If you would like to take part in the Toronto Solar Neighbourhoods Initiative (“TSNI”) pilot program (the “Program”) as an eligible homeowner (the “Customer”), please read and sign the following form, as well as relevant sections of the Program Guidebook at http://www.solarneighbourhoods.ca/forms/program_guide.pdf.

Submission of this form and subsequent acceptance will constitute an agreement between the Toronto Atmospheric Fund (“TAF”) and the Customer (the “Agreement”). The Homeowner is hereinafter referred to as the “Applicant”.

An eligible TSNI Contractor (the “Contractor”) shall complete this application form with the Customer.

Glossary of Terms
SDHW means solar domestic hot water; TSNI means Toronto Solar Neighbourhoods Initiative; TSNI Administrator means the Program delivery agent; Agencies means the Toronto Atmospheric Fund, the Energy Efficiency Office, the Toronto Environment Office and Toronto Hydro; Customer means a TSNI participant who purchases a SDHW system through a TSNI eligible Contractor; Contractor means a contractor who applied for a been approved for participation in the Program and who sells and installs SDHW systems under the Program; Project means a SDHW installation undertaken by a Customer; Program means Phase I of the TSNI pilot program; Program Guidebook means the TSNI Phase I – Ward 30 Program Guidebook.
Program Participation Agreement: Terms & Conditions
I agree to the following terms and conditions required for participation in the Program in order to be eligible for the Program incentives as outlined in Section 1.10 of the Program Guidebook:
1. / I understand the Program requires inspections and may require measurement and verification of the performance of the Project. Therefore, I agree to provide access to the Project site for these purposes to the Contractor and the TSNI Administrator during the term of the Program, and to allow installation of any required monitoring and verification equipment. I also agree to allow system performance data to be transmitted over my existing internet connection, if present.
2. / I understand that the City of Toronto and its Agencies may publish information, photos and/ or performance data about my system, and my identifying information will be kept confidential.
3. / I understand that the City of Toronto and its Agencies have made no warranty or representation regarding the qualifications of the Contractor, and that I am solely responsible for the selection of the Contractor to implement the Project, in keeping with the Project eligibility criteria and requirements as set forth in Sections 4.1 and 4.2 of the Program Guidebook. I understand that the Contractor is an independent contractor and is not authorized to make any representations on behalf of the City of Toronto and its Agencies.
4. / I agree that the City of Toronto and its Agencies will have no role in resolving any disputes between me and the Contractor.
5. / I have authority to contract, on behalf of the legal owners of the Project site, for installation of the SDHW System and Monitoring Equipment, if required, or I have obtained the permission of the legal owner of the Project site to install the solar system and or/ monitoring equipment under my contract with the Contractor.
6. / I understand that the SDHW system is to be supplied and installed by the Contractor signed below. I further understand that the role of the City of Toronto and its Agencies is limited to making incentives for Projects that qualify under the Program, as outlined in the Program Guidebook. TSNI does not certify either products or contractors, and is not affiliated with, the person or entity responsible for installing the SDHW System for which I am seeking an incentive.
7. / I understand and acknowledge that the City of Toronto and its Agencies, directors, agents and employees shall have no liability for general, special, incidental, indirect or consequential damages, incurred by me, or anyone claiming under me, arising from, or in any way connected with the installation or performance of any SDHW system and devices for which an incentive is paid under the Program or TSNI’s performance of, or failure to perform, this Agreement, however caused, regardless of the City of Toronto and its Agencies’ negligence, whether active or passive.
8. / I further agree to indemnify, defend and hold harmless the City of Toronto and its Agencies, directors, agents and employees, from and against all claims, demands, costs, expenses and liability (legal, contractual or otherwise) which arise from or are in any way connected with any (i) death or personal injury to me or any third party; (ii) injury to my property or the property of any third party; or (iii) violation of local, provincial, or federal law, regarding the installation or performance of any SDHW system and devices for which an incentive is paid under the Program or the City of Toronto and its Agencies’ performance of, or failure to perform, this Agreement, however caused, regardless of the City of Toronto and its Agencies’ negligence, whether active or passive.
9. / I understand that the Contractor will receive the incentive payments in accordance with the terms and conditions of the Program Participation Agreement as outlined above and in Section 2 of the Program Guidebook.

EnWise Conditional Sales Contract & void cheque
STEPS TO APPLY FOR A TSNI REBATE OR LOAN
1. Contractor and Customer: Complete, sign, and mail this application, along with the required attachments to the following address:

If applying for the TSNI no-interest loan option, please complete and submit the EnWise Personal Credit Application along with this Program Application. Once the loan is approved and loan documentation (the EnWise “Conditional Sales Contract”) signed by the Customer, the Contractor will be authorized to go ahead with building permit applications and system installation.
2. Customer: Do not purchase, order or install any equipment until you have been notified that your application has been approved. Deposits should be paid upon approval of the Program Participation Agreement.
3. TSNI will notify you if your application has been approved within 14 days of receiving a complete application.
4. The Contractor will have up to 90 days to install and commission the SDHW system once Project has been accepted for TSNI support.
