TERMS AND CONDITIONS
1. These terms and conditions and the enrolment form to which these terms and conditions are attached to must be completed in full and returned to our offices.
2. Definitions
In these terms and conditions any reference to:
2.1 "We”, “us” or “Our” shall mean ExtraEduSupport(pty)Ltd (Midrand Chess Club brand), our employees and our agents.
2.2 "You" or 'Your" shall mean the Leaner's parents, the person indicated on the enrolment form as being responsible for payment and/or the person who has signed these terms and conditions.
2.3 "Learner shall mean the person indicated as the Chess Learner (Child) on the Enrolment Form.
2.4 "Consumer Protection Act" shall mean the Consumer Protection Act, 68 of 2008.
3. Duration
3.1 This agreement is valid for the period as indicated below and will commence on date of first class attended of the agreement, subject to paragraph 3.

4. Payment
4.1 There is no enrolment fee for chess lessons, a non-refundable amount of R500.00 per month is payable before every first lesson of the month.
4.2 The lesson fee is payable by all new students in advance and must be paid in full before the Learner will be allowed to participate in the classes.
4.3. Upon the first payment of the lesson’s fee, the learner and his/her parent can agree to pay an extra R250 which will allow the ExtraEduSupport(Pty)Ltd to provide a chess kit to the learner, including: 1x bag, 1x set of 32 chess pieces and 1x chess board which will be available on the first lesson.
4.4. Fees for each month are payable in advance via EFT unless otherwise agreed with us.
4.5 You are required to furnish us with proof of payment via email (). Please remember to use the Learner surname + month as reference.
4.6 In the event that we agree to receive your payment by cash, we shall provide the Learner with an envelope in which to put your payment. Upon receiving the payment and invoice will be sent to you.
5. Obligations
5.1. We shall provide the learner with the necessary knowledge and techniques to allow him/her to become a good chess player and grow according to his/her capacities.
5.2 We shall provide the learner with exposure to the following events:
· Midrand Chess Playground every weekend (2hours)
· Midrand chess League tournaments if ready
5.3 We shall strive to make the Learner aware of his/her capacities, weaknesses and strength.
5.4 We shall provide the Learner with a platform for development and encourage the Learner to enjoy the Chess.
5.5 We shall provide our instructors with continuous training and development and undertake to upgrade and improve the syllabus every alternate year.
5.6 You will be provided with access to our website for your own personal learning and practice at home and readings ( for seniors only), a username and password will be provided to you.
5.7. You will be provided with at least one newsletter per trimester via email which will keep you informed about ExtraEduSupport(pty)Ltd children events and attractions. All chess related events will be free of charge for you or a small fee will be required.
5.9 We will correspond with you via email () and in the event that you change your email address, it will be your responsibility to ensure that you provide us with an updated email address.
6. Services
6.1 ExtraEduSupport awards school winners or best improvement certificates and medals every year and update each school ranking online which is available to the public and parents can follow up on their child’s evolution (Schools only).
6.2 The Learner and his/her parent are welcomed to join the Midrand Chess Club weekend playground activities Free of charge every Saturday from 1h00PM to 3H00PM where the Learner can be exposed to a wide range of chess players. The Learner has a free membership to the club as long as his contract is still active. Parents can join as Club Active Members if they are interested by paying the required annual fee or can stay inactive members by visiting the club with the learner.
6.3 Tournament transport and expenses (affiliation, refreshments, coach out event fee…) are either at the school’s cost or each learners cost. The ExtraEduSupport(pty)Ltd will only provide coaching support. The School has to make sure that the Coach and the students use the same transport to keep the team motivated and are required to motivate the coach with a out event fee of R300 per event (Schools only).
7. Termination
7.1 If you wish to terminate this agreement, you shall be required to give a written notice of at least 1 (one) full month of your intention to do so.
8. Attendance
8.1 Fees shall not be reimbursed or reduced as a result of classes not taking place on public holidays or school holidays.
8.2 Fees shall not be reimbursed should a learner be absent for any reason whatsoever.
8.3 In the event that an instructor is unable to attend a class for any reason whatsoever, prior written notice within a reasonable time will be sent out to reschedule the class at any alternative day which is convenient to us.
9. General
9.1 You furthermore agree that the aforementioned physical address shall serve as your domicilium citandi et executandi for the service of correspondence, notices and all legal process.
9.2 This agreement shall be deemed to have been entered into in South Africa and the construction, validity and performance of this agreement shall be governed in all respects by the law of South Africa.
9.3 No modification, alteration or amendment of any provisions (including this clause) contained herein shall be valid or binding unless in writing executed by you and us.
