REGISTRATION OF FLATS – EXECUTION OF CONVEYANCE DEED

JAL VAYU VIHAR, SECTOR 30, GURGAON

1.It is intimated that the Final Costing of Jal Vayu Vihar, Sector 30, Gurgaon has been completed in Aug 06. As you are aware that the land was procured from HUDA and Conveyance Deed was executed between HUDA and AFNHB on 27 Feb 2003. You are also aware that there is a requirement for all allottees to execute Conveyance Deed at the earliest.

2. It is intimated that ‘State Sub-Registrar Authorities’ has oflate made registration of a dwelling unit a compulsory condition for any sale/purchase requirement. Moreover as per terms and conditions, it is compulsory on the part of allottees to execute the Conveyance Deed with the registrar office.

3. To facilitate smooth registration process, AFNHB authorizes nominated office bearers of the concerned Society who would sign in the registrar office on behalf of AFNHB. Allottees are requested to get in touch with the nominated authorized office bearers of the Society for executing their registration of dwelling units.

4.In order to execute the said Conveyance Deed in favour of original allottees, the following actions are required to be completed by them :-

(a)They are required to clear all dues payable to concerned Resident Welfare Association and are to produce a proof thereof i.e. NOC / NDC.

(b)Produce an Affidavit that no unauthorized additions / alterations have been carried out by them in and around their Dwelling Units. This would be physically verified by a representative of Society.

(c)Ensure that the Flat and / or Parking are not being used for commercial purposes.

(d)Obtain a “No Dues Certificate” / “No Objection Certificate” from the concerned Bank(s)/ Financial Institution(s) / HBA / AFGIS / NGIF etc. for loan(s) if taken for purpose of their flat.

(e)Allottees need to reach concerned authority office preferably a day prior to executing of Conveyance Deed as documents could be prepared only after ensuring physical presence in the office.

(f)In case of joint registration, co-registrant also should be physically present for signature. Allottee should also ensure that joint registration certificate is issued from AFNHB.

(g)Contact the office of Sub-Registrar Gurgaon for calculation of Stamp Duty payable. Non-Judicial Stamp Paper equivalent to the value of Stamp Duty payable can also be purchased directly from the Treasury, Gurgaon. Stamp Duty for execution of Conveyance Deed is as per the Costing Certificate issued by the Board.

(h)Two copies of text of Conveyance Deed are to be prepared as per the AFNHB approved draft Conveyance Deed. Hard copy of the AFNHB approved Conveyance Deed and a copy of Conveyance Deed executed between HUDA and AFNHB may be obtained from Society office. The Conveyance Deed is to be executed on a non-judicial stamp paper of appropriate value.

(j)Two known persons will also be required to accompany you to the office of Sub-Registrar for signing as witnesses on documents.

(k)Documents are to be deposited for registration in the office of the Sub-Registrar by paying the registration charges in cash.

5.All expenses towards payment of Stamp Duty, registration charges etc. for execution of Conveyance Deed will have to be borne by the Allottees.

6.Allottees are to produce the following documents to Society office before execution of Conveyance Deed :-

(a)Copy of Allotment Letter

(b)Copy of Possession Certificate

(c)Copy of Joint Registration Certificate (in case of joint registration cases)

(d)Affidavit in original as per format

(e)Costing Certificate / No Dues Certificate issued by AFNHB

(f)No Dues Certificate / No Objection Certificate from loan granting agency.

(g)Identity Card / any other documents, establishing identity.

(h)Conveyance Deed document on prescribed non-judicial stamp paper.

(j)No Dues Certificate from the Society

(k)Undertaking, for those who have availed housing loan as per format

(l)Undertaking, for those whose loan is cleared or has not availed loan as per format.

7.Documents prepared for execution of Conveyance Deed are to be signed on each page by the Original Allottee, Co-registrant (if required) and AFNHB’s representative. AFNHB has issued Authority Letter to the office bearers of the society as a representative of AFNHB and he would accompany the allottees for execution of Conveyance Deed. In order to facilitate the timely execution of the registration, all allottees are requested to submit all required documents to the Society by the preceding day of execution of Conveyance Deed.

8.Allottees, after completion of above actions are advised to contact Society office for further clarification if any in person or on Telephone No. 0124-2381994, 4032622 for necessary action for execution of Conveyance Deed.

9.On execution of Registration, it will be the sole responsibility of the allottee to submit the original copy of ‘Registration Deed’ to the loaning agency and a copy to AFNHB.

10.Allottees are requested to get their flats registered at the earliest.
