Annex A

An exemption under section 38(1)(b) of FOISA (personal information) applies to some of the information requested because it is personal data of a third party, ie the names and contact details of individuals, and disclosing it would contravene the data protection principles in Schedule 1 to the Data Protection Act 1998. This exemption is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.

In response to the members query, I provide the following clarification:

Parts 4 and 5 of the Children and Young People Act 2014 could in theory work independently of one another. They have been designed so that they work together to make appropriate and proportionate universal and targeted support available seamlessly as and when families may want or need this. A key component of this interrelationship is information sharing, hence the intent would be to produce one Code of Practice that addressed information sharing in Parts 4 and 5 of the 2014 Act, similarly the Statutory Guidance for Parts 4 and 5 would be combined so one Code of Practice would apply to both sections.

This approach we believe would make most sense in explaining the law to practitioners and the public who will often be experiencing information sharing as support moves between that available through the Named Person service provider and processes in relation to a Child’s Plan.
