Thank you for giving us an opportunity to review the response we have sent to your Freedom of Information (FOI) request, and make sure that we have done all we can to put things right for you.
Although initially your request was dealt with under the Freedom of Information Act,
as this request relates to a parking we now consider the relevant regime is the Environmental Information Regulations (EIR).
I apologise for any confusion this may cause.
Your request on 12 January 2012 was for:
Can you please supply me with a copy of your Parking Account from April 2010 to March 2011. Also from April 2011 to December 2011
Also if available please supply me with the quarterly figures for the current Parking Account: from April-June 2011; July-September 2011; and October-December 2011.
Gary Weston, Parking Infrastructure Manager, responded to your request on 6 February 2012. He provided a copy of Annual Parking Report for 2010/11.
With regards to your request for quarterly figures for the current tax year Mr Weston advised you that we only prepare accounts only on an annual basis.
Your complaint on 16 February 2012was as follows:
The Parking Report provides a summary like not the entire Parking Account as requested. So please send me a copy of the full and complete Parking Account - April 2010 to March 2011. Also from April 2011 to December 2011

Having spoken with Ann Cunningham, Head of Traffic Management, I understandthat you were provided with the Parking Report due to a genuine misunderstanding. As the Parking Report provides more information aboutParking performance and finances it was (mis)understood that you had requested the Report.
Please accept our apologies for the delay in providing with you the Accounts and for any inconvenience this delay has caused.
Regarding your request forthe current Parking Account from April 2011 to December 2011
Although, we monitor income and expenditure on monthly and quarterly basis, this information is not held in an account format.
Therefore, I can confirm that we do not hold quarterly/monthly figures for the current Parking Account. As Mr Weston explained – accounts are prepared on annual basis only, at the end of a tax year.
If you wish we can provide you details of parking income for the current tax year. However, this would not be a prepared account offsetting income with expenditure and showing the amount of surplus. It is not clear if this information would be useful for you. Please let us know.Please note however that an amended request would be considered a new request and a new timescale would apply.
The 2011/2012 Parking Revenue Account will be finalised and available at the end of April 2012. If you wish to have a copy please submit a new FOI/EIR request.
To conclude:
Ipartially uphold your complaint.
Section 5 of the Environmental Information Regulations 2004 states that “a public
authority that holds environmental information shall make it available on request.
2. Information shall be made available under paragraph (1) as soon as possible and
no later than 20 working days after the date of receipt of the request”.
We have therefore failed to comply with Section 5 of the Environmental Information
Regulations as we have failed to provide you the requested Parking Revenue Account for 2010/2011within the set timescale and I would like to apologise for this.
I hope that you are satisfied with my response to your complaint. If you are dissatisfied, you may complain to the Information Commissioner, who may be able to help you. Please note that if you wish to refer this case to the Information Commissioner, they ask that you do so within two months of our response to you.
