WINDSOR MEADOWS CONDOMINIUM

FORTH AMENDMENT TO THE DECLARATION

NOW COMES Coastwise Management, LLC, having a principal place of business at 100 Main Street, Suite 140, Dover, New Hampshire, and says:

  1. That the condominium was declared on September 26, 2000 by Declaration of Condominium recorded in the Rockingham County Registry of Deeds, Book 3506, Page 2311.
  1. That the condominium has been previously amended by instruments recorded in Rockingham Records at Book 2514, Page 1169 and Book 3521, Page 1595.
  1. That recorded substantially contemporaneously with the Declaration was a plan entitled “Proposed Site Plan – Phase I and Phase II Household Realty Trust Tax Map 4, Block 1 Lot 40” as plan D-26807, Sheet 3 of 6, as Plan D-26807.
  1. The Declaration provided in Appendix C, that there would be certain convertible land and reserved to the Declarant the right to convert the described premises to additional unit upon certain conditions.
  1. Coastwise Management, LLC hereby converts, by the recording of this instrument and of a Plan entitled “Tax Map 4, Block 1, Lot 40 North Road Brentwood, N.H. Site Plan Phase II Windsor Meadows Condominium for Coastwise Management, L.L.C.” that land described as Convertible Land Phase II in said Appendix C to the Declaration as more particularly described in Appendix A hereto.
  1. A total of 24 Units designated as 37 through 42 (Building 7), 43 through 48 (Building 8), 49 through 54 (Building 9) and 55 through 60 (building 10) located within the convertible land and as shown on the site plan are hereby declared.
  1. The undivided interest in the common area for each unit, (13 units having previously been declared is not 1/37th.
  1. The maximum number of additional unit which may be created within the Phase III Convertible land as described in Appendix C to the Declaration is 24, so that the total number of units in the Condominium shall not exceed 61. The Declarant is under no obligation to complete Phase III or the improvements and amenities associated therewith.
  1. Units to be constructed within Phase II shall be substantially compatible with unit 1 through 12 previously declared (excluding Unit 61) in terms of quality of construction, the principal material to be used and architectural style. The units within said buildings shall be substantially identical in size and layout to units 1 through 12 as previously constructed. Nothing herein shall be construed to prevent the Declarant from using materials superior in grade to those utilized in units 1 through 12.
  1. The limited common areas within Phase II shall included the exclusive right for access and parking within the garage and driveway appertaining to each unit to be built and an area 25 feet from and parallel to each unit including the garage.
  1. The roadways to be constructed in accordance with the approved site plan within Phase II are withdrawable land as described in Appendix D to the original Declaration pursuant to Town of Brentwood regulations. Until such time as the Town of Brentwood accepts the dedication and the roadways are withdrawn from the condominium for the purpose of conveyance to the Town of Brentwood said roadways shall be common area and the maintenance and repair thereof shall be the responsibility of the association.
  1. Pursuant to the approvals from the Town of Brentwood and the original Declaration each unit to be constructed within Phase II shall be limited to two bedrooms.
