CHAPTER1. PROJECT DISCRIPTION

1.1 EXISTING CONDITION OF PROJECT PLAN

Gedong Tataansubstation is a substationthat was builtas an efforttoimprove thereliability ofthe electricity system inLampungProvince. The planof thissubstationwill connectto thenetworkSUTTofNatarto Gedong Tataanandfrom Teluk Ratai to Gedong Tataan. Thissubstationis oneof substationthat will befinancedby IBRD. This effortwillenable improvedsecurityandreliability ofelectricenergydistributioncapacityto meetelectricenergy needsin Sumatra, especiallyinthe areasthrough which thetransmission(theProvince ofLampung).

A locationplannedfor the constructionof substationis aunderbrushandformericefactory buildingswhich are nolongeroperatedfor many years. The closestsettlementlocationare at+ 200m.Thereforethere is noresettlementplan(RP).

1.2PROJECT LOCATION

Gedong Tataan substation islocatedinBinong Kampung, Way Layapvillage,Pesawaran Regency,Lampung Province. In geographicallocation, the substationis locatedat05 °23'51, 4 "LS andE105 °03'53, 5"BT.

Currentsite conditionsLARAPsurveyconductedin November 2011in the form ofshrublandutilizedby thewatchmanof productiveland forseasonalcropsofcassava, maize, vegetablesandsomecoconuttrees. The plan to around the locationthesesubstationswill be builtsettlements, boarding school andadjacent tothe local government-owned officebuilding plans.

1.3Scope Of Work

Building 150 kV Substation consist of 2 line bay, 1 trafo bay 30 MVAand 1 future trafor.

1.4Land Needed

To build a Gedong Tataan substation is need a land about+ (200m x 100m)/ 20.000m2.

CHAPTER2. INVENTORY OF PEOPLE AND ASSETS AFFECTED

2.1Inventory ofLand and AffectedPeople of Gedong Tataan Substation Location

The totalrequirementof landneededtobuild theGedongTataan substationis 20,000m2. Allparcels of landto bereleasedis underbrushlandand oldbuildings owned byprivate individuals.Landownerslocationof substationthere are 4brotherslisted inonecertificate.

Location data, landownersandland usetypesthat will beusedfor the construction ofGedong TataanSubstationare presented in Table2.1.

Althoughthe needforconstruction ofsubstationsonly20.000m2, allthis landwill be purchasedby PLN. The owneris thecitizenwhodoes not live inthat location.They livein the city andrun atrading business. Economically, there was no significant effect on theowners ofthis landbecause it isnot usedforproductiveactivities. Choiceof compensationformallows themtochoose thereplacementland, butthe initial consultationat thetime of the surveyindicatethatthey prefercashas a replacement forthe lostland.

All thisland wasplantedby thewatchmanof landwithcropsfortheir own needs. In theinitial consultation, watchmanexpressedenthusiasmifanyoneboughtthis landbecause it willalso benefit.

2.2 Land/Building Ownership Status

Ownership statusof landis landowned byresidentsis now alandthat has beencertified. In aland certificateowner's name, there are four brotherschinesedescent

Most of theland that willbe releasedis thescrub andformericefactory buildingthat has beendamaged. Most ofthe landwas used bywatchmanof productivelandby plantingseasonalcropssuch ascassava, maize, vegetableoilandthere aresome plantstomeettheir own needs.

2.4 Plants/treesaffected bydevelopment projectsGedongTataan Substation

At theinitial consultationprocesswith landowners, theyjusttellthat theownersold the landwithouttaking accountplantcontained in theland.Based on survey resultsin November2011,there is noproductivehard plantsare deliberatelyplantedbythe landowner.Most ofthe landwas used bywatchmanof productivelandby plantingseasonalcropssuch ascassava, maize, vegetablesandthere aresomecoconut trees.

CHAPTER3. THE VALUE OF ASSETS AND COMPENSATION SCHEME

  1. Compensation Alternative

The options of replacement for land to be used for build 150 kv Gedong Tataan main substation has been offered to affected persons.

Option for compensation are as follows :

  1. Replacement in form of land the same width and qualities
  2. Replacement in form of cash money, according to the market value of assets affected
  3. A combination of the forms described above
  4. Forms of other compensation in accordance with the agreement residents.

This is in accordance with Presidential Decree No. 36/2005, Article 13. These choices also represent an alternative compensation to be offered by PT. PLN (Persero).

3.2 Land Price

To assess the price of land, PLN will use Appraisal Team to deermine the price established by the local government. The results of land price forecasts issued by the appraisal team represent comensation prices used during negotiations between PLN, government and affeced persons.With reference to market prices, The affected land owners are expected to receive land with a value equivalent to the land previously owned.

As refference, Harga Nilai Jual Obyek Pajak (NJOP) and the market price for the land affected by the project presented in the following table:

All land required for Gedong Ta substation and tower site will be certified after the entire land acquisition process has been completed. This process will be the responsibility of PT PLN (Persero). The certification process will be done by the Notary appointed by PT. PLN (Persero).Since theentirelandwill be purchasedby theproject, then there isno obligationPLNforthe certification processorrefundthe remaininglandto the owner ofthe land certificate.

