FINALORDER

In accordance with the provisions of Section 332(h) of the Public Utility Code, 66Pa. C.S.§332(h), the decision of Administrative Law Judge Elizabeth H. BarnesdatedFebruary24, 2015, has become final without further Commission action;

THEREFORE,

IT IS ORDERED:

1. That the formal Protests filed by Jerome Fuhr and Fred D. Lindbuchler, Jr. at Docket Nos. A-2014-2424362 and A-2014-2424432 are sustained in part and denied in part.

2. That the Joint Application of UGI Penn Natural Gas, Inc. and UGI Utilities, Inc. – Gas Division for approval to abandon Rate GBM (Gas Beyond the Mains) Service to certain Rate GBM Service Addresses Served by Individual Propane Tanks at Docket Nos. A-2014-2424362 and A-2014-2424432 is hereby approved, subject to conditions in the following Ordering Paragraphs.

3. That UGI Penn Natural Gas, Inc. pay Jerome Fuhr $3,250 to help defray the cost of transitioning to unregulated propane or converting to an alternate fuel source within 30 days of the date of entry of the Commission’s Order in this proceedings.

4. That UGI Penn Natural Gas, Inc. pay Fred D. Lindbuchler, Jr. $5,916 to help defray the cost of transitioning to using unregulated propane or converting to an alternate fuel source within 30 days of the date of entry of the Commission’s Order in this proceeding.

5. That UGI Penn Natural Gas, Inc. file a sworn certification with the Commission showing its compliance with the directives of this order within 90 days of entry of the Commission’s Order in this application proceeding.

6. That Docket Nos. A-2014-2424362 and A-2014-2424432 will remain open until the subject facilities of UGI Penn Natural Gas, Inc. and UGI Utilities, Inc. – Gas Division, meet the approval of the Gas Safety Division of the Bureau of Investigation and Enforcement, as evidenced by its letter to that effect, which letter shall be served upon Applicants as well as the affected customers, and inserted into the documents folder for this application proceeding.

7. That upon UGI Penn Natural Gas, Inc. and UGI Utilities, Inc. – Gas Division, filing the certificates of compliance and the Gas Safety Division of the Bureau of Investigation and Enforcement filing its letter in accordance with the foregoing ordering paragraphs, the Secretary’s Bureau shall mark Docket Nos. A-2014-2424362 and A-2014-2424432 closed.

8. That if either UGI Penn Natural Gas, Inc. or UGI Utilities, Inc. – Gas Division do not comply with the foregoing terms and conditions for abandonment of service or if either company fails to file or serve the required certificate(s) of compliance as set forth in the foregoing ordering paragraph, their joint application for abandonment of service at Docket Nos. A-2014-2424362 and A-2014-2424432 shall be dismissed without further action.
