Four supreme court Judges air differences with CJI Mishra

Four senior most Judges of SC who are also part of collegium aired their differences with CJI in open through a press conference. They stated that, it is a fulfilment of a duty to the nation and institution. It is feared that institutional credibility can be effected in the long run.

Issues raised by them are

Roster : CJI as the administrative head of SC is the master of roster. It is an established precedent. Impartiality of CJI is essential to maintain independence of office. It is alleged that roster is been decided in such a way that senior judges are not allocated with sensitive Judicial work of national importance. According to them, convention of the court demands that important cases of public interest should be first handled by CJI and if not senior most judge of SC.

MoP : centre’s silence on Memorandum of procedure has led to delay in appointment of Judges. As centre has not decided on time, it can be concluded as acceptance to speed up judicial appointments.

Judicial independence is critical for functioning of democracy. Previously, by passing Justice HansrajKhanna, than senior most Judge of SC to be elevated to CJI has become controversial. It was seen as a response to his Judgement in ADM jabalpur case. He is the lone judge who favoured protection of right to life and liberty during emergency. Later, Appointment of AN Ray as CJI bypassing 3 senior most Judges also become controversial. I has come after KeshavanandaBharatijudgement. It was alleged that Government is trying to create a committed Judiciary through appointing judges of its own.

Rights in the age of big data

Technology is a means and not an end.

Technology and change can be transitory phenomenon. Rights are bigger questions of law and philosophy. They are the issues of principles and values.

Technology and innovation shall not lead to servitude and impotence. Economic benefits promised by technology shall not obscure rights of the citizens.

so, in framing of a data protection law - a balancing act between technological innovation and individual rights in unwarranted. It can not be a debate at all. Individual rights always take precedence over the other. Privacy concerns of individual shall get precedence as it is essential for human dignity and individual autonomy.

A perfect storm of uncertainty

Govt of India do not have a certain data related to revenue estimates. It is due to the confusion associated with GST filing date, input credit credits to be paid etc. In this scenario, only rough revenue estimates have to be worked out for this budget.
