READ CAREFULLY
It is understood that any applicant for membership in HickoryHeights Golf Club does so with knowledge of, and agreement with, the terms and conditions of this membership application and contract. This is a one year agreement.
This agreement is entered into between HickoryHeights Golfers Club,LLC, doing business as HickoryHeights Golf Club (hereinafter referred to as the “Club”) and the undersigned applicant(s) (upon acceptance for membership, “the Member”). This application becomes the membership contract upon the signature of all parties (the Members and the Club) as evidenced below.
SECTION I:MEMBERSHIP FEES & DUES

Fees and dues are subject to increase as according to Section IV of this contract. All memberships are non-transferable.
SECTION II:INITIATION FEE PAYMENT
Payment in full of the above-identified initiation fee is due upon submission of this application.
SECTION III:ENTITLEMENTS
Class SG- Senior Golf-entitles the Member to full golf weekdays, weekends, and holidays.
Class IG- Individual Golf-entitles the Member to full golf weekdays, weekends, and holidays.
Class FG- Family Golf-entitles the Member, his/her spouse and their unmarried children under the age of 21 residing with the Member to full golf weekdays, weekends, and holidays.
All golf privileges are subject to tee time availability. The club reserves the right to schedule outings, tournaments, and other events during which access to the golf course may be restricted.
SECTION IV:TERMS AND CONDITIONS
New Members are responsible for all fees of a full year membership. Membership in the Club does not make the Member(s) financially responsible for any obligations of the Club, and a Member is guaranteed against assessments of any kind for any purpose. Likewise, membership does not confer upon a Member(s) any right, ownership or equity interest whatsoever in any property or appurtenances of the Club. As an applicant or as accepted Member, it is understood and agreed that, as such, the applicant and/or Member does not acquire, maintain or establish any vested rights, undefined privileges of equity in the Club or in the membership therein. The Club reserves the right to change terms of membership and/or the dues, fees or charges upon reasonable notice.
Membership is by invitation only, and the Club reserves the right to accept or reject any and all applications. This contract and the Rules and Regulations of the Club control all aspects of the membership. The Club reserves the right to modify, amend or alter those Rules and Regulations, as it may deem necessary from time to time. The Club reserves the right to suspend or terminate the membership of any Member violating the Rules and Regulations.
SECTION V:DUES CHARGES
Dues are paid monthly and will be charged the 1st of the month to your credit card. A late charge of $15.00 shall be added to the dues owed by the Member if not received by the Club by the fifteenth (15th) day of the month. This late charge shall be cumulative and applied each month to the total balance due. Should a Member be thirty (30) days late in paying dues or other charges, that Member shall be subject to suspension of membership privileges. During suspension, all dues and minimums shall continue to accrue until full payment is made or membership is terminated.
Should a Member be more than sixty (60) days late in paying dues or other charges, that Member shall be subject to termination of membership privileges. In the event of termination of membership by the Club for non payment of dues or other charges, the Member shall not be entitled to a refund of any portion of the initiation fee paid, prepaid dues or other fees, and all amounts owed prior to termination shall continue to be due and owing to the Club.
SECTION VI:RESIGNATION/TERMINTATION OF MEMBERSHIP
Members may, upon at least thirty (30) days’ prior WRITTEN NOTICE to the Club, resign their membership. Any resignation shall be sent to the Club or hand-delivered. Resignation notices received on a day other than the first (1st) of the month shall be deemed effective on the last day of the month following the month in which the noticed is received. Any membership resignations within the first year are subject to a resignation fee of $100 plus two months dues. Members are responsible to all fees and charges due and owing through the last day of the membership and the resignation of a Member shall not be effective all financial obligations of the Member to the Club have been satisfied in full.
Membership is subject to termination for failure to honor the financial obligations described in this Agreement or for persistent disregard of the Rules and Regulations of the Club. In the event of any such termination for cause, the Member shall not be entitled to a refund of any portion of the initiation fee paid, prepaid dues or other fees, and all amounts owed prior to termination shall continue to be owing to the Club. In addition, the Club reserves the absolute right to terminate membership upon thirty (30) days’ prior written notice to the Member(s) with or without cause.
SECTION VII:ASSIGNMENT
The club reserves the right to assign or transfer all its rights, entitlements, obligations and duties in this membership contract to any person or entity; and the Member hereby agrees that any such assignment or transfer shall be effective upon thirty (30) days written notice to the Member. The Member may not assign his or her rights or obligations described in this Agreement without the prior written consent of the Club, which consent may be withheld in the sole and absolute discretion of the Club.
SECTION VIII:COSTS OF COLLECTION
Should it become necessary for the Club to initiate any action for collection of delinquent dues or other fees or charges, the Member agrees to be responsible for, and to pay all costs of, collection or such amounts, including reasonable attorney’s fees and court costs, together with late charges as provided herein and any interest charges available under the law.
SECTION IX:INITIATION FEES
The initiation fee is a one-time payment by the Member(s) for the privilege of joining the Club. The initiation fee is NOT transferable to any corporation, family member, or to any individual not listed on this contract, whether by sale, gift or otherwise. The initiation fee is not redeemable with the Club.
SECTION X:FORBEARANCE AND ACKNOWLEDGEMENTS
Forbearance in the exercise of any of the rights granted to the Club under this contract and the Rules and Regulations are not a waiver of any of the rights. The undersigned acknowledge receipt of the Club Rules and Regulations and acknowledge that they have read and understood those Rules and Regulations. The undersigned agree to abide by those Rules and Regulations as published and as may be altered or amended in the future. Further, the undersigned (if more than one) agree to be jointly and severally liable for and do personally guarantee any and all dues and other obligations thereunder, and so acknowledge their agreement by the signature below.
In consideration of the mutual promises and covenants herein, the undersigned do execute this contract as the final and complete agreement between them.
