shall comply with instructions issued in such circumstances.

5.4Where You in the course of carrying out the Works encounter any equipment materials or apparatus belonging to the DNO which You consider is or may be faulty, damaged or in disrepair, or which reasonably You should consider to be or may be faulty, damaged or in disrepair You shall inform the DNO immediately and in writing by the following Business Day and shall, at the option of the DNO:

5.4.1replace such equipment, materials or apparatus under the terms of the Notice at the DNO’s cost (where You have not caused the damage) as previously agreed in writing with the DNO’s nominated representative and shall continue the Works; or

5.4.2immediately cease all work which may be affected by the fault damage or disrepair and ensure that the equipment materials or apparatus is made safe or cordoned-off until the DNO, which shall react promptly, has procured reinstatement of the fault damage or disrepair or has confirmed that the equipment, materials or apparatus is safe.

5.5You shall ensure that a Quality Label is attached to the end of fitted joint and cut out.

5.6You are fully responsible for all necessary excavation, interim and permanent reinstatement. Excavation shall be sufficient both for jointing and positive identification if multiple cables are present.

6Inspection, Testing, Checking, Energisation and Adoption of the Works

6.1You shall notify the DNO of the completion of Works at a Site on the day that they are completed. If the Works are not completed in accordance with the Programme, you must notify the DNO.

6.2Following completion of the Works at a Site You shall carry out Your Tests and shall immediately provide the DNO with records of Your Tests. Where any of Your Tests fail, You shall carry out any Works of Rectification required and then shall carry out the Your Tests again.

6.3Within 2 Business Days of completion of the Works at a Site You shall provide the DNO:

6.3.1a completed form as set out in Schedule 2 including accurately marked up as constructed records and an accurate “as built drawing” of each Connection;

6.3.2all relevant RIGS Information;and

6.3.3all other relevant information and documentation reasonably requested by the DNO.

6.4You shall provide the DNO with such assistance in carrying out any Tests as the DNO shall reasonably require.

6.5Where the Works fail any Test, the DNO may instruct You to undertake the required Works of Rectification at Your cost and may require You to carry out no other part of the Works until authorised to do so.

6.6You shall carry out such Works of Rectification within 15 Business Days of notification by the DNO and shall notify the DNO once the Works of Rectification are completed. The DNO may following receipt of written notification by You completion of the Works of Rectification under this Clause, decide in its absolute discretion to make a further Inspection and shall be entitled to charge for such.In the event that the Works of Rectification fail such Inspection it carries out, clauses 6.5 and 6.6shall apply in respect of rectifying the same.

6.7Where in the reasonable opinion of the DNO, the Works of Rectification have not been carried out in accordance with this Addendum the DNO may:

6.7.1carry out the Works of Rectification itself and be reimbursed by You the reasonable costs incurred; or

6.7.2requireYou to complete the Works of Rectification to the DNO’s reasonable satisfaction; or

6.7.3if Energised, De- Energise the Works; or

6.7.4by written notice to You terminate the Notice.

6.8Upon completion of any Works of Rectification You shall carry out the Tests again andthe DNO may atits absolute discretion carry out an Inspection. Clauses 6.5 to 6.7shall apply in the event that any Tests fail, or the DNO is not satisfied by any Inspection.

6.9You shall pay to the DNO its costs of any Tests, inspections and abortive visits (being £175 per site inspected or such other rates as may be agreed between the Parties or which the DNO may be entitled to charge by virtue of its published Connection Charging Methodology from time to time in force). The inspection frequency will be in accordance with the DNO’s policy which may vary for different asset categories. The frequency will be lowered in relation to work volumes and the level of successful audits as described in the DNO’s policy. If an increased frequency of inspection is justified by the circumstances (for example if the audit identifies issues of concern) the DNO may recover also the increased costs as are reasonably incurred by it as a consequence thereof. The DNO shall review the rates herein and any rates shall be cost reflective in accordance with the DNO’s License.
