Rules & Regulations

These Rules and Regulations are authorized by Section 5.2 of the Amended Condominium By-Laws and are not intended to restrict the rights of any Owner, but rather are intended to assure the mutual enjoyment by all condominium owners. The cooperation of everyone will benefit us all. The Rules and Regulations apply to Owners, guests and any other occupants of a unit. They apply to all present and future Owners. Owners are responsible for adherence by any occupant of their unit. Guests should be supplied with a copy of these Rules and Regulations at the time of initial occupancy. These Rules and Regulations are in addition to the Rules and Regulations contained in Section 6.1 of the First Amended By-Laws.

  1. Parking space adjacent to each building is sufficient for one vehicle per Unit. Each unit Owner has absolute priority to one parking space. During periods of high occupancy, such as summer weekends, all other vehicles, including those of guests and visitors, must park in the overflow areas.
  2. Boats and/or boat trailers are not allowed in the regular or overflow parking areas. An area west of the trash garage is available for up to 5 boats/trailers on a first come basis. Over-winter boat parking can be arranged in the same area for a fee of $150.
  3. Owner’s cars are not to be left over-winter in the regular or overflow parking areas, but may be placed in the boat area if space is available and a permit is obtained from the board.
  4. No more than two pets are allowed in any Unit at any time. Dogs must be leashed and accompanied by the Owner when in any portion of the common elements. Owners are responsible for cleaning up after their pets. Dogs are not allowed in any Unit unless occupied by the Unit Owner. Please pick-up pet refuse and place in bag/trash container.
  5. Do not give instructions to any maintenance personnel.
  6. Do not tamper with the central antenna system.
  7. Paragraph 6.1(b) reads as follows, “There shall be no obstruction of the common elements facilities, and nothing shall be stored therein without prior approval of the Association”. Please consider making use of storage buildings for storage of bikes, toboggans, etc.; each unit has a designated space in the storage building.
  8. Place all refuse in bags and deposit in the trash dumpster. Use extreme care in handling fireplace ashes, which are to be deposited in the fireproof containers near the dumpster. Place acceptable recyclables in labeled containers.
  9. The Condominiums of Fox Point Owner’s Association, Inc. adopted a no rental policy, effective January 1, 2002. This policy supercedes any previous rental policy.
  10. All occupants are to refrain from creating excessive noise or any other activity that is offensive to neighbors, or potentially destructive to common areas. The use of snowmobiles, dirt bikes, ATV’s or similar vehicles is expressly forbidden.
  11. Do not remove or damage any trees, shrubs or plants.
  12. Signs, banners or posters of any kind are prohibited.
  13. In an emergency (fire, police or medical) call 911 and give your Fire Code Number. The alarm box in your Unit only provides an audible alarm in your building.

  1. In March 2008 the State of Wisconsin revised its Fire Code to adopt the NFPA 2006 Uniform Fire Code. Included in the new code are much more strict rules for the use of grills and other devices; the specific language is: “For other than one- and two-family dwellings, no hibachi, gas fired grill, charcoal grill, or other similar devices used for cooking, heating or any other purpose, shall be used or kindled on any balcony or under any overhanging portion or within 10 ft. (3 m) of any structure. (UL)Listed electrical ranges, grills, or similar electrical apparatus shall be permitted.” The Egg Harbor fire department further clarifies that this includes patio fireplaces, chimineas, etc. and that you also may not store gas or charcoal grills or spare gas cylinders in multifamily dwellings, including the outside storage closets. Based on this, the board of directors decided that all such devices are banned and are to be permanently removed from all Owners’ properties – use an electric grill or no grill. While the association may elect to continue to store a couple of grills in the storage garage for group functions, Owners are not authorized to store these items in the storage garage.

If you or your guests continue to use these devices, the association and/or you may be cited and fined for non-compliance with State Fire Code, plus you could be held civilly or criminally liable for any fire that might have been started by a non-compliant grill or stove.

  1. Paragraph 11.5 of the by-laws prohibits structural changes by an Owner to a unit and/or to any common areas without the written consent of the Association (i.e. the board). As an extension of this prohibition the Association has determined that any modification or addition to a structure in the common areas that is made with the consent of the board nonetheless remains the responsibility of the Owner(s) creating the modification to remove said same at their expense when it is no longer needed. An example is the addition of a handrail at the common front entrance of a building. If the unit is sold to a new Owner who does not have a physical need for the handrail, the Association may request that it be removed at the seller’s expense and, if not provided for otherwise, may become a lien on the unit.
  2. To clarify where the responsibility lies for costs associated with repairs and replacements in the buildings, the board of directors has determined that replacement of exterior mounted features, such as skylights, windows and doors, etc. is generally the responsibility of the condo association. The cost of any interior work that may be required as a result of such repair or replacement work will be borne by the owner of the unit. The condo association will replace items deemed necessary due to deterioration with comparable materials and, should an owner want an upgrade from that level, they will be responsible for any difference in cost.
  3. Firewood supplied for Owners is to be used only while at Fox Point and not to be used as a source for home use. Owners will please make this clear to guests and children who are visiting.
  4. Infractions of these Rules and Regulations by Owners or guests of owners are to be reported in writing to the Board of Directors, who may take whatever action, including legal action, they deem advisable.
