Restrictions on the use of a Building Notice

A Building Notice cannot be submitted if: -
  • There is a public sewer (as shown on the water company’s map of sewers) within 3m of any extension or new building.
  • Where work includes the erection of a building fronting onto a private street.
  • Where the building (or part of the building) is subject to the Regulatory Reform (Fire Safety) Order 2005 (typically commercial buildings and common parts of flats).

This application must be accompanied by a site plan to a scale of not less than 1/1250 showing:-
  • The location of the extension or building
  • Its relationship to the boundaries of the site.
Under Regulation 13 (3), reasonably detailed plans are also required for loft conversions, large extensions, and new dwellings. In addition you are reminded that DER/TER and water efficiency calculations must be submitted for the erection of new dwellings, in the case of DER/TER calculations, not less than 1 day before the commencement of work.

Statement 1

I understand that the Building Regulation fees are not fixed, and whilst a refund may be given by the council where the estimated time used to calculate the fees is more than 1 hour more than the actually time incurred, I agree to pay additional charges where the District Council incurs more than an additional 1 hour of time in providing the Building Regulation service.
Statement 2
This notice is given in relation to the building work as directed, and is submitted in accordance with Regulation 12 (2) (a) and is accompanied by the appropriate fee.

I understand that where I have requested to pay my application charge by invoice, that the application is not legally submitted until such time as the invoice is paid, and that if works commence on site that they do so at my own risk.

Notes:

Section 1. Use this section to tell us the applicant’s details. Unless Section 2 is completed, this is the person or organisation that we will communicate with.

Section 2. Use this section to tell us who is handling the work on your behalf, e.g. architect, plan drawer. All correspondence, except invoices and completion certificate will be sent to his person/organisation. We may use these details to contact them at a later date to advise them of our marketing initiatives and changes to legislation.

Section 3. Use this section to tell us where the work will take place. Please note that the official address should be used. If this is the same as the applicants address, please state “as above”

Section 4. Use this section to tell us what work you want to do. The description should be brief, e.g. ‘single storey kitchen extension’, but you must ensure that the description includes all works to be carried out since this forms the basis of our charges, and will appear on both the acceptance notice, and completion certificate (if work is left off the description it can cause you problems if you ever try to sell your property).

Section 5. Use this section to tell us who your builder is and how we can contact them. We may use these details to contact them at a later date to advise them of our marketing initiatives and changes to legislation.

Section 6. This section advises you of the scenarios where a Building Notice cannot be used. This is a legal requirement and outside the control of the District Council. To avoid delay, we would advise that you contact Severn Trent Water direct to find out of there is a public sewer within 3m of any extension or new building. Section 7.Where relevant, we presume that you will use contractors that are registered on a relevant government approved competent person scheme, e.g. FENSA, NAPIT, HETAS, etc. Where you do not use competent persons we may increase our charges to reflect the extra work involved in checking your project. Please note that ‘competent person’ relates to the use of a person registered on a competent person scheme approved by the governments ‘Department of Communities and Local Government’, and is not a reference to a general competency, trade body or other government department competency scheme.

Section 8. Use this section to indicate the fees that need to be paid, and how you would like to pay. Ordinarily, you will only need to complete option 1, 2 or 3.

Section 9. The Building Regulations requires you to submit certain documents in support of this application. If you are extending your property, plan to erect a standalone building, or live in a relatively rural area, then please provide a site plan indicating the location of the work, and its proximity to the site boundaries. In addition, where work is more complex, e.g. loft conversions, large two storey extensions, or new dwellings, Regulation 13 (3) allows the authority to request further plans and information. We would advise that you provide this information at the earliest opportunity so that unnecessary or incorrect work is not undertaken. Plans may not have to be as detailed as those for a ‘Full Plans’ submission.

Section 10. Please read the statements, if you do not understand their meaning or how they impact on your project then please contact Building Control for an explanation. You must sign and date the form. If you do not agree to the fees being individually determined, then please put a line through the statement, and then contact Building Control to agree the fees for this project.

General Advice

  1. This application will lapse and be of no effect, unless work commences on site within 3 years from the date of valid submission, and the authority has been notified of commencement. Please note that case law will determine what constitutes commencement or work, but in the case of an extension or new build, it is usually considered to be the excavation and concreting of foundations.
  1. This application does not constitute approval, or otherwise, under any other legislation (including Planning) than Building Regulations.

  1. Party Wall and boundary disputes are a civil matter between the affected property owners and are not a matter for the District Council to resolve. If you are proposing to carry out work to the party wall, extend your property, or work near an adjacent boundary your attention is drawn to the need to comply with the Party Wall Act 1996.For Further advice please contact a Party Wall Surveyor and/or use the following link to the governments guidance document,
  1. The Council strongly recommends the use of people registered on a government approved competent person scheme such as FENSA, HETAS, NICEIC, NAPIT, etc. A competent person offers you a high degree of protection and they are authorised to self certify their own work under Building Regulations. For many smaller projects, this may be more cost effective route to demonstrating compliance.
  1. Once work commences on site you have a legal responsibility to notify the Council when you reach certain stages, e.g. excavated the foundations. The Building Control team will be able to discuss with you what those stages of work will be. Please note that we will not issue a completion certificate if we have not been able to determine whether the project complies with the Building Regulations, and the appropriate inspection requests have not been made.
  1. The issue of a completion certificate is not a guarantee that work complies with the Building Regulations since the council does not have a permanent presence on site. Risk based site inspections will take place at certain stages (see above) to establish whether compliance is being achieved, however liability for compliance with Building Regulations remains with the owner, designer, and builder at all times, including after completion.

DATA PROTECTION ACT 1998

The information given on this form will be used for the purposes of this Building Regulation application and will be made available to other Council services to allow the authority to provide "joined up" service provision including enforcement. It will also be made available to other external organisations that have a statutory interest in the information, e.g. Valuation Office, Leicestershire Fire and Rescue (if relevant), Severn Trent Water, and any organisation appointed by the Council to assist in the Building Regulation process, e.g. external plan checkers, consultant engineers, etc.The site address, name of the agent, and application status, will be published on the Councils website to facilitate Freedom of Information and Environmental Information Regulation requests from members of the public. The Council may publish on its website documents such as decisions and completion certificates.Information relating to agents and builders may be held centrally and used by the Building Control team or LABC to advise them of changes to legislation, service improvements, customer feedback, and general marketing initiatives. This data is under the control of the Local Authority and if you wish to know what personal data is being held about you please contact the Council at the address shown on the application form.Records will be digitally scanned at various stages, and the paper file destroyed on completion of the project. Computer records will be kept indefinitely subject to a change in retention policy.
