REQUEST FOR BIDS

The Housing Authority of the Cherokee Nation will be accepting bids for the completion of Labor and Materials Sub-Contracting, Solicitation # 2013-001-074, work on a Housing Development Project located in Delaware and Mayes Countiesof the Cherokee Nation of Oklahoma. Work will be completed according to the Scope of Work. These jobsmay be located in any part of the listed counties, locations have not been determined.This project will consist of Thirty- Four (34) detached single family units divided into 3-Bedroom homes with attached garage AND 4-Bedroom homes(exact number of each are unknown at this time)

Submit bids on Bid Form (provided), identifying by bid number the subcontract. They must be signed and dated by contractor. Contractor must self-perform any and labor required, no subcontracting of labor will be allowed.

Bids will be awarded according to the lowest most responsive bids for each unit. The HACN reserves the right to reject any and all bids. The HACN further reserves the right to award multiple bids for the project. Consideration in awarding sub contract will be given for Timeliness in starting and finishing HACN Development projects. Bidder furthers agrees to complete HACN Development Project in a timely manner in order to not hold up the entire Project. Failure to comply and HACN reserves the right to award to the next lowest bidder anytime the need arises.

Payments will be paid upon the completion and acceptance of all work approved. A contractor may submit a payment schedule for any bid. A payment schedule would allow for payment, upon HACN’s acceptance, at the end of a particular phase. Any payment schedule will be reviewed for acceptance, prior to bid award.

Unless otherwise specified in the bid, contractor shall bid to furnish all labor, equipment, tools, and insurance needed to perform the work required. Time schedules will be negotiated prior to contract award, however, all potential bidders should be aware that the completion date for an individual unit is no more than 45 days from the date of first award.

Contracts must be executed within (10) ten days of award or the bid will become null and void, and the next lowest most responsive bid will be considered.

TERO CERTIFICATION:Bids will be accepted from Indian and Non-Indian contractors. Indian preference will be given only to the contractors who provide proof of certification through the Cherokee Nation Tribal Employment Rights Office (TERO) located in Tahlequah, Oklahoma 74465 (918) 453-5000.Proof of TERO certification must accompany and be included in bid submittal. The HACN has determined this contract is subject to Section 7 (b) of the Indian Self-Determination and Education Assistance Act, which require in part that to the greatest extent feasible; preference in the award of contracts and subcontracts shall be given to Indian organizations and Indian Owned Economic Enterprises. The TERO fee of ½ of 1% of contract award will be paid by the HACN. However, successful contractor must complete TERO Labor Agreement and pay all applicable fees, including $25 per day for each non-Indian employee working on this project in accordance with Legislative Act 30-12. Successful bidder will be required to submit to the HACN a Core Crew list for the project, prior to any contract award.

Debarment, Suspension, Proposed Debarment and other Responsibility Matters:

No Contracts/Purchase Orders shall not be awarded to debarred, suspended, or ineligible contractors, under executive order 12549 (Debarment and Suspension). Contractors may be suspended, debarred, or determined ineligible by HUD in accordance with HUD regulations (24 CFR Part 24) or by other Federal agencies (e.g., Department of Labor, for violations of Secretary of Labor regulations) when necessary to protect the Housing Authority of the Cherokee Nation in its business dealings. The Housing Authority of the Cherokee Nation may suspend or debar a contractor under state, local or tribal laws, as applicable.

The responding party shall provide immediate written notice to the Housing Authority of the Cherokee Nation if, at any time prior to contract award, the person learns its certification was erroneous when submitted or has become erroneous by reason of changed circumstances.

General Information:

Any bid received after the time stated above will not be considered for award. The Housing Authority of the Cherokee Nation reserves the right to waive any informality or to reject any and all bids. Award of contract will be to the lowest most responsive/responsible bidder and will be subject to availability of funds. Indian Preference will be given to Contractors certified as an Indian-Owned firm by the Cherokee Nation Tribal Employment Rights Office (T.E.R.O.). Proof of certification must accompany all bids.

No bidder may withdraw their bid within thirty (30) days after bid opening date.

All warranties will be presented to the Housing Authority of the Cherokee Nation Housing Inspector at the time of final payment. Contractor shall provide a one (1) year warranty for any and all work performed.

TITLE:

INSURANCE

A.All contractors must be able to be insured. Before a contract or purchase order, that includes labor, will be signed. A certificate of:

  • Comprehensive General Liability Insurance;
  • Comprehensive Automobile Liability Insurance; AND
  • Worker's Compensation insurance must be provided to the Housing Authority of the Cherokee Nation.

A contractor shall purchase and maintain for the duration of the contract, insurance with the following requirements or better:

1. WORKER’S COMPENSATION: Oklahoma Statute requires worker’s compensation coverage for anyone with one or more employees.

Limits of Liability:

Bodily injury by accident - $100,000 each accident

Bodily injury by disease - $500,000 policy limit

Bodily injury by disease - $100,000 each employee

2. COMPREHENSIVE GENERAL LIABILITY: Comprehensive general liability with the Housing Authority named therein as an Additional insured. Limits of general liability shall be no less than $100,000.00.

3. AUTOMOBILE LIABILITY: Vehicle insurance verifications must be submitted on any vehicle the contractor, subcontractor, or their employees will have on site.

B.All policies of insurance required herein shall contain a clause to the effect that the policy shall not, at any time, be canceled or reduced, restricted or limited without ten (10) days prior written notice of such change to the Housing Authority.

C.Contractors must provide certificates of workmen’s compensation, general liability and automobile insurance for all contracts involving labor and material. Worker’s compensation insurance must be provided for all labor, and labor and material contracts.

