Hays City Corp DBA Tex-Con Oil Co. (Tex-Con) is providing ______(Customer) the following Equipment for use in storing, handling and dispensing oil and fuel products purchased solely from Tex-Con subject to the terms and conditions set forth below:

Customer agrees to receive above described equipment (“the equipment”) loaned to Customer by Tex-Con and agrees upon request to return it to Tex-Con at Customer’s sole cost in same condition as received, ordinary wear and tear excepted (replacement standard cost of equipment attached). The Equipment shall remain the property of Tex-Con and Tex-Con may at any time, without notice, enter upon the premises where Equipment shall be located and retake possession of the Equipment, without legal process or liability. The Customer is acknowledged to be the equipment operator and agrees to hold Tex-Con harmless from damage or claims from the operation of the Equipment. The Customer shall keep the Equipment free and clear of all liens, encumbrances, pledges and security interests. Tex-Con must be notified prior to tank relocation. The Customer is responsible for providing power to the equipment where necessary and is responsible for any Local, State and/or Federal requirements pertaining to Equipment. The Customer warrants that it has general liability insurance in the amount of at least $1,000,000 and Customer further warrants that it has property insurance in the amount of $100,000.

In pursuant to Title 30 of the Texas Administrative Code (TAC) Chapter 213 (30 TAC 213), an aboveground storage tank (AST) facility plan is required for the installation of aboveground storage tanks at a facility that will have a total capacity of 500 gallon or more on either the recharge or transition zone of the Edwards Aquifer. Customer agrees to hold Tex-Con harmless from any damages, fines or any legal action associated with any loaned equipment located in the recharge or transition zone of the Edwards Aquifer.

This Equipment agreement and Addendum contains the entire agreement between Hays City Corp DBA Tex-Con Oil Co. and Customer related to Equipment.

Loaned Equipment Agreement

Water or fuel left in tank and/or$50 per hour pump-off fee (includes trip time)

Note: The Tank Delivery & Pick-Up Fee may be charged for each attempted pick-up and if any of the above conditions prevent the driver from loading the equipment.

Loaned Pump Policy:

Tex-Con will loan a 12-volt or 115-volt pump in good working condition at no charge and will guarantee it for the length of the manufacturer’s warranty. Pumps replaced due to misuse and not due to manufacturer defect will be billed to customer at the replacement cost of a new pump as listed below.

Missing or damaged equipment will be charged back to customer. Some standard charges:

Tex-Con will maintain loaned equipment in good working order. Customer is responsible for supplying filters and any item that is damaged due to neglect, lost or stolen.

Important Tips for using loaned equipment safely and economically:

Pump Maintenance

30 minutes on - 30 minutes off. 12 volt and 110 volt GPI pumps have a 30-minute duty cycle. They will over heat if run longer than 30 minutes and a small module will have to be replaced in order for them to run correctly again. After an extended run time let it cool for as long as you ran it.

Replace fuel filters often. All loaned pumps come with a fuel filter base and clean filter. If fuel flow seems restricted the first thing to do is change the filter. Filters can be purchased at most auto or truck parts stores. We will deliver filters in any quantity when making fuel deliveries at a price of $13 each.

Avoid Extra Charges

Leave the tank as empty as possible. Diesel weighs over 7 lbs per gallon. We cannot haul a tank that has fuel in it.

Keep your rainwater to a minimum. The containment pans are designed to prevent a major fuel leak. Unfortunately they collect rainwater as well. Having the pan empty of water, trash and used filters at the time of pick-up is the customer’s responsibility and will save you money.
