The FloridaStateUniversity acting for and on behalf of the FSU Board of Trustees, a public body corporate of Florida by and through the FSU Property Surplus Warehouse is conducting a special “Sealed Bid” Auction. The item (s) up for bid are as follows:

The high bidder for the item (s) will be notified via telephone and/or email. Payment must be made in the form of CASH or CHECK within 10 (ten) days of notification. If payment is not received in the allotted time, the bidder has forfeited his/her right to ownership and the next highest bidder will be contacted.

The winning party must arrange for the item (s) to be removed/picked up from its current location.

ALL costs associated with removal/pick up of the item (s) are the responsibility of the new owner. Removal/pick up dates and times are subject to the availability of the FSU Department that currently houses the item. Proper contact information will be given to the winning party upon receiving payment. Sealed Bid Sale — Terms and Conditions

All bidders and other participants of this sale agree that they have read and fully understand these terms and agree to be bound thereby.

Guaranty Waiver: All property is offered for sale “AS IS, WHERE IS.” Florida State University, acting for and on behalf of the FSU Board of Trustees, a public body corporate of Florida, located in Tallahassee, Florida by and through the FSU Property Surplus Warehouse (Seller) makes no warranty, guaranty or representation of any kind, expressed or implied, as to the operability, condition, merchantability or fitness for any purpose of the property offered for sale. The Buyer is not entitled to any payment for loss of profit or any other monetary damages — special, direct, indirect, or consequential.

Description Warranty: Seller warrants to the Buyer that the property offered for sale will conform to its description. Any claim for mis-description must be made prior to removal of the property. If Seller confirms that the property does not conform to the description, Seller will keep the property and refund any money paid by the Buyer to the Seller. The liability of The Florida State University shall not exceed the actual purchase price of the property. Please note that upon commencement of the property removal, the sale is final.

Personal and Property Risk: Persons attending during exhibition, sale or removal of goods assume all risks of damage of or loss to person and property and specifically release the Seller from liability therefore. Seller is only liable for the negligent acts and omissions of its employees as provided by Section 768.28 Florida Statutes, and Seller does not waiver sovereign immunity concerning any aspects of this sale.

Inspection: The item (s) offered for sale are used and may contain defects not immediately detectable. Bidders may inspect the property prior to bidding. Please contact the department representative as noted on the Advertisement to schedule an inspection time.

Consideration of Bid: The Florida State University reserves the right to reject any and all bids and to withdraw from sale any of the item(s) listed.

Buyer’s Certificate: The successful bidder (the highest bidder) will receive a Buyer’s Certificate by email or mail from The Florida State University that contains the address and payment information.

Payment: Payment in full is due no later than 10 (ten) business days from the time and date of the Buyer’s Certificate. Acceptable forms of payment are:

• U.S. Currency (in person only, no mail) • Cashier’s Check • Certified Check • Money Order • Traveler’s Check • Company Check (with Bank letter guaranteeing payment — mandatory)

Checks shall be made payable to: The Florida State University. Payments shall be made at the location listed in the Buyer’s Certificate.

Removal: All items must be removed within 20 (twenty) business days from the time and date of issuance of the Buyer’s Certificate. Purchases will be released only upon receipt of payment as specified. Successful bidders are responsible for loading and removal and any and all property awarded to them from the place where the property is located as indicated on the website and in the Buyer’s Certificate. The Buyer will make all arrangements and perform all work necessary, including packing, loading and transportation of property. Under no circumstances will The Florida State University assume responsibility for packing, loading or shipping. Property may be removed between the hours of 8:00 a.m. and 3:00 p.m. Monday through Friday, EST excluding legal holidays, with the concurrence of the Department representative.

Default: Default shall include (1) failure to observe these terms and conditions; (2) failure to make good and timely payment; or (3) failure to remove all items within the specified time. In Seller’s sole discretion default may result in termination of the contract and suspension from participation in all future sales until the default has been cured. If the Buyer fails in the performance of their obligations, Seller may exercise such rights and may pursue such remedies as are provided by Florida law.

State/Local Sales Tax: Buyers may be subject to payment of State/local sales tax. The Florida State University is responsible for collection of taxes, which will be added to the winning bid amount. Buyers are responsible for providing a copy of their tax exempt form (as applicable) to avoid having to pay taxes.

Sales to Employees: Employees of The Florida State University may bid on the property of The Florida State University, provided that they do not bid while on duty. Any officer or employee participating in the determination of Sale execution and outcome shall not submit a bid.

Law, Venue and Litigation: The Sealed Bid Sale is governed and construed pursuant to the law of Florida and the Administrative rules of The Florida State University, Board of Governors and Department of Education, with venue being in Leon County, Florida. In case of dispute each party shall be liable and responsible for its own legal costs, expenses and attorney fees.
