Pursuant to the terms of the sales agreement utilized in connection with the sale of homesite lots within the Company’s service territory, and pursuant to beneficial restrictive covenants filed of record on the Company’s service territory, homesite lot owners are obligated to pay a charge when sewer lines are extended to their homesite lots and upon which no structure has been erected. Such charge, as established hereby, is $24.00 per lot per quarter and shall be paid irrespective of the fact that sewage is not discharged.

RULES AND REGULATIONS

1. DEFINITIONS

1.1 “Sewer System” shall mean sewer mains, lateral sewers from main to point of sewer service line connections, sewer service lines, sewage ejector and/or pumping stations, sewer force mains, sewage treatment plants and all appurtenant facilities operated by Glendale Yearound Sewer Company in furnishing sewer service.

1.2 “Sewer Service Line” shall mean all facilities located between a lateral sewer and the curb or, if there is no curb, the edge of the roadway abutting the property furnished sewer service.

1.3 “House Sewers” shall mean all facilities located between a Sewer Service Line and premises furnished sewer service.

1.4 “Sanitary Sewage” shall mean spent water, together with human and household wastes ordinarily removed by water carriage. Such definition expressly excludes the effluent from septic tanks or cesspools, as well as rain, storm and ground water which could in any way enter the Sewer System as well as roof or surface drainage, drainage of percolating or seeping waters or of accumulations thereof, whether underground or in cellars or basements.

1.5 The word “ spigot”, as used herein, shall mean either a wash basin or sink with one or two faucets, a lone faucet, a flush toilet, a shower facility, a bath facility, an automatic dishwasher hook-up, or a laundry washer hook-up.

1.6 The word “Company”, as used herein, shall mean Glendale Yearound Sewer Company acting through its properly authorized officers, agents or employees, each acting with the scope of the particular duties entrusted to him.

1.7 The word “customer”, as used herein, shall mean (C)

the party contracting for sewer service or sewer service is available to be received for an approved subdivided lot or campsite, including an unimproved property or an improved property, unless the deed prohibits the construction of a structure that may receive sewer service. An improved property shall mean:

(a)A building under one roof and occupied as one (C)

Residence or business; or

(b)One side of a double house having a solid vertical (C)

partition wall; or

(c)One side or part of a house occupied by more than (C)

One family or business, even though the closet and

other fixtures be used in common; or

(d)Each apartment, office or suite of offices located (C)

In a building having several such apartments,

offices or suites of offices and using in common

one hall and one or more means of entrance; or

(e)A mobile home, irrespective of whether wheels (C)

  1. CONDITIONS OF SERVICE

2.1 Compliance with Rules and Regulations

No connection shall be made, either directly or indirectly, to

the Sewer System until all requirements of the rules and

Regulations have been met. No connection or House Sewer, through which sanitary sewage does or may enter the Sewer System, shall be constructed, altered, repaired, or allowed to exist, which does not comply with the rules and regulations.

2.2Application for Service

All applications for sewer service must be made, in writing, on a form provided by the Company. The application and these rules and regulations constitute a contract between a customer and the Company.

2.3Individual Sewer Service Line

Each property must have its own individual Sewer Service Line.

2.4Maintenance, Repair and Relocation of House Sewers

All House Sewers shall be maintained and repaired at the cost of the owner of the premises served, and such repairs shall be subject to the direction, approval and inspection of the Company.

The owner of the premises served shall make any change to House Sewers which shall be required because of change of grade or relocation of the Company’s facilities or otherwise.

2.5Inspection of House Sewers and Sewage

The Company, by its agents and employees, shall have the right, at all reasonable times, to enter any premises connected with, or about to be connected with, the Sewer System, to inspect House Sewers, sources and nature of sewage and all fixtures and facilities from which sanitary sewage may be discharged into the Sewer System in order to enforce compliance with the rules and regulations.

2.6Prohibited Flow - Sanitary Sewage

No flow, other than sanitary sewage, shall be turned into or permitted to enter the Sewer System, and no connection, fixture,

device, opening or condition shall be allowed to exist which would permit any flow, other than sanitary sewage, to enter the Sewer System.

Use of the service by a customer shall be in accordance with the class, scope, and type of use, and for the purpose stated in an application. A customer shall not use, and shall not allow use by others of, his House Sewer for other persons or for other purposes than as covered in an application. A new application will make service available for other purposes or for other character of use.

2.7Damages

The Company shall not be liable for any damage or expense, occurring to or within any premises, resulting from leaks or stoppage in the Sewer System or from any other cause.

  1. HOUSE SEWERS

3.1Plans and Specifications

Before connecting any proposed drainage or sewers directly or indirectly with the Sewer System or before making any material alterations of existing drainage or sewers, connected directly or indirectly with the Sewer System, plans and specifications shall be submitted to the company, showing proposed construction or existing plumbing, as applicable.

3.2Requirements for Customer’s Service Pipe

That portion of the service pipe installed and maintained by the customer shall conform to all reasonable rules of the Company. It must be constructed of approved materials and must be installed and maintained in accordance with accepted good practice and in conformance with applicable codes or governmental regulations.

3.3House Sewer and Connections of Sewer Service Lines

All connections to the Sewer System shall be made at the curb, or , if there is no curb, at the edge of the roadway abutting the property furnished sewage service. Where no Sewer Service Line previously has been constructed, such facilities shall be constructed, at the expense of the Company, by the company, or under the Company’s direction and supervision.

3.4Standard of Quality of Construction - House Sewers

All construction, reconstruction and alterations of House Sewers and appurtenances shall be done and installed in a competent, workmanlike manner in accordance with recognized standards of the plumbing trade. The Company may require reconstruction of any work done improperly.

