“Fonterra Foodservices Cash Cow Promotion”

TERMS AND CONDITIONS

1.  Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2.  Entry is only open to Australian residents who are 18 years of age or over and who work in the foodservices industry.

Individuals can enter on their own behalf or on behalf of a foodservice business located in Australia. Where an individual enters the promotion on their own behalf and is not the owner of the foodservice business, the individual must have authority from the foodservice business owner to enter the promotion and accept any resulting prize.

3.  Employees (and their immediate families) of the Promoter, participating distributors and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

4.  Promotion commences at 12.01am AEST on 28/07/2014 and closes at 11.59pm AEST on 21/09/2014 (“Promotional Period”).

5.  To be eligible to enter, individuals must purchase eight (8) of the following Tier 1 participating Fonterra products, and four (4) of the following Tier 2 participating Fonterra products, from a participating distributor or via a Fonterra Foodservice representative during the Promotional Period in a single transaction (“Qualifying Transaction”).

An entrant may purchase any eight (8) Tier 1 products and any four (4) Tier 2 products in order to be eligible to submit one (1) entry in accordance with these Terms and Conditions.

For the avoidance of doubt, an entrant must order a minimum of eight (8) Tier 1 products and four (4) Tier 2 products in one (1) transaction to be eligible to enter this Promotion.

6.  To enter, individuals must visit www.fonterrafoodservices.com.au after making a Qualifying Transaction, follow the prompts to the promotion entry page, input all of the requested details (including but not limited to their first and last name, contact telephone number, a valid email address, their State/Territory of residence, a list of all participating Fonterra products purchased in the Qualifying Transaction, the full invoice number from the Qualifying Transaction, the name of the participating distributor or the Fonterra Foodservice Representative the Qualifying Transaction was made through, and if the Qualifying Transaction was made on behalf of a business, the name of the business and their position in the business) and submit the fully completed entry form so it is received by 11.59pm AEST on 21/09/2014.

7.  The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence and/or employment) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process or the Game. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

8.  Incomplete or indecipherable entries will be deemed invalid.

9.  Entries are deemed to be received at the time of receipt into the Promoter's database, not time of transmission by the entrant.

10.  Multiple entries are permitted, subject to the following:

a)  a limit of one (1) entry per person per day; and

b)  a separate entry form will need to be completed for each separate Qualifying Transaction; and

c)  each entry must be submitted in accordance with the entry requirements.

11.  Entrants must retain a copy (or allow the Promoter to contact their distributor directly to obtain a copy) of their purchase invoice(s) (TIO form or distributor invoice) for all entries as proof of purchase (“Proof of Purchase”). Failure to produce the Proof of Purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. The Proof of Purchase must clearly specify the method of purchase, the eligible Fonterra product/s purchased, and that the purchase was made during the Promotional Period but prior to entry.

12.  If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

13.  If more than one person attempts to claim a prize, the Promoter has sole and absolute discretion to determine which of those persons the winning entrant is.

14.  The Promoter is not responsible for technical difficulties with the entry mechanism or the Game and does not warrant that the entry mechanism or the Game will be available at all times during the Promotional Period.

15.  Upon submission of their entry, entrants will be prompted to play the Cash Cow game (“the Game”). The entrant must follow the on-screen prompts to participate in the Game for the chance to instantly win one (1) of 350 prizes (“Instant Win Prize”). Each Instant Win Prize is an eftpos card randomly selected from the Instant Win Prize pool. The Instant Win Prize pool is made up of the following Instant Win Prizes – 200 x $50 eftpos card; 100 x $100 eftpos card and 50 x $200 eftpos card. The Instant Win Prize pool is made up of 350 Instant Win Prizes with a total collective value of AU$30,000. Instant Win Prize winners will be prompted via an on-screen notification to either upload a copy of their Proof of Purchase in order to validate their entry and claim their Instant Win Prize, or to agree (by placing a tick in the relevant box on the screen) to the Promoter validating their Proof of Purchase directly with their distributor. If an Instant Win Prize winner cannot be validated they will forfeit their claim to the Instant Win Prize.

16.  All entries received during the Promotional Period, with the exception of entries awarded an Instant Win Prize, will be entered into a major prize draw at the conclusion of the Promotional Period (“Major Prize Draw”). The Major Prize Draw will be conducted at 12 noon AEST on 22/09/2014 by a representative of the Promoter at Prime Focus, 403/62 Beach Street, Port Melbourne, VIC 3207 (“Draw Location”). The first entry drawn in the Major Prize draw will win $5,000, awarded to the winner in the form of a cheque (“Major Prize”). The Promoter may draw additional reserve entries in the Major Prize Draw and record them in order in case an invalid entry or ineligible entrant is drawn.

