MINUTES OF Tuesday , November 17, 2015

The Lawrence County Commissioners’ Meeting was opened with the Pledge of Allegiance to the Flag followed by a Moment of Silence.

The Lawrence County Commissioners’ Meeting of Tuesday November 17, 2015 was called to order by Commissioner Dan Vogler, at 10:00 am. in the Commissioners’ Meeting Room. Office Manager Carol MacDonald called the Roll. Those in attendance were, Commissioners, Dan Vogler, Robert Del Signore, Sr., Steve Craig,; Chief Clerk/County Administrator James Gagliano, Clarence Nelson, Don Dougherty, Cindy Scaramazza, Lisa DeSantis, Joe Venasco, Brian Melcer and Debbie Wachter, New Castle News. It was stated for the record that the meeting is being taped. Those wishing to speak shall be given five minutes. If they need more time, they are to see the Chief Clerk at another time and he will arrange for them to meet with the Commissioners. Those speaking are to state for the record their names, addresses and the nature of their business.

Mr. Nelson asked for an update on the Casino

Ms. DeSantis questioned the odor coming from sanitation.

Ms. DeSantis state there are oil and gas liens for several families.

APPROVAL OF MINUTES

Moved by Mr. Del Signore seconded by Mr. Craig to accept and file the minutes. Motion carried 3-0.

WRITTEN CORRESPONDENCE

1. Rex Energy, dated November 9, 2015, giving Act 14 notification of the amending of permit application for drilling or altering a well located at the Wolf Unit in Perry Township.

2. Plenary Walsh Keystone Partners, dated November 10, 2015, giving Act 14 notification for a BWEW-GP-11 permit for work to be done in North Beaver Township.

3. Plenary Walsh Keystone Partners, dated November 10, 2015, giving Act 14 notification for a BWES-GP-11 permit for work to be done in Shenango & Taylor Townships.

Mr. Vogler gave an update on the Casino.

Mr. Vogler answered Ms. DeSantis and told her the Commissioners have no jurisdiction over the DEP.

Mr. Del Signore had no comments.

WHEREAS, the Lawrence County Register and Recorder has established a goal of converting existing records to a more permanent medium; and

WHEREAS, the PropertyInfo Corporation has provided an estimate to digitize, tag and load the existing records; and

WHEREAS, the PropertyInfo Corporation has provided the service for Register and Recorder’s Office previously;

NOW, THEREFORE BE IT RESOLVED BY THE LAWRENCE COUNTY BOARD OF COMMISSIONERS, that:

1.  the County hereby approves the agreement with PropertyInfo Corporation, located at P.O. Box 974587, Dallas, Texas 75397-4587 for scanning, cropping of images, tagging and importing/merging images into CountyFusion.

2.  terms shall be as identified in the attached agreement.

3.  the Chairman is authorized to sign all agreements.

R E S O L U T I O N R-2015-199

WHEREAS, the Lawrence County Board of Commissioners entered into a contract for the maintenance of record scanning and recording programs in the Register and Recorders Office; and

WHEREAS, the current contract expires December 31, 2015; and

WHEREAS, the Board of Commissioners wishes to extend the contract with “PropertyInfo” for the maintenance of the appropriate software programs in the Register and Recorders Office, for the period January 1, 2016 through December 31, 2020.

NOW, THEREFORE BE IT RESOLVED BY THE LAWRENCE COUNTY BOARD OF COMMISSIONERS, that:

1.  the County hereby approves the agreement with PropertyInfo Corporation, located at P.O. Box 974587, Dallas, Texas 75397-4587 for software program maintenance.

2.  terms shall be as identified in the attached agreement.

3.  the Chairman is authorized to sign all agreements.

R E S O L U T I O N R-2015-200

WHEREAS, Act 165 Hazardous Material Response Fund (HMRF), administered by Pennsylvania Emergency Management Agency, provides funds for development of emergency response capabilities to the dangers which hazardous material releases pose to the general public; and

WHEREAS, to be eligible for funding, the grant application must be submitted to Pennsylvania Emergency Management Agency by December 1, 2015; and

WHEREAS, Pennsylvania Emergency Management’s disbursement of funds in the amount of $6,106.00 expended during the period from July 1, 2015 to June 30, 2016.

NOW, THEREFORE, BE IT RESOLVIED BY THE LAWRENCE COUNTY BOARD OF COMMISSIONERS, that authorization is given to execute on behalf of the Lawrence County Department of Public Safety, all documents related to the Hazardous Materials Response Fund (HMRF Grant Application and Grant Program for the period of July 1, 2015 through June 30, 2016.

R E S O L U T I O N R-2015-201

Resolution of the Board of Commissioners of Lawrence County to apply for an Act 101, Section 902 Recycling Grant.

WHEREAS, the Commonwealth of Pennsylvania, Department of Environmental Protection has provided for funds available under the Municipal Waste Planning, Recycling and Waste Reduction Act of July 28, 1988, and

WHEREAS, the County of Lawrence has embarked on a program to enhance recycling in Lawrence and Mercer Counties, and

WHEREAS, the County intends to improve the countywide recycling program and increase school recycling opportunities, and

WHEREAS, the County intends to make an application to receive Act 101, Section 902 Grant funds from the Department of Environmental Protection to carry out these goals.

NOW, THEREFORE, BE IT RESOLVED, that an application for funding an Act 101, Section 902 County Planning Grant be submitted to the Pennsylvania Department of Environmental Protection and that Daniel Vogler, Chairman, shall be authorized to sign such application and execute any subsequent documentation resulting from said grant.

