RESPONSIBILITIES FOR

GNO PRPOERTY MANAGEMENT (GNO) AND

MEMBERS OF THE
ARCHITECTURAL CONTROL COMMITTEE (ACC)

GNO Property Management responsibilities to assist the ACC:

1.  GNO will receive submittal request from the resident.

2.  GNO will review the request to make sure they are complete. Two sets of all Plans and a Plot Plan for construction of single residences, additions, and alterations, including any accessory buildings, swimming pools and fences, and including the ground floor or slab elevation in relation to the street. The plans and/or project specifications to include at a minimum the complete Plans, showing the location, nature, shape, height, material, color, type of construction, and/or any other proposed form of change (including, without limitation, any other information specified by the Committee).

3.  As per Section III A. Maintenance, GNO will inspect the subdivision twice a month for any architectural control violations. From that standpoint, GNO will give a non-binding opinion to the ACC and cc: the Board if the requests in its present form would be a violation.

4.  GNO will forward the complete request and GNO’s opinion to the ACC and cc: the Board.

5.  GNO will make ACC aware of the submittal date and follow-up to ensure approval or denial is returned to the resident prior to the required 30 day period.

6.  GNO will receive the decision from the ACC.

7.  Should the ACC decision be different than the GNO opinion or if the ACC is granting an exception to the restrictions, the ACC will transmit their draft letter to the Board for review. After a final decision is made the ACC will transmit this to GNO for them to write the letter to the applicant. This letter is to be copied to the ACC and the Board. This letter and any attachments should be scanned and emailed to the ACC and Board on the same day the letter is placed in the mail.

8.  GNO will notify the resident by phone and with a letter of approval or denial.

9.  During GNO inspection visits, GNO will record when the project is started and when the project is completed per approval letter. A completion letter will be sent to the ACC and Board.

10.  GNO is to email the ACC & the Board on the same day that any violation letters (1st, 2nd, 3rd, etc) is sent to a homeowner. As of yet, the current by-laws and restrictions do not have provisions for fines.

Architectural Control Committee (ACC) responsibilities:

1.  ACC will review the request, previously reviewed by GNO, as to safety, harmony of external design, color, and location in relation to surrounding structures. Review submittal to make sure the change or alteration will not affect the interest or welfare of any other Owners, or impair any servitude.

2.  ACC will review submittal plans for compliance to all provisions of Section III and Section IV of the restrictions.

3.  ACC members must be aware the only exception the ACC can approve in the Restrictions is Section III Item 15 Fences and Walls.

4.  ACC will keep in mind that Section III Item 15 was tentatively approved at 2011 Homeowners Meeting and will read: No fence or wall shall be constructed or allowed to remain nearer the street than at the rear corner of the dwelling. The ACC committee may only approve exceptions of fences to the rear corner of the dwelling, if the orientation of the front of the house is not parallel to the front property line. Exceptions for the fence shall not be nearer the front street than the midpoint of the side length of the dwelling. Exceptions for the fence shall run from the dwelling parallel to the front property line or at an angle in which the fence run shall not be nearer the front street than the starting point from the dwelling. All exceptions closer to the street than the rear corner of the dwelling shall be constructed of black wrought iron or black decorative aluminum fence material. No wooden fences shall be allowed that are nearer the street than the rear corner of the dwelling. Fence or wall materials and height must be approved by the ACC committee.

5.  ACC will present to the Board, prior to approval being sent to the resident, any exceptions to the restrictions.

6.  ACC will indicate its decision on the submittal form and forward the signed form to GNO to notify the resident by phone and with a letter of approval or denial.

7.  Upon receipt of the GNO completion letter, ACC will write an acceptance letter for GNO to send to the resident.