17.  Instant Win Prize winners will be notified via an on-screen notification following completion of the Game, and will be sent an email to the email address included in their entry.

18.  The Major Prize winner will be notified by phone and by email and their name (and the name of the business they submitted an entry on behalf of, if applicable) will be advertised on www.fonterrafoodservices.com.au from 17/10/2014.

19.  The Promoter’s decision is final and no correspondence will be entered into.

20.  In the event that an entrant submits an entry on behalf of a business, if that entry is drawn as a winning entry, the prize will be awarded to the owner of the business (who may distribute the prize to any employee of the company at his/her discretion). In the event that an entrant submits an entry in their individual capacity but without authority from their employer (owner of the foodservice business), then the prize will be awarded to the owner of the business (who may distribute the prize to any employee of the company at his/her discretion).

21.  Subject to the unclaimed prize draw clause, if for any reason a winner does not take a prize (or an element of a prize) at the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.

22.  If a prize (or part of a prize) is unavailable for any reason, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

23.  The Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend or modify a prize, subject to any written directions from a relevant regulatory authority.

24.  There are 351 prizes to be awarded in total. Total prize pool value is up to AU$35,000.

25.  Fonterra eftpos cards will be dispatched to winners at the postal address supplied on their entry form within 14 working days from a claim being marked as valid.

It is a condition of accepting an eftpos card that the winner must comply with all the conditions of use of the eftpos card supplier - Edge Loyalty Systems Pty Ltd ABN 96 138 299 288 (the "Supplier”) - requirements, namely:

a)  eftpos cards will be redeemable at retailers in Australia with "eftpos" facilities who accept the eftpos card and when the eftpos card has enough unused value to make the purchase. Recipients may use the eftpos card to purchase goods or services during the validity period of the eftpos card. See eftpos card for expiry date.

b)  eftpos cards must be activated at www.activatemycard.com.au/fonterra within 2 months of the date detailed on the winner's letter, which will be delivered with the eftpos card, by following the steps provided in the winner's letter. Available funds on the eftpos card must be used within 6 months of activation. eftpos cards will be loaded with funds 24-36 hrs after activation and cannot be redeemed for cash, reloaded, returned for a refund, have their balances consolidated to a new card, or be replaced after expiry, and are not legal tender, account, credit or debit cards or securities.

c)  The Promoter and Supplier are not liable for the availability, quality or fitness for purpose of any goods or services purchased with the eftpos card. Any dispute about goods or services purchased with the eftpos card must be resolved with the supplier of those goods or services. Except for rights, which cannot be excluded, any conditions or warranties implied or imposed by legislation or otherwise are excluded from these conditions of use. To the extent permitted by the law, the Supplier’s liability is limited to replacing faulty eftpos card.

d)  The Supplier may cancel any eftpos card, or the eftpos card scheme, for any reason at any time without notice. If so the Supplier may either provide a refund or a replacement eftpos card of equivalent value unless the Supplier reasonably suspects fraud in relation to an eftpos card. The eftpos card remains the Supplier’s property.

e)  Should the eftpos card not arrive via mail or a recipient suspects an unauthorised transaction, please contact the Supplier by telephone on 1300 079 267, or online at www.giftcardplanet.com.au

26.  The Promoter or the Prize Supplier does not take any responsibility in the event an eftpos card does not reach its intended recipient because incorrect or incomplete details were provided by the entrant in the competition entry form. In such instances where possible the eftpos card will form part of the Unclaimed Prize Draw.

27.  Entrants are eligible to win a maximum of two (2) Instant Win Prizes in the promotion.

28.  Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash (unless stated otherwise).

29.  A draw for any unclaimed prizes will take place at 12 noon AEDT on 14/01/2015 at the Draw Location, subject to any directions from a regulatory authority. The winners, if any, will be notified in writing by email and by telephone within two (2) business days of the draw and the name (and the name of the business they submitted an entry on behalf of, if applicable) of the unclaimed Major Prize winner, if any, will be advertised on www.fonterrafoodservices.com.au from 06/02/2015.

30.  The Promoter accepts no responsibility for any tax liabilities that may arise from winning or receiving the benefit of a prize.

31.  Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

32.  Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

33.  The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
