TheOpenAccessCustomerhasmadeanapplicationtoRVPNforavailingshorttermopen
accessontransmissionsystemofRVPNand/orwheelingpowerondistributionsystemof------
Discomasdetailedatschedule-1undertheRajasthanElectricityRegulatoryCommission(Terms
ConditionsforOpenAccess)Regulations,2004andfurnishedrequireddocumentsincluding
copyofMOU/Agreementsforpowerinjection/drawalincludingbalancingpowerandhave
depositedanapplicationprocessingfeeofRs.5000/-(RupeesFiveThousandsonly).

RVPNafterscrutinyandanalysingtheapplicationandcarryingoutrequiredsystemstudiesfor
ascertainingthecapacityandfacilitiesavailableopenaccessdecidedtoallowtheshorttermopen
accessonthefollowingtermsconditions:

theOpenAccessCustomerenterintoanAgreementassetforthhereunder:
Followingconstitutestheintegralpartofthisagreement
(i)Applicationforgrantofshort-termopenaccesssubmittedbyOpenAccessCustomer.
(ii)ConfirmationforabidingandcomplyingwiththeTermsandConditionsforavailing
short-termopenaccess.
(iii)RVPNLetterallocatingtheshorttermopenaccesssubjecttoconditionsmentioned
therein.
TermsandConditionsGoverningAgreementforOpenAccess
TheShortTermOpenAccessisallowedasperprovisionsofRajasthanElectricityRegulatory
Commission(TermsandConditionsforOpenAccess)Regulations,2004.
Theopenaccessshallbegovernedbytheprocedureandthetermsconditionsspecifiedby
RVPNinpursuancetoRajasthanElectricityRegulatoryCommission(TermsandConditionsfor
OpenAccess)Regulations,2004.
Chargesforopenaccess
(1)TheOpenAccessCustomeragreetopaythetransmissionchargesforuseofthe
TransmissionSystemandwheelingchargesforuseofthedistributionsystemofa
distributionlicenseeasthecasemaybeasspecifiedbytheCommissionfromtimetotime.
(2)Transmissionchargesfortransmissionsystemand/orwheelingchargesforadistribution
system,asthecasemaybe,constructedforexclusiveuseoftheopenaccesscustomershall
beasdeterminedbytheRVPNand------Discomforrespectiveyearbasedontariffnorms
specifiedbytheCommissionintheregulationsfordeterminationoftariff.
(3)Entirechargesfordedicatedtransmissionsystemand/oradistributionsystemasthecasemay
beshallbebornebytheopenaccesscustomertillrecoveryofentirechargesforthededicated
systemuptosuchtimethesurpluscapacityisusedbyotherpersonsorotherpurpose
(4)Theinter-stateopenaccesscustomersusingintra-statetransmissionsystemordistribution
systemofDistributionLicenseeinconjunctionwithinter-statetransmissionopenaccess
shallpaytoRVPNthetransmissionchargesand/orwheelingchargestoconcerned
distributionlicenseeforuseofintra-statesysteminadditiontopaymentoftransmission
chargesforinter-statetransmission.
(5)BesidestheTransmissionchargesand/orwheelingchargesforuseoftheRVPN
TransmissionSystemand/orthedistributionsystemof------Discomasthecasemaybe,the
OpenAccessConsumeragreestomakethepaymentoffollowingotherchargesin
accordancewithRajasthanElectricityRegulatoryCommission(TermsConditionsfor
OpenAccess)Regulations,2004:
a.Reactiveenergychargesinaccordancewiththeschemeapplicabletogeneratorsand
consumersforreactivechargeinputanddrawalrespectivelyasmaybedeterminedbythe
Commissionfromtimetotime.
b.Paymentofun-scheduleinterchangeandmismatchnotexceeding5%ofthecontracted
openaccesspowerbetweenthescheduleandtheactualdrawalasperthepricing
mechanismspecifiedbytheCommissionfortheStatefromtimetotime.
c.Paymentforbalancepowerrequirementexceeding5%ofthecontractedopenaccess
powerbetweenthescheduleandtheactualdrawalshallbearrangedbytheOpenAccess
CustomerdirectlyunderaseparateAgreemententeredbetweentheOpenAccess
CustomerandanyDistributionLicensee/TraderorGeneratingCompany.
d.PaymentofschedulingandsystemoperationchargestotheSLDCasdeterminedbythe
Commissionfromtimetotime.
Surcharge
(1)Inadditiontotransmissionchargesand/orwheelingchargesasthecasemaybeaconsumer
availingopenaccessoftheRVPNtransmissionsystemand/ordistributionsystemshallpay
totheDistributionLicenseetowhichheisconnected,asurchargeasdeterminedbythe
Commissionfromtimetotime.
(2)TheOpenAccessConsumersavailingexclusivelytheinter-statetransmissionsystemshall
alsopaythesameamountofsurchargeasdeterminedbytheCommissionforintra-state
transmissionsystem/distributionsystem.
