August 2, 2012 Public Hearing

Public Hearing regarding a variance request by Scott Olson was opened at 7:15 PM by Duane Goeden. Others present were O’DeanHokanson, Russ Johnsrud, and Zoning Administrator Gary Korsgaden.

Scott Olson presented his variance request to build on to an existing structure to a distance of 5 feet from a public road right of way. The 66’ road right of way is within a plat and is owned by Henrietta Township, it is undeveloped and not maintained.

The following findings of fact were recorded:

  1. Has the applicant established that there are practical difficulties in complying with this ordinance?

-This is the only feasible location to attach the new structure to the existing structure.

-There would be considerable additional costs and excavation needed to build a separate structure elsewhere on the property

-The cost to vacate the road is not cost reasonable.

2. Are there exceptional circumstances unique to this property, which were not created by the landowner?

-The 66’ road right of way for a non developed road.

- The Township does not maintain the road, it has trees growing on it.

  1. Can the variance be granted without upsetting the general purpose and intent of the Zoning Ordinance and the comprehensive plan?

-Yes it can be without upsetting the purpose and intent of the comprehensive plan.

-Required setback in the R1 District is 35’ from a front lot line and 10’ from a side lot line.

  1. Can the variance be granted without altering the essential character of the surrounding area?

-Less than the required setback for the proposed structure would not alter the essential character of the

surrounding area.
