GUARANTEE AGREEMENT

This Guarantee Agreement is dated and effective as of the date on K&D Management, LLC standard Lease Agreement to which this agreement is attached and made a part of (“the Lease Agreement”) and is made by and between Lessor, the Guarantor identified below, and Resident for the Apartment at the Premises identified in the Lease Agreement.

Guarantor memorializes and unconditionally acknowledges and assumes full financial responsibility incurred on behalf of the Resident until all financial obligations have been fulfilled under the Lease, as such Lease may or may not be renewed. This responsibility includes, but is not limited to, all Rent owing by Resident at the Community. Should Resident or any occupant of the Premises continue to hold over in the premises after expiration of the term thereof, the undersigned Guarantor shall continue to be financially responsible for the rental value of the Premises until the Premises are returned to the exclusive possession of Lessor.

The obligations described herein are primary. Guarantor waives the right, if any, to notice of Resident’s default and/or to require the holder of this Guarantee to attempt enforcement against Resident of the Lease Guarantor. If any legal action is necessary to enforce any financial obligations under the Lease Agreement, the Guarantor agrees to be named a party defendant in any original litigation arising therefrom, and to have liability concurrent with Resident.

Guarantor agrees that service of process upon Guarantor is appropriate if service is made at the Apartment in any manner allowed by the lease Agreement and/or applicable law. Guarantor further agrees that service of process upon Guarantor at the Apartment of any legal documents shall confer personal jurisdiction upon any court where the action is filed.

If Guarantor is married, both spouses must sign this Guarantee Agreement. If desired by Lessor or if any requested of Lessor, Lessor may provide rental and/or payment information on Resident to Guarantor.

If this agreement is signed by Guarantor in the presence of Landlord, with Guarantor’s proper identification, Guarantor’s signature does not need to be notarized. If this agreement is NOT signed by Guarantor in the presence of Landlord, Guarantor’s signature MUST be notarized.
