KNOW ALLBY THESE PRESENTS:

That I/we,,as principal, and ______,a corporation organized and existing under the laws of the State of ______as a surety corporation, and qualified under the laws of the State of Washington to become surety upon bonds of contractors/principals with municipal corporations, as Surety, are jointly and severally held and firmly bound to the CITY OF TACOMA(“City”)in the penal sum of TEN THOUSAND DOLLARS ($10,000) (sales tax not applicable), for the payment of which sum on demand we bind ourselves and our successors and assigns, heirs, administrators, or personal representatives, as the case may be.

WHEREAS, under and pursuant to the City Charter and general Ordinances of the City of Tacoma, the above principal has applied to the City’sDirector of Public Works for a Right-of-Way Occupancy Permit (“Permit”) for the installation of ground monitoring wellswithin, upon and under a street, alley or other public place in the City which may obstruct, disturb, or interfere with the free use thereof or cause a dangerous condition thereon.

NOW, THEREFORE, if said principal shall,during the continuance of said Permit, faithfully perform and comply with all the provisions of said Permit and shall indemnify and save harmless the City of Tacoma from any and all judgments, costs or expenses arising from injuries or damage to any person or property on account of installation and existence of said ground monitoring well and shall carry out and complete such installation within the specified time and according to the terms of saidPermit, and shall restore said street, alley, or public place to its pre-existing condition or better within the time specified by the Director of Public Works, then and in that event this obligation shall be void; otherwise it shall be and remain in full force and effect; provided, however, that future liability on this bond may be terminated by ten (10) days’ notice to the Director of Public Works of the City of Tacoma. Termination of liability under this bond by notice to the Director of Public Works will not operate to release the surety of liability for thePermitsubject of this bond.
