INSTRUCTIONS FOR COMPLETING NOTIFICATION AND CLAIM OF

SELLER'S RIGHTS IN TECHNICAL DATA AND COMPUTER SOFTWARE FORM

PURPOSE:

The following instructions are included herewith to provide guidance and clarification for the correct completion of the Notification and Claim of Seller's Rights in Technical Data and Computer Software Forms. Since the completed forms are submitted to the Government to document the Seller's proprietary interest, it is essential that the forms be completed correctly.

1. PROVIDE COMPLETE HEADER INFORMATION

Lockheed Fort Worth Part No., Seller's Part No., Nomenclature, and Purchase Order.

2. COMPLETE ONLY THE APPROPRIATE PORTION OF THE FORM, PART I OR PART II,

NOT BOTH

A. Part I: IS completed only when

- all technical data and computer software is supplied with UNLIMITED RIGHTS. DO NOT

fillout this portion of the form if you claim any proprietary interest in technical and/or

computer software related to this procurement.

B. Part II: IS completed only when

- the seller has a proprietary interest in the affected hardware and intends to provide some

technical data or computer software with LIMITED/RESTRICTED RIGHTS and/or intends

NOT to submit data to Lockheed Fort Worth and/or Government.

- When completing Part II answer each question from number 1.(a) through (f) and number 2.

through 7. or insert "None" or "Not Applicable" in the appropriate blank. Please provide Part

Numbers/Drawing Numbers in Part II 1(a) through (d) appropriately.

Should all pertinent information not be available (part numbers, drawing numbers, etc.) when the form is originally submitted, an update should be prepared and a revised form provided by the Subcontractor as

soon as the new information becomes available.

All forms should be typewritten and should include the Subcontractor's name, as well as the signature and title of the individual with the proper authority to validate the claim.

PART II LIMITED RIGHTS IN TECHNICAL DATA AND RESTRICTED RIGHTS

COMPUTER SOFTWARE

NOTE: This part is to be completed when Seller has claims of a proprietary nature and intends to

Furnish certain technical data and/or computer software required under this Purchase Order

with only Limited/Restricted Rights under the provisions of DoD FAR Supplement

252.227-7013.

When Seller procures supplies and/or services from a sub-tier supplier who claims a proprietary interest in the technical data and/or computer software related to such procurement, a completed

copy of this form must be provided to Lockheed Fort Worth to substantiate each sub-tier supplier's claim. All data submitted with other than Unlimited Rights must be marked with the appropriate legend found in DoD FAR Supplement 252.227-7013 by the party claiming such rights.

5.2 If Part II, 1.d. is completed, will Seller negotiate with the Government for DIRECT submittal

of this Limited/Restricted Rights data to be stamped with the appropriate DFARS Legend?

6. Seller certifies that:

a. The design or process is an existing design or process.

b. The design or process was developed exclusively at private expense.

c. The design and related data have been held confidential within the Seller's operation.

d. The technical data or computer software did not pertain to items, components, or processes

the development of which was directly paid for in whole by the Government or was

specified in a Government contract or subcontract or was accomplished during and was

necessary for performance of a Government contract or subcontract.

7. The Seller represents that, to the best of its knowledge and belief, the information contained in

this notification is current, accurate, and complete.
