The undersigned student at ColoradoSchoolof Mines herein called "STUDENT” and ColoradoSchool of Mines herein called "CSM" hereby enter into this Housing Contract under the terms and conditions set forth below.

DURATION OF THE HOUSING CONTRACT (Check one):

FULL ACADEMIC YEAR: The duration of this contract is for the full academic year of 2011-2012commencing ten days prior to the start of classes and ending eight days after May Graduation of the same academic year; or for any prorated portions thereof, in the event the STUDENT ends the occupancy at a date prior to the end of the spring semester.

FALL ONLY:The duration of this contract is for the fall semester of 2011 commencing ten days prior to the start of classes and ending eight days after December Graduation of the same year; or for any prorated portions thereof, in the event the STUDENT ends the occupancy at a date prior to the end of the fall semester.

SPRING ONLY:The duration of this contract is for the spring semester of 2012 commencing four days prior to the start of classes and ending eight days after May Graduation of the same year; or for any prorated portions thereof, in the event the STUDENT ends the occupancy at a date prior to the end of the spring semester.

HOUSING Deposit

  1. A housing deposit of $100on a check payable to the Colorado School of Minesis required for this contract.

  1. If, after submitting this contract with the $100 deposit, the student decides to cancel the contract priorto the move in date; the entire deposit will be forfeited.Thisrequest for cancellation must be in writing and submitted to Student Activitiesprior to moving into the chapter house.
  2. This deposit will be held against property damage, room defacement, or early termination of the contract (deactivation) and will be refunded, less any damage charges,within 30 days of receiving official notification from that chapter that the STUDENT has vacated the premises.

CONTRACT TERMINATION

  1. TERMINATION BY CSM:CSM may terminate this contract:
  1. Failure to Pay - If the Student fails to pay assessed fees or other charges when due.
  2. Discipline Matters - If the Student does not comply with the rules contained in the Student Handbook, civil laws or student code contained in the CSM policies or is in violation of any term agreed upon in the Memorandumof Understanding (see attached).
  3. Casualty Damage - If fire or other casualty renders the room un-tenantable.
  4. Disruptive Behavior - If the Student's behavior interferes with the living-learning community.
  5. Other - The Director of Auxiliary Services and Housing feels the cancellation is the best interest of the student, the chapter or the university.

In the event that the contract is terminated, CSM may take one or more of the following actions against the Student:

  1. Cancel this agreement and expel the student from Greek Housing.
  2. Housing deposit will be forfeited.
  3. Request payment for remaining balance of contract.
  4. Request reimbursement for any and all damages caused by the Student.
  5. Pursue any and all other remedies, including judicial relief, which may be available.
  6. CSM reserves the right to pursue disciplinary procedures provided in the Student Handbook for any violation thereof.
  1. MUTUAL TERMINATION:This contractual agreement may be terminated with appropriate pro-ration of fees with the approval of Student Activities and Student Life. Please be advised that mutual termination does not automatically exempt the resident from the responsibility of paying the remaining balance of the contract. Cases will be handled on a case-by-case basis and a final decision will be rendered by Student Life. Student Life will remove all appropriate charges within 30 days of official notification of termination. The chapter should also complete a membership update form and submit it to Student Activities.
  1. University withdrawal- if the Student ceases to be a currently enrolled student at CSM and a copy of thewithdrawal is given to Student Life.
  2. Marriage- if the Student presents an original certificate of marriage and requests termination, thisContractual Agreement will be terminated on the date the evidence is presented, providing the marriageoccurs during the term of this Agreement.
  3. Study Abroad Program - if the Student participates in a CSM study aboard program. Students must receive prior approval from the chapter and a Chapter Housing Approval form must accompany the contract in the fall.
  4. Loss of Membership - Deactivation, suspension or expulsion from the Greek house of affiliation.
  5. Medical Exemption - Medical Reasons as requested in writing by a licensed medical professional supporting the request for a medical release, given to the Greek Advisor and Student Life.
  6. Medical Marijuana: Possession of a valid and appropriately held Medical Marijuana Registry identification card does not authorize a Resident or his or her guests to possess, use, or distribute marijuana in any fraternity/sorority house, university-owned property or in any public area of the university. Students who request and receive a valid and appropriately held Medical Marijuana Registry identification card during the term of this contract may submit a request to the Director of Auxiliary Services and Housing or his/her designee to be released from this Lease without financial penalty.

Room Rates

2011-2012 Room Rates per semester (for comparative purposes only):

Rates for 2011-2012 are based on rates from the previous year and are subject to approval by the CSM Board of Trustees during the summer meetings. The annual Room Rates typically increase by an amount between 3% and 7% from the previous year (the 2010-2011rates were $2,163 per semester for Sigma Nu; $2,395.50 per semester for Fiji; and $2,341.50 per semester for the sororities). This amount will be assessed to your student account once a semester. It is due and payable to CSM through the business office.

CONTRACTUAL AGREEMENT

Please read the aforementioned terms and conditions carefully before executing this Greek Housing Contract. By executing this contract, the undersigned agrees to pay all charges and fees for room and for any property damage to the room or room furnishings assigned to the Student for his/her use during the period of residency set forth.

No term or condition of this Contract can be waived by any statements made by the University or its agent. Any such waivers must be in writing in order to be deemed effective. Should any clause or portion of this contract be held invalid by a court, the remaining portions shall still be considered in force.
