Cost of storage, hauling, & winterization pursuant to published schedule.
1. This agreement is executed in duplicate on the below indicated date between Boat Owner and Hutchinson’s Boat Works. The winterization and storage work order of even date is hereby made a part hereof.
2. The rental period commences on the date of this agreement and ends upon commissioning of the Boat in the Spring, however, in all cases by not later than June 15, 2016.
3. The rent is fully due and payable within 30 days of billing.
4. Boat Owner shall not store any items which violate any law , rule or ordinance of any governmental agency. Boat Owner is hereby advised to remove valuables from boat prior to leaving boat for storage.
5. Boat Owner acknowledges that weather conditions affect Hutchinson’s ability to launch boats. Boat Owner shall call ahead giving as much advance notice as possible to make arrangements for Spring launching.
6. Landlord provides no insurance coverage and accepts no liability for the boat ,any personal property left therein, or for the personal safety of the Boat Owner or the Boat Owner’s Invitees. Insurance for the stored boat and any personal property left on board the boat is the sole responsibility of the Boat Owner. This agreement is expressly contingent on the Boat Owner’s agreement to hold Hutchinson’s, Hutchinson’s agents, employees and officers harmless from any and all liability or cause of action of any nature whatsoever, without exception.
7. Boat Owner shall not perform any bottom sanding or painting while boat is on Premises. Any bottom paint work done on Premises must be performed by Landlord’s licensed technicians pursuant to DEC regulations. No outside contractors of any nature shall be allowed to work on Stored Boats while on Premises.
8. In the event of the sale of the stored boat, it is the responsibility of Boat Owner to notify Hutchinson’s of the new owner’s name and contact information. No outside Boat Broker shall be allowed in Hutchinson’s Storage facility during the term of this agreement.
9. In the event that Boat Owner fails to pay the rent when due or fails to perform any covenant or condition contained in this agreement or fails to take boat out of storage by the end date in paragraph 2 above without arranging for summer storage, Boat Owner shall be deemed in default. In the event of such default, Hutchinson’s may take possession of the stored boat until such time as the default is corrected. In the event that a default continues in excess of 7 days, then Hutchinson’s shall give Boat Owner written notice of default by regular mail at the above address and may thereafter take any legal action available to collect any rents or fees due 30 days thereafter. Any stored boat which remains in the storage premises after the expiration or termination of this rental agreement shall be deemed to have been abandoned by the Boat owner. In the event that Hutchinson’s incurs any expenses, including but not limited to court costs, attorney’s fees, commissions, or any other expenses resultant from Boat Owner’s default, then Boat Owner shall be responsible to reimburse such fees and expenses to Hutchinson’s.
10. In the event that any portion of this agreement is declared invalid, then the remaining portions of this agreement shall be deemed to remain valid and in full force and effect.
11. This rental agreement shall be construed under the Laws of the State of New York. Renter agrees to submit to the Jurisdiction of Town of Alexandria Justice Court or Jefferson County Supreme Court in any cause of action of any nature arising out of this agreement.
12. Boat Owner acknowledges that he (she) has read and understands all portions of this rental agreement and has an identical copy.
