NOTICE INVITING TENDER

Tender for Initial Load Testing of Pile Including Construction of Test Piles For Proposed ESIC & ESIMB Building At GB Block, Sector -III Salt Lake City, Kolkata.

1.0 Employees State Insurance Corporation (ESIC) Kolkata has decided to construct Initial Load Testing of Pile Including Construction of Test Piles for Proposed ESIC & ESIMB Building At GB Block, Sector -III Salt Lake City, Kolkata

Sealed percentage rate tender is invited by Engineering Projects (India) Ltd.l as per the brief particulars of scope mentioned hereinafter, from eligible contractors for Initial Load Testing of Pile Including Construction of Test Piles for construction of Proposed ESIC & ESIMB Building At GB Block, Sector -III Salt Lake City, Kolkata

The detailed scope of work is given in the tender documents.

Time schedule of tender activities:

I)  Date & Time of sale of Tender Documents: From 05.11.08 to 12.11.08

11.00 AM to 05.00 PM

II) Last Date & Time of submission of Tenders : 14.11.08 at 12.00 Noon

III) Date & Time of Opening of Tender : 14.11.2008 AT 2.00 pm

Contractors who fulfill the following basic qualifying requirements are eligible to participate in this tender. The joint ventures are not accepted.

a)  Should have completed /substantially completed during last 7 years following “similar works” out of which at least one work should be with Central/State Government Deptt. / Agency/PSU i.e. completed after 01.03.2001).

i)  Three works valuing at least 30% of this estimated cost of this works..

OR

ii)  Two works valuing at least 40% of this estimated cost of this works.

OR

iii)  One work valuing at least 70% of this estimated cost of this works.

a. The ‘similar works” shall mean “buildings and associated works”

b. The substantially completed work shall be the work where at least 80% bill of total awarded value has been achieved.

c. For evaluation purpose, the completion cost of works mentioned in the Completion Certificate shall be enhanced by 10% per annum (till 29.02.2008)

d. The cost of free issue materials shall not be included in the completion cost of works.

b)  Should have had Average Annual Financial Turnover of not less than 30% of the estimated cost in the last three years ending 31.03.2008 duly certified by a Chartered Accountant.

c)  Should not have incurred any loss in more than two years during the last five years ending 31.03.2008. Copies of balance sheet /certified from Chartered Accountant to be submitted.

d)  Should have a solvency of 40% of the estimated cost issued by a Bank.. The Solvency Certificate should not have been issued earlier than one year of last date of submission of the tender.

e)  Should have valid Permanent Account Number of Income Tax.

f)  Should have valid PF Registration No.

g)  Should have valid VAT Registration No.

EPI’s empanelled contractors can also participate in the tender provided they fulfill the above qualifying requirements. Non-empanelled contractors shall get themselves registered before placement of LOI/work order.

2.0  Estimated Cost of the Work is Rs. 5.00 LAKHS (Rupees five lakhs only)

3.0  Time for carrying out the work will be 02 (Two) months.

4.0 Tender documents can be directly downloaded from the website or can be obtained from the office of General Manager (MMD-Contracts), Engineering Projects (India) Ltd, 8th Floor, 50, Chowringhee Road, Kolkata – 700071 from 11.00 AM to 05.00 PM on all working days (Monday to Friday) except Public Holidays, on submission of request letter along with relevant experience certificates and other documents as mentioned above (Cl 1.0 (a) to 1.0 (d) duly attested by Gazetted Officer not below the rank of Executive Engineer or equivalent or Notary Public) fulfilling the qualifying criteria. Tender document shall be issued to eligible prima-facie qualified bidders on payment of Rs. 250/- (Rupees two hundred & fifty only) (Non-Refundable) by Crossed Demand Draft favoring “Engineering Projects (India) Ltd.” payable at Kolkata, Issuance of Tender Documents to any tenderer shall, however not construe that the tenderer is considered qualified for the tender work and the same may be rejected, if on detailed scrutiny, the documents submitted alongwith the tender are found to be unsatisfactory. In case the tender documents have been directly downloaded from the website, the tenderer shall submit the cost of tender document of Rs. 250/- (Rupees two hundred & fifty only) in the manner specified above in a separate envelope and attach the envelope outside the envelope containing his tender.

5.0 All Tenders shall be accompanied by Earnest Money Deposit (EMD) of Rs. 10,000.00 (Rupees Ten thousand only) This can be either in the form of Crossed Demand Draft or Pay Order of any Nationalized Bank / Scheduled Bank for the full amount of EMD payable favoring, “Engineering Projects (India) Ltd.” payable at Kolkata or in the form of Bank Guarantee of any Nationalized Bank / Scheduled Banks, in accordance with the prescribed proforma. The EMD shall be valid for minimum period of 150 days (One hundred fifty days) from the last day of submission of Tender. Tenders submitted without EMD or with inadequate amount of EMD shall be rejected.