CHAPTER4. CONSULTATION AND DELIBERATION PROCESS

Early socializationof theprojecthas beencarried outbydistributingquestionnairesto theresidents aroundandmeetingwith landownershave been conductedin November2011.Initial consultationtoindividuallandownerswhowill likely beaffected by the projecthas beencarried outbyPLNtoobtainpreliminary datathatexposedassets. Atthis earlysocializationis representedby onelandownernamedin thecertificateof landwhich will beused as asubstation location plan. From the results ofconsultationsobtainedresultsbasicallylandownerswelcomed thewillingness of thePLNtowant to selltheir landtobe used asbuilding sitesGedongTataan substationplan withappropriately priced.

Socialization processthat will be donenextis tohold ameeting which organizedby a team ofSocializationPT. PLN(Persero) UIPRINGSMTII. The meeting isexpected to beattended bythe Land Procurement Committeeconsistingofgovernmentofficials andvillage officials, affected people’s (land owners), societyin generalifnecessaryandthe PT. PLN(Persero). Will furtherbean inventory oflandand plantsthat will bereleasedwitnessed by thelocal village government.

After surveying, consulting andlandinventory, then the PT. PLN(Persero) will hold ameeting ofnegotiationswiththeaffected people. The meetingwill be facilitatedandwitnessed bydistrictofficialsandlocal villages,compensationpaymentsbefore being implemented. Furtherpayment ofcompensation,in accordancewith theform ofand amount ofnegotiations, openly andknowledge/presentedbydistrictofficialsandvillage/localvillage.

All meetingandinventories results, includingminutes ofmeetingswill be documentedandpeoplewhose assets areaffected by the projectwillget a copy.

CHAPTER5. INSTITUTIONAL ARRANGEMENT

5.1 The Main Institution Involved

In accordance with regulation which prevail in the Republic of Indonesia, as well as PLN policies, the main institution involed in implementing LARAP are follows:

  1. Head of PT. PLN (Persero) is responsible forfinal reportingtotheWorldBank.
  2. PT. PLN (Persero) UIPRING SMT IIis responsible forpreparingthe documentLARAP, assistin the process ofland acquisitionandmake areport on the implementationLARAPto head of PT PLN(Persero).
  3. Land AcquisitionTeamPT. PLN(Persero) UPKJSReg.IIIresponsibleforcoordinating theimplementation ofland acquisitioninthefieldofPT PLN(Persero).
  4. Land Procurement Committeeofthe Regional Governmentis a party tomediate betweenpartiesPT PLN(Persero) with affected peoples whichareresponsible foroverseeingandcoordinating theimplementation processofland acquisitionofinventory, consultation, deliberationandnegotiation, payment andcertificationof land.
  5. Assessment Teamresponsible forassessing the price of landassetsthat will beaffected by the project.

In theprocess of land acquisitionfor development projects150 kVsubstation, the land procurement committeewhich was formedby decreeregent/mayorwill be involvedbecausethe areaforbuildGedong Tataan substationswicthyardmorethan 1hectare. Thesub-districtofficeand villageon the locationin questionwillfacilitatethe meetingsin the framework ofthe projectas wellas dissemination ofnegotiationsbetweenthe PTPLN(Limited) andownersof householdland to beusedfor the locationof substation.

5.2Complain Handling Mechanism

The process ofsocialization, participationandconsultationwithaffected people’sis expected tominimize complaintsfrom the publicin the future. However,acomplainthandlingmechanismhas been establishedso thateveryaffected people’scan be servedandanycomplaintsorproblems thatarisecan befollowed upappropriately.

All complaintsshould be dealt withfirst bythe PT. PLN(Persero) UPKJSReg.III. in Lampung. Complaintscan be submittedin writing to:

Based on thecomplaintsto be received, PT. PLN(Persero) UPKJSREGIII willconduct researchrelated to thecomplaints submittedbyaffected peopleand will furtherrespond tothe complaintno later than10 (ten) working days afterthe complaintis received.

Whenpeoplefeel lesssatisfied with thecontinuation ofthePT. PLN(Persero), then thecitizensthe right to puta complaintto the Regent.

If theabove stepshave passed, butresidentsremaindissatisfiedwith thedecision ofthe Regent, then thecitizensright tofile a complaint/lawsuitto the courtto resolve.Thisgrievancemechanismwill be informedto the citizens.

5.3Monitoring and Reporting

Monitoringthe implementation ofland acquisitioninternally byPT. PLN(Persero) in this casebyPT PLN(Persero) UIPRINGSMTIIandUPKJSReg.III. PT. PLN(Persero) UIPRINGSMTIIwill submit areport on the implementationof land acquisitionto thehead PLNandWorld Bankforanyprogressor changesthat occurin the field.