SCOPE OF WORK

(Single family, 4 Bedroom HomesSingle family, 3 Bedroom Homeswith attached garage, located in Delaware and Mayes Counties)

BID # 2013-001-074-1 EXCAVATION, FOOTING, & CONCRETE WORK – Areas of new concrete are to be excavated to aminimum depth of 4” and uniformly graded to receive gravel for base of new work. Install construction formsas needed and provide a compacted sub-base of gravel or crushed stones to a minimum depth of 8”, ifnecessary, before pouring concrete.

FOOTINGS - shall be set on undisturbed soil or compacted backfill, whichis free of organic material. Poor bearing soil shall be removed to extent required for footing loads andreplaced with a minimum of eight (8) inches of compacted backfill material. Side forms shall be used wheresoil will not retain shape. Unless otherwise shown, footings shall be sized as per code requirements, centereddirectly under the wall and reinforced with: two (2) #4 bars, two (2) inches up from bottom of excavation andtwo (2) inches away from side excavation. Bars shall be lapped 18 inches at splices and shall run continuouslyaround corners; Frost footings shall be a minimum of 8” deep (into undisturbed soil) and shall conform to therequirements of the local building code as adopted by the city in which the work takes place.

CONCRETE - Concrete slab to be constructed with 3500 lb. concrete with a 4-inch minimum thickness. Area shall be filled with four (4) inches of sand or a mixture of sand and gravel uniformly compacted.

APPROACH – For each unit containing a garage door, a concrete approach shall be constructed 12’6” x 15’ and include a 4’x4’ slab connecting the approach with the porch.

PORCH – A 4’x4’ concrete slab at the back door.

Concrete will be provided by HACN, contractor required to provide steel, excavation, finishing of concrete, andall labor.

BID# 2013-001-074-2 TERMITE TREATMENT - The entire structure (footings included) shall be treated in strict compliance and inaccordance with the specifications of the Termite Control System, which will eliminate the present infestation.

Treatment must be carried out by a certified applicator. Structural modifications, soil poisoning, drilling andflooding of masonry voids, which represent the major steps or fundamental principles and operations, shall bemade according to the Termite Committee of the National Pest Control Association and approved by the U.S.Department of Agriculture Bureau of Entomology and Plant Quarantine. All chemicals used shall be approvedby the Environmental Protection Agency (EPA) as indicated.

BID# 2013-001-074-4 FRAMING CARPENTRY - Framing work shall be accomplished in a level, straight, plumb and truemanner.

Exterior Walls - Studs shall be placed 16” o.c. A single bottom plate and double top plate shall beused. Where headers are required, they shall be doubled 2x12. Walls shall be sheathed on the exterior with7/16” wafer board. Bottom plates shall be pressure treated #2 yellow pine. Interior Walls - Partition wallsshall be 2x4 studs 16” o.c. with a single bottom plate and a single top plate. A double top plate shall be used if it’s a bearing wall. The bottom plate shall be treated lumber.

Trusses – Set,fasten, and secure all trusses, prepare for decking;

Roof Sheathing – Deck roof with 7/16” sheathing, nailing 6”o.c. on edges and 12” o.c. on other supports, all end joints shall bear on framing;

Doors - Set all exteriordoors;

Windows – Set all windows;

Furnace Closet – Construct platform for furnace, and provide necessarysupport.

BID# 2013-001-074-5 - BRICK & MASONRY LABOR – Brick and masonry materials provided by HACN. One (1) inch airspace between veneer and sheathing. Galvanized metal ties shall be installed in every sixth course (verticaldistance not to exceed 24 inches) and at every third brick (horizontal distance not to exceed 26 inches). Thereshall be one metal tie for not more than 4½ square feet of wall area. Ties shall be vertically staggered. Theends of ties shall be bent to 90 degree angles to provide hooks not less than two (2) inches long. Additionalties shall be provided at all opening spaces, not more than three (3) feet apart around such opening and within12 inches of the opening.

BID# 2013-001-074-6 DRYWALL HANGING LABOR – Hang all drywall. ½” thick gypsum board. Screws shall be driven with their shanks perpendicular to face of board 7” to 8” o.c. on ceilings and 1 ¼” GWB Annular ring flat head ¼” diameter on sidewalls. HACN will supply drywall materials.

BID# 2013-001-074-7 DRYWALLFINISHING LABOR –Mud, Tape, and Finish all drywall. ½” thick gypsum board shallhave tapered or beveled edges. All joints and corners shallbe taped. Edges will be sanded and feathered after each coat. Inside corners shall be reinforced with tape. Outsidecorners shall be protected by metal molding or metal corner reinforcement. All tape and metal accessoriesshall be imbedded in thin layer of joint cement. Cement three (3) coats over all nails and tape. All mudded and taped areas will be sanded and feathered after each coat. HACN will supply drywall materials. Drywall finish is to be orange peel.

BID# 2013-001-074-8 PAINTING – Includes all labor for interior walls, ceilings and garage, There will be no exteriorpainting. Interior paint will be white semi-gloss finish. HACN will supply paint. BID# 2013-001-074-10 TRIM CARPENTRY LABOR, CABINETS AND COUNTERTOPS – Bid shall include as follows:

Trim - Contractor shall provide all tools, equipment, and labor necessary to complete finish trim carpentry of unit. Trim materials will be furnished by HACN. This will include hanging and fitting all interior doors. Doors shall be hung square, true, and level, and allow for 1” air return air flow at the bottom. Also included will be the hanging of all interior trim, installing all hardware, installing towel bars, installing all door bumps, installing all door hardware, and all closet rods. Will also include Hanging (1) one Storm Door.
