Notice is hereby given that proposals will be received by the Purchasing Agent of the City of Pascagoula, Mississippi, at her office in City Hall during legal office hours until 4:00 P.M. on Monday, March 9, at which time they will be opened for:

Pyrotechnical Display for Fourth of July Celebration

All proposals shall be submitted in a sealed envelope addressed to the Purchasing Agent of the City of Pascagoula, Mississippi. If a proposal is submitted by mail, the post office address of the Purchasing Agent isP. 0. Drawer 908, Pascagoula, Mississippi39568-0908. If a proposal is hand-delivered, the street address is 603 Watts Avenue, Pascagoula, Mississippi39567-4220.

All proposal envelopes shall be marked "FOURTH OF JULY FIREWORKS SHOW, TO BE OPENED Monday, March 9, 2015, at 4:00 P.M.", and if any envelope is not so marked, any proposal contained therein will not be considered.

All proposal envelopes must contain the proposer’s name and mailing address on the face of the envelope and also specify the name of the proposal item.

The City reserves the right to evaluate all proposals, waive any technicalities or informalities, reject any or all proposals, and further specifically reserves the right to make the award in the best interest of the City.

PART ONE

GENERAL TERMS AND INSTRUCTIONS

SECTION I:TERMS AND CONDITIONS

1.1All proposals submitted shall be firm for a minimum of 65 working days.

1.2The City reserves the right to cancel or make null and void, any purchase order, if delivery cannot be made on the specified delivery date.

1.3All items shall be delivered F.O.B. destination. Delivery costs and charges shall be included in the proposal.

1.4Proposal awards are not official until a purchase order is issued or the Purchasing Department notifies the successful vendor in writing.

SECTION II: SUBMISSION OF PROPOSALS

2.1Proposals received after the designated date and time will not be opened or returned.

2.2All proposals are to be submitted via email, fax, mailed in a sealed, plainly marked envelope, or hand-delivered. The envelope shall be marked in the bottom left corner: Fourth of July Fireworks Show, to be opened Monday, March9, 2015,at 4:00p.m.

2.3All proposals shall be typewritten or printed in black ink.

2.4 An authorized officer or agent of the company submitting the proposal must sign the proposal in order for it to be considered.

SECTION III:PROPOSAL EVALUATION

3.1The City reserves the right to evaluate all proposals, waive any technicalities or informalities, reject any or all proposals, and further specifically reserves the right to make the award in the best interest of the City.

3.2NON-COLLUSION: Vendors, by submitting a signed proposal, certify that the accompanying proposal is not the result of, or affected by, any unlawful act of collusion with any other person or company engaged in the same line of business or commerce, or any other fraudulent act punishable under Mississippi or United States law.

SECTION IV:BILLING AND PAYMENT

4.2Payment by the City shall be made on the day of fireworks show at completion of same, subject to any discount offered.

4.2.1Any prompt pay discount offered will be computed from the date of delivery of the equipment, supplies, materials, or services at the destination when final inspection and acceptance are at those points, or from the date the correct invoice is received, if the latter is later than the date of delivery.

SECTION V:CONTRACT

5.1 All proposals submitted shall include a copy of the vendor’s contract to be signed by the City of Pascagoula.

CITY OF PASCAGOULA

REQUEST FOR PROPOSALS

PYROTECHNICAL DISPLAY

PART TWO

The City of Pascagoula shall accept written proposals for a pyrotechnical show for a Fourth of July celebration until 4:00 PM, Monday,March 9, 2015, at which time they will be opened. All proposals shall be for the vendor’s “Best Quality Show”.

The City will accept proposals for a $19,000.00 pyrotechnical show to be shot by the successful vendor’s certified pyrotechnical technicians. Adequate personnel will be provided, to fire the show, without unnecessary or lengthy delays. The successful vendor shall also supply enough mortars for the show to be shot without having to reload. The proposal shall be for all materials, supplies, mortars, certified technicians, and transportation cost for the show. The show shall include all Class B aerial shells, 3-inch minimum and 12-inch maximum diameter, except as noted below.

The program shall include, without exception, the following:

1. A fireworks display lasting a minimum of twenty minutes

2. One “Patriotic Music CD” for airing on a local radio station

The quantity of shots will be a determining factor, but shall not be the final determining factor in the award of this contract. Other criteria to be considered shall be, but not necessarily limited to:

1. Overall program and variety content

2. Availability of equipment to fire the show without reloading

3. Overall show choreography

4. How specific each proposal is regarding shell descriptions (such as special effect and multi break), type and quantity of each

The proposal shall include the following:

1. A list of proposed devices to be discharged; any “Low Level” device (cakes, candles, strobe pots, mines, etc.) must be listed separately and described. All aerial shells are to be listed separately and size quoted in diameter only.

2. Retail value of each shell size (average cost of each shell size category)

Vendors shall include all information on their show and company that might be useful in helping to determine their capabilities to provide the type of enhanced show that the City of Pascagoula requires. The City reserves the right to award the contract for the show that is deemed to best represent the desires and needs of the City.

INSURANCE REQUIREMENTS: Any person, firm, or corporation entering into a contract with the City for this project shall have Worker’s Compensation and Employers’ Liability Insurance, in addition to General Liability Insurance in an amount not less than $1,000,000.00 per occurrence. Proof of Workers’ Compensation and Employers’ Liability Insurance and General Liability Insurance in the above amount shall be provided with the proposal. The successful proposer shall also provide the City of Pascagoula with a certificate of insurance naming the City as additional insured on the general liability policy, prior to the City issuing a purchase order.

GENERAL: The vendor shall be responsible for all expenses that may be incurred, such as hotel accommodations, food, etc.

The vendor shall be responsible for obtaining all permits necessary and submitting a copy to the City at least a month prior to the show.

The vendor shall be responsible for coordinating with the radio station regarding the countdown and compilation of music.

A penalty of three times the retail value of any shortage will be deducted from the payment of the invoice. The cost of any unfired shells remaining after the show will be refunded to the City.

The fireworks show will be shot from the City’s Park Pier on Beach Blvd. The pier will be closed for setup of the fireworks display, the fireworks show, and for cleanup after the show only.The vendor will be responsible for loading and unloading the show onto the end of the pier and for any damage to the pier.Cleanup after the show shall be done the next day by noon, including but not limited to the recovery of any unexploded items floating in the water.

The schedule date for the show is Saturday, July 4, 2015, at 9:00 P.M., but in the event the weather is not permissible for this date, the successful vendor shall be prepared to shoot the show on Sunday, July 5, 2015, at 9:00 P.M. without additional charge. Should there be extreme weather conditions, e.g. several days of rain, tropical weather, hurricane, etc., the City and the contractor will agree upon a newly scheduled date for the show within 30 days of July 5, 2015.