R E S O L U T I O N R-2015-202

WHEREAS, the County of Lawrence has received notification from the Commonwealth of Pennsylvania, Department of Community and Economic Development of the availability of funding in the projected amount of $549,486.00 ($244,511 for the County of Lawrence, $109,199 On behalf of the Township of Shenango, $91,081 On behalf of the Township of Union and $107,695 On behalf of Ellwood City Borough) for the provision of services eligible under the Community Development Block Grant (CDBG); and

WHEREAS, the County of Lawrence wishes to engage in the provision of services eligible under the Community Development Block Grant Program; and

WHEREAS, the Township of Shenango, the Township of Union and Ellwood City Borough have directed and agreed on the purpose of the CDBG funds set aside for their community; and

WHEREAS, Public Hearings were advertised and conducted on September 8, 2015, October 13, 2015 (On Behalf of Shenango Township and Ellwood City Borough), October 14, 2015 (on Behalf of Union Township) and November 10, 2015 as required by the CDBG regulations, to obtain citizens views and comments concerning the proposed use of these funds.

NOW, THEREFORE, BE IT RESOLVED BY THE LAWRENCE COUNTY BOARD OF COMMISSIONERS, that;

1.  The County shall prepare and submit a grant in the projected amount of $549,486.00, to the Department of Community and Economic Development.

2.  The County has chosen to engage in municipal projects including:

a.  Street Improvements, North Beaver Township and New Beaver Borough

b.  Countywide Housing Rehab

3.  The County on Behalf of Shenango Township has chosen to engage in project including:

a.  Single Housing Unit Rehabilitation

b. Public Facilities – 03L – ADA Compliance

4.  The County of Lawrence on Behalf of Union Township has chosen to engage in Street Improvements

5.  The County of Lawrence on Behalf of Ellwood City Borough has chosen to engage in Public Facilities.

6.  The said program activities will be administered in accordance with all State and Federal Regulations.

7.  The Chairman Commissioner shall have the authority to execute any and all documents required by the Commonwealth of Pennsylvania pertaining to the application and administration of the 2015 CDBG Program.

R E S O L U T I O N R-2015-203

WHEREAS, The County of Lawrence, on behalf of Union Township, has been contacted by the Commonwealth of Pennsylvania, Department of Community and Economic Development of the availability of funding to make application for the provision of services eligible under the Community Development Block Grant (CDBG) in the amount of $107,695.00 for Ellwood City Borough; and

WHEREAS, the County of Lawrence, on behalf of Union Township, wishes to engage in the provision of services eligible under the Community Development Block Grant Program; and

WHEREAS, Public Hearings were advertised and conducted on October 13, 2015 and November 10, 2015, as required by the CDBG regulations, to obtain citizens views and comments concerning the proposed use of these funds.

NOW, THEREFORE, BE IT RESOLVED BY THE LAWRENCE COUNTY COMMISSIONERS, that:

1.  The County shall prepare and submit a grant application on behalf of the Township of Union for the amount of $107,695.00.

2.  Ellwood City Borough Council has chosen to engage in ADA accessible activities

3.  The said program activities will be administered in accordance with all State and Federal regulations.

4.  The Chairman Commissioner shall have the authority to execute any and all documents required by the Commonwealth of Pennsylvania pertaining to the application and administration of the 2015 CDBG Program.

WHEREAS, The County of Lawrence, on behalf of Shenango Township, has been contacted by the Commonwealth of Pennsylvania, Department of Community and Economic Development of the availability of funding to make application for the provision of services eligible under the Community Development Block Grant (CDBG) in the amount of $109,199 for Shenango Township; and

WHEREAS, the County of Lawrence, on behalf of Shenango Township, wishes to engage in the provision of services eligible under the Community Development Block Grant Program; and

WHEREAS, Public Hearings were advertised and conducted on October 13, 2015 and November 10, 2015, as required by the CDBG regulations, to obtain citizens views and comments concerning the proposed use of these funds.

NOW, THEREFORE, BE IT RESOLVED BY THE LAWRENCE COUNTY COMMISSIONERS, that:

5.  The County shall prepare and submit a grant application on behalf of the Township of Shenango for the amount of $109,199.00.

6.  The Supervisors have chosen to engage in Single Unit Housing Rehabilitation and addressing ADA accessibility at the Township Building

7.  The said program activities will be administered in accordance with all State and Federal regulations.

8.  The Chairman Commissioner shall have the authority to execute any and all documents required by the Commonwealth of Pennsylvania pertaining to the application and administration of the 2015 CDBG Program.

WHEREAS, The County of Lawrence, on behalf of Union Township, has been contacted by the Commonwealth of Pennsylvania, Department of Community and Economic Development of the availability of funding to make application for the provision of services eligible under the Community Development Block Grant (CDBG) in the amount of $91,081.00 for Union Township; and

WHEREAS, the County of Lawrence, on behalf of Union Township, wishes to engage in the provision of services eligible under the Community Development Block Grant Program; and

WHEREAS, Public Hearings were advertised and conducted on October 14, 2015 and November 10, 2015, as required by the CDBG regulations, to obtain citizens views and comments concerning the proposed use of these funds.

NOW, THEREFORE, BE IT RESOLVED BY THE LAWRENCE COUNTY COMMISSIONERS, that:

1.  The County shall prepare and submit a grant application on behalf of the Township of Union for the amount of $91,081.00.

2.  The Supervisors have chosen to engage in Street Improvements

3.  The said program activities will be administered in accordance with all State and Federal regulations.

4.  The Chairman Commissioner shall have the authority to execute any and all documents required by the Commonwealth of Pennsylvania pertaining to the application and administration of the 2015 CDBG Program.

WHEREAS, The County of Lawrence maintains Stavich Bike Trail Recreational Area located in Union and Mahoning Townships; and