6.0 The Terms & Conditions contained in this NIT and tender documents shall be applicable.

7.0 EPI reserves the right to accept any tender or reject any or all tenders or annul this tendering process without assigning any reason and liability whatsoever and to re-invite tender at its sole discretion. The corrigendum, extension, cancellation of this NIT, if any, shall be given on EPI’s webside www.engineeringprojects.com only. The intending tenderers are requested to visit EPI’s website regularly for this purpose.

ADDITIONAL CONDITIONS OF CONTRACT

1.0 These Additional Conditions of Contract (ACC) shall be read in conjunction with General Conditions of Contract (GCC).The provisions in these Additional Condition of Contract supersede the provisions of General Conditions of Contract wherever they are at variance.

2.0. INTRODUCTION

The site is located at GB Block, Sector – III, Salt Lake City, Kolkata

3. 0 SCOPE OF WORK

The brief scope of work consists of the following:

i) Construction of 600mm dia & 750 mm dia bored cast-in-situ test pipes and other

allied works specified in the schedule of works/bill of quantities.

The work is to be carried out on item rate basis as per bill of quantities and tender conditions.

4.0. QUALIFICATION OF TENDERERS

To be eligible for this tender the bidders should fulfill the requirements for eligibility as mentioned in the Notice Inviting Tender (NIT) and should submit detailed data and credentials set out in Cl. 19.0 of NIT (Vol.-I) NIT ( ) of the Tender. The Tenderers are required to fulfill all the eligibility criteria as stipulated in NIT and elsewhere in the Tender documents. The price bid of tenderers who fulfill the eligibility criteria as per evaluation of EPI shall only be opened. The decision of EPI in this regard shall be final & binding on the tenderers

5.0 DISQUALIFICATION

The tenderers may note that they are liable to be disqualified and not considered for the opening of Price Bid if;

a) Representation in the forms, statements and attachments submitted in the pre-qualification document are proved to be incorrect, false and misleading

b) They have record of poor performance during the past 10 years such as abandoning the work, rescinding of contract for which the reasons are attributable to the non-performance of the contractor, inordinate delay in completion, consistent history of litigation /arbitration awarded against the contractor or any of its constituents or financial failures due to bankruptcy etc. in their on going/past projects.

c) They have submitted incompletely filled formats without attaching certified supporting documents and credentials to establish their eligibility to participate in the Tender

d) If the tenderers attempt to influence any member of the selection committee.

EPI reserves its right to take appropriate action including disqualification of tenderer(s) as may be deemed fit and proper by EPI at any time without giving any notice to the contractor in this regard. The decision of EPI in the matter of disqualification shall be final and binding on the Tenderers.

6.0 The work in general shall be carried out as per the technical specifications given at Annexure-IV to be read in conjunction with specifications described under Bill of Quantities enclosed at Annexure-VI.

7.0 The clause no. 72.1 of GCC shall be replaced as under :

The Contractor shall ensure adequate progress during the execution of work so that the activities are completed in the period allowed in the completion schedule as given at sl. no. 9.0 of Additional Conditions of Contract (ACC).

If the contractor fails to maintain the above progress or to complete the work and clear the site on or before the contract or extended date of completion he shall without prejudice to any other right or remedy of the EPI on account of such breach, pay as agreed compensation and not as penalty at the rate of half percent (1/2%) per every week of delay of the value of the work awarded to him.

The total amount of compensation payable by the contractor for delay in stage-wise completion or completion of the whole work shall not exceed 10% of the total contract value as awarded.

8.0 Clause no. 72.4.1 of GCC stands modified as under:

Within 10 (Ten) days of date of Letter of Intent, the contractor shall submit a Time and Progress Chart (CPM/PEERT/Quantified Bar Chart) and get it approved by the Engineer-in-Charge. The Chart shall be prepared in direct relation to the time

stated in the contract documents for completion of items/scope of the work. It shall indicate the forecast (mile stones) of the dates of commencement and completion of various items trade sections of the work and may be amended as necessary by agreement between Engineer-in-charge and the Contractor within the limitations of time imposed in the contract documents to ensure good progress during the execution of the work. The contractor on the prescribed format shall submit the physical report including photographs & the intervals (not later than a months) as decided by the Engineer-in Charge. The compensation for delay as per clause 72.1 (revised as per ACC) shall be leviable at intermediate stages also, in case the required progress is not achieved to meet the time deadlines of the completion period and/or milestones of time and progress chart provided always that the total amount of compensation for delay to be paid under this condition shall not exceed 10% of the tendered value of work.