AdditionalSurcharge
Aconsumeravailingopenaccessandreceivingsupplyofelectricityfromapersonotherthanthe
distributionlicenseeofhisareaofsupplyshallpaytothedistributionlicenseetowhichhewas
originallyconnectedanadditionalsurchargetomeetthefixedcostofsuchdistributionlicensee
arisingoutofhisobligationtosupplyintermsofRERC(TermsConditionofOpenAccess)
Regulations,2004.
Non-UtilisationofOpenAccessCapacity
(1)TheOpenAccessCustomermaysurrenderthecapacityallottedtohimbyservinganotice
of30daystoRVPNandStateLoadDespatchCentre,ifheisunableornotinpositionto
utilizethefullorsubstantialpartofthecapacityallottedtohim.
(2)TheOpenAccessCustomershallmakepaymentforun-utilized contractedopenaccess
capacityasdeterminedbyRVPNfromtimetotimebasedonRegulationsforTariff
determinationprescribedbytheCommission.
(3)TheOpenAccessCustomershallalsopaytheSchedulingandSystemOperationandLoad
Despatchchargesforun-utilizedcontractedopenaccesscapacitysurrenderedbyhimfor
theremainingperiodofallocation.
(4)HoweverwhentheOpenaccessConsumersurrendersthefullorsubstantialpartofthe
capacityandRVPNacceptssuchreductionorcancellationintheOpenAccessCapacity
andallotssuchreleasedsurrenderedcapacitytoanotherOpenAccessCustomer,the
chargesrecoverablefromoutgoingOpenAccessCustomershallbereducedfortherevised
capacityonly.
Metering
(1)Metersatpointofinjunctionanddrawalandatsuchotherpointsspecifiedbythe
Commissionbasedonvoltage,pointandperiodofsupplyandtariffcategoryasperlatest
amendedMeteringCodeforRajasthanGrid(GridCodepart–III)intransmissionsystem
andasperMeteringCodeofdistributionlicenseesatinter-connectionpointwith
DistributionSystemshallbeprovidedbytheOpenAccessCustomerathisowncost.
(2)Boththepartiesagreethatprovisionsrelatingtometering,jointmeterreading,sealingand
settlementetcshallbegovernedbyRERC(TermsConditionofOpenAccess)
Regulations,2004andMeteringCodeforRajasthanGridandDistributionMeteringCode
ofconcernedDiscom.
Energylosses
TheenergylossesinthetransmissionsystemanddistributionsystemshallbebornebytheOpen
AccessCustomerinproportionoftheenergydrawalbasedontheactuallossesduringprevious
yearinthetransmissionanddistributionsystemfortheconnectedopenaccessvoltagelevel.
ThemonthlystateenergyaccountpreparedandissuedbytheStateLoadDespatchCentreshall
bebindingonbothparties.
SecurityDeposits
(1)Securitydepositamountequivalentto3monthsamountoftheaveragebillingtowards
transmissionchargesontheallocatedopenaccesscapacityshallbemaintainedbyOpen
accessCustomerwithRVPN.
(2)OpenAccessCustomershallfurnishasecuritydepositofamountequivalentto3monthsof
theaveragebillingtowardsStateLoadDispatchCentrechargesandSchedulingChargesto
SLDC.
(3)Asecuritydepositofamountequivalentto3monthsoftheaveragebillingtowards
wheelingchargesonDistributionSystemforOpenAccessshallbefurnishedbyOpen
AccessCustomertoconcernedDiscom..
(4)TheOpenAccessCustomershallfurnishsecuritydepositseitherinCashorLetterof
Credit(s)fortheaboveestimatedaveragebillingamountatthetimeofAgreementbutin
anycasebeforeconnectingintosystem.
ComplianceofGridCodeandDistributionCode
AllthepartiesagreetocomplywiththeprovisionsofRajasthanGridCode,DistributionCodein
forcefromtimetotimeforuseofDistributionSystemofDistributionLicenseeincludingthe
ConnectionConditionsmentionedtherein.
TransmissionPerformanceStandards
BoththepartiesagreesthatallequipmentconnectedtotheStateTransmissionSystemshallbeof
suchdesignandconstructiontoenabletheRVPNtomeettherequirementofPerformance
Standardsspecifiedatinter-connectionpoint.TheOpenAccessCustomerconnectedtoState
TransmissionSystemshallensurethattheirloadsdonotcauseviolationofthesestandards.
UnforeseenCircumstances
Openaccessonthetransmissionsystemandwheelingondistributionsystemshall
besubjecttotransmissionanddistributionsystemconstraints.Theprovisionof
Openaccessshallremainsuspendedduringsuchperiodattheabsolutediscretion
ofSLDC/Distributionlicensee.
SchedulingbySLDC
TheOpenAccessCustomershallabidetheSLDCscheduleandshallcomplywithalldirections
issuedbySLDC.
TermofAgreement
Theopenaccessallowedshallberemainvalidupto-----