  1. SPECIAL DEVICES AND TREATMENT

4.1Requirement of Special Devices

All persons discharging sanitary sewage containing grease, oils or fats into the Sewer System shall provide adequate grease and sand traps or oil separators which shall effectively keep the grease content of sewage leaving the premises to less than 100 parts per million by weight.

4.2Prohibited Wastes - Special Treatment

Only those wastes which conform to reasonable rules and regulations of the Company shall be discharged into the Company’s Sewer System. The Company shall have the right to direct any customer to cease and prevent the discharge into the Sewer System of any wastes not complying with these regulations. Where wastes are of such character as to violate any of the Company’s reasonable rules and regulations in this respect, the wastes must be pre-treated to such a degree that they will comply with the Company’s said rules and regulations.

4.3Approval of Pretreatment Devices

All grease traps, sand traps or other devices for pretreatment of sanitary sewage or industrial waste shall be subject to the approval of the Company prior to installation.

  1. Bills

5.1Payment of Applicable Charge

Each customer shall pay the applicable charge in the amount which is set forth in the Schedule of Rates.

5.2Late Payment Charge

Bills are due and payable upon presentation. If a bill is not paid within 20 days after the due date, a penalty at a monthly rate of 1.5 percent (C)

will be added to the amount of the next bill.

Failure to pay a bill for any month shall not excuse the delinquent customer from the charge, under the Schedule of Rates, for any succeeding month.

5.3Payment of Bill

Payment of an undisputed bill, within the meaning of the Public Utility Code, shall be payment of the bill, with or without discount or penalty, (C)

within twenty days following the date of the bill, or payment of any contested bill, payment of which is withheld beyond the period herein mentioned and the dispute is terminated substantially in favor of the customer and payment made by the customer within ten days thereafter.

5.4No Waiver of Rules and Regulations

Presentation or non-presentation of a bill shall not be held to be a waiver of any of the rules and regulations.

  1. DISCONTINUANCE OF SERVICE

6.1Termination of Service

Service may be terminated by the Company for violation of any rule or regulation of the Commission or this tariff. Before service may be (C)

terminated, the Company shall follow the procedures established by the Commission in Title 52 of the Pennsylvania Code.

  1. CUSTOMERS’ DEPOSITS

7.1Amount of Deposit: Interest

The Company reserves the right to require a deposit equal to the estimated gross bill for any single billing period plus one month (The maximum number of months for calculating the maximum deposit shall be four months in the case of quarterly billing and shall be two months in the case of monthly billing.) With a minimum deposit, at the Company’s option, of not less than $5.00. The purpose of such deposit is to secure payments where the credit of the customer has not been established to the satisfaction of the Company. Upon the deposit, the Company will pay six percent (6%) interest per annum. Upon deposits held for more than a year, the Company will pay to the customer, at the end of each calendar year, the interest accrued thereon.

7.2Refund of Deposit

The Company will refund a deposit to the customer after(C)

payment has been made of all amounts due or when the customer shall have paid undisputed bills over a period of twelve consecutive months. Any customer who has secured the return of a deposit shall not be required to make a new deposit unless the customer’s credit standing has been impaired through failure to comply with tariff provisions.

  1. MISCELLANEOUS

8.1Rules and Regulations are Binding

No agent or employe of the Company shall have the right or authority to bind it by any promise, agreement, or representation contrary to the provisions or intent of these rules and regulations.

8.2Alteration or Amendment of Rules and Regulations

The Company reserves the right to alter or amend these rules and regulations in the manner provided by law.

  1. Extension of Service

Whenever the developer/owner or occupant (“Applicant”) of a property within the service territory of the Utility requests the Utility to extend its system to service such property, the Utility shall agree to extend its service upon Applicant’s execution of a Main Extension Agreement and Applicant’s payment of and Advance in an amount as determined below. Alternatively, the Utility may agree to have such extension service lines constructed, installed and financed by the developer, with the Utility arranging to reimburse the developer for cost of such construction out of revenues to be derived from the service connections so constructed.

The Utility will utilize an agreement defining the required extension, amount of deposit, any non-refundable contributions, and terms for refunding deposits, such agreement being in accord with the Public Utility code, Title 66 Pa, C.S.1303.

(a)The Utility will extend existing distribution mains a distance of thirty-five (35) feet for each bona fide prospective customer making application for sewer service therefrom for a period of one year or more under these Rules and Regulations. Such extensions will be made without cost to such customer(s).

(b)With an extension greater than thirty-five (35) feet in length for each bona fide prospective customer is required or requested, such extension will be made under the terms of an “Extension Deposit Agreement.” The Utility shall have the exclusive right to determine the type and size of mains to be installed and the other facilities required to render adequate service. However, where the Utility decides to install a pipe larger than necessary to render extension of adequate service to the applicant, all estimated or actual cost figures referred to in the “Extension Deposit Agreement” shall include the material cost and installation cost for a pipe the size of which is necessary to provide adequate service to the applicant. Any incremental costs of a larger pipe will be the responsibility of the Utility. All estimated or actual cost figures referred to in the “Extension Deposit Agreement” shall include a reasonable allowance for overhead costs and taxes. The minimum pipe size for main extensions shall be 6 inches per 52 Pa. Code Chapter 65.17(b).

(c)In determining the length of and necessity for any extension required, the terminal point of such extension shall, in all cases, be at that point in the curb line which is equidistant from the side property lines of the last lot for which sewer service is requested. A street service connection will be provided only for customer service lines that extend from the curb to the premises to be serviced which are laid in a straight line at right angles to the curb line.
