LAYING DOWN THE RULES FOR APPLYING
RATES OF EXCHANGE TO THE VALUE OF GOODS

Pursuant to the authority given to him under section 16.7(a) of the United Nations Interim Administration in Kosovo (UNMIK) Regulation No. 2004/1, of 30 January 2004, On The Customs Code Of Kosovo,
Having consulted the Government of Kosovo,
Hereby issues the following Administrative Instruction:
Article 1
Definitions and References
1.1Any definition or rule of interpretation contained in UNMIK Regulation No. 2004/1, of 30 January 2004, on the Customs Code of Kosovo, shall also apply to the present Administrative Instruction.
1.2For the purposes of the present Administrative Instruction, the following additional definitions shall apply:
“rate recorded” means the latest selling rate of exchange recorded for commercial transactions by the Banking and Payment Authority of Kosovo;
“published” means made generally known by the Banking and Payment Authority of Kosovo; and
“currency” means any monetary unit used as a means of settlement between monetary authorities or on the international market.
Article 2
Rate of Exchange to be Used
2.1Where any element used to determine the customs value of goods is expressed in a currency other than the euro, the rate of exchange to be used to determine that value in terms of the euro shall be the rate recorded on the second-last Wednesday of the preceding month and published on that or the following day.
2.2 Where a rate of exchange is not recorded on the second-last Wednesday indicated in article 2.1, or, if recorded, is not published on that or the following day, the last rate recorded for the currency in question and published within the preceding 14 days shall be deemed to be the rate recorded on that Wednesday.
2.3The Director General shall disseminate the rate of exchange to be used to determine the customs value of goods in terms of the euro under article 2.1 to the Customs Service and that rate shall be used by that Service during the following calendar month.
Article 3
Periodic Declarations
When the Director General authorizes a declarant to furnish or supply at a later date certain details concerning a declaration for free circulation of goods, in the form of a periodic declaration, this authorization may, at the declarant’s request, provide that a single rate of exchange be used for conversion into euros of any element forming part of the customs value expressed in another currency. In this case, the rate to be used shall be the rate, established in accordance with article 2, which is applicable on the first day of the period covered by the declaration in question.
Article 4
Commencement
The present Administrative Instruction shall enter into force on 2004.
