Please use the Internet to lookup the following items and write one paragraph about the meaning of the text that you found and offering your opinion of the purpose of the clause.
Article IV section 1
Full Faith and Credit shall be given in each State to the public Acts, Records, and judicial Proceedings of every other State. And the Congress may by general Laws prescribe the Manner in which such Acts, Records and Proceedings shall be proved, and the Effect thereof.
This text means that each state will honor every other state’s court decisions. The congress, however, will have the power to decide if these decisions are to be approved. I think this enables lawyers in court cases to refer to other states’ cases, and use decisions made in those cases as references.
Article I section 8, Clause 11
The Congress shall have Power To declare War, grant Letters of Marque and Reprisal, and make Rules concerning Captures on Land and Water;
This gives congress the ability to declare war on other nations. A reprisal is and act avenging and injustice, such as an attack. The act could be seizure of property or of the person at fault. A reprisal allows a person to cross borders in order to perform this Marque. This could allow congress to authorize a private person to, say, go hunt Osama over in the Middle East. (
Article X section 13
Provision may be made by general law for bringing suit against the state as to all liabilities now existing or hereafter originating.
This means that the state can be sued and held liable. The state includes all statewide agencies, and can all be held liable. I think this has to do with the state acting as a corporation, and state employees being protected just as employees are in a company.
Article X section 26
Prohibition of medical license after repeated medical malpractice.
No person who has been found to have committed three or more incidents of medical malpractice shall be licensed or continue to be licensed by the State of Florida to provide health care services as a medical doctor.
This means that a doctor will lose his/her license if they have committed medical malpractice three times. This is intended to stop bad doctors from practicing. However, it does not consider the length of time of practice. Also, proper research should reveal much more about a doctor’s practices than the number of malpractice suits. This will also cause doctors to strongly favor settling suits rather than risk a judgement against them. This would a) cause more bogus lawsuits to be filed against doctors, and b) cause the cost of insurance to rise for doctors.
