FIXING THE ORGANIZATION AND NATURE OF OPERATIONS MANAGEMENT
NATIONAL TRADE AND COMPETITION.
THE PRESIDENT OF THE REPUBLIC
Mindful of the Constitution;
Pursuant to Law n ° 94-009 of 22 March 1994 on the principles of the creation, organization,management and control of public services. ;
Considering Ordinance No. 98-019 of 20 August 1998 establishing the National Directorate of Trade andCompetition;Given the Decree of 25 August 1985 204/PG-RM determining how to manage and controlstructures of public services;
Given the Decree of 13 September 97 97-263/P-RM appointing a Prime Minister;
Pursuant to Decree No. 97-282/P-RM of 16 September 1997 appointing the members of the
Government;
Given the Decree of 21 November 9.7-343/PM-RM 19 9.7 interims fixing members
Government;
RULING COUNCIL OF MINISTERS
DECREES:
ARTICLE 1: This decree establishes the organization and operating procedures of the Directorate
National Trade and Competition.
CHAPTER I: GENERAL PROVISIONS
ARTICLE 2: The National Trade and Competition is headed by a Directorappointed by decree of the Council of Ministers upon proposal of the Minister of Commerce:
ARTICLE 3: The National Director of Trade and Competition is responsible, under the authority of
Minister of Commerce, direct, coordinate, monitor and manage activities of the service.
ARTICLE 4: The National Director is assisted by a Deputy Director who replaces him as of right in casesof vacancy, absence or incapacity.
The Deputy Director is appointed by decree of the Minister of Commerce. The appointment sets stopsalso its specific responsibilities.
CHAPTER II: ORGANIZATION
ARTICLE 5: The National Trade and Competition includes
- Plaster
The Computer Centre and Documentation;Bureau of Management Support staff and equipment. Four DivisionsStudy and Organization Division of Trade and Distribution;
Division of Legislation and Competition;
Division of Foreign Trade;
Division of Economic and Commercial Promotion.
Services staff are treated as divisions.
ARTICLE 6: Computing and Documentation Centre is responsible for:
Analysis and programming of computer data;
Monitoring and operating computer programs;Entering data;Management documentation and archiving
ARTICLE 7: The Bureau of Management Support and Staff
: Material is responsible for monitoring thepersonnel and equipment in connection with the Administration and Finance.
ARTICLE 8: Design and Organization Division. Commerce, and the distribution is loaded.
Organization and monitoring of markets by sector and by economic sector inrelatedother structures, organizations;
Collection and analysis of information on prices and stocks in the domestic market.
ARTICLE 9: Division Study and Organization of Commerce and Distribution includes foursections:
- Agricultural Sectors section;
- Section Industries, Energy and Mines;
- The services section;
- Section Trade Distribution.
ARTICLE 10: The Division of Legislation and: Competition is responsible for:
The preparation of drafts of laws and regulations on trade and
Competition;
The application of the rules on competition;
The review and monitoring records - Litigation;
Analysis and monitoring of applications for approval study and test models of instrumentsable for their approval;
The verification of new instruments or adjusted;Monitoring measures and measuring instruments in service.
ARTICLE 11: The Division of Legislation and Competition consists of four sections
The Investigations Section;
Litigation Section;
Section Approvals and Regulations;
Métrologie.
ARTICLE Section 12: Foreign Trade Division is responsible for:
Monitoring and nu.se implement reforms and trade policies of the country,participation in the elaboration of trade agreements and monitoring their implementation,
Developing and monitoring the implementation of the Programme Import-Export (IMEX)
The participation in the mobilization of aid external balance of payments andpossibly credit goods.
ARTICLE 13 ': The Foreign Trade Division consists of three sections:
Record section titles of Foreign Trade;
Section Trade Agreements;
Section: Development Programme Monitoring Import-export.
ARTICLE 14 The Division of Economic and Commercial Promotion isresponsible for:
Market research;
Diagnostics companies,Information and economic training.and commercial
Publications to promotional
The organization of the participation of Mali fairs,
Trade fairs and exhibitions;
Commercial exploration missions;
Housing business relationship
ARTICLE 15: The Division, Economic and Commercial Promotion consists of two sections:
Section Informa Lions and Assistance;
Trade Promotion Section.
ARTICLE 16: The Divisions, the Computer Centre and guidance and the Office of Management Support
Personnel and equipment are headed by Heads of division, head of the center andoffice manager called by order of the Minister of CommerceSections are led by department heads appointed by decision of the Minister ofTrade.
ARTICLE 17: The National Trade and Competition is represented atregionally by the Regional Trade and Competition and sub-regional level byServices Trade and Competition
CHAPTER III: OPERATION
SECTION I: POLICY DEVELOPMENT DEPARTMENT
ARTICLE 18: On the authority of the National Director, Heads of Division prepares studiestechnical programs of action on matters within their sectors of activityconduct periodic evaluation of programs implemented, coordinate and controlactivity. Sections.
ARTICLE 19: Heads of Sections of Division Heads provide the data elementsessential to the development of studies and action programs.
SECTION II: COORDINATION AND CONTROL
ARTICLE 20: The activity of coordination and control of the National Directorate of Trade andcompetitionperforms on-the regional and subregional.
CHAPTER III: FINAL PROVISIONS
ARTICLE 21: are and remain abrogated the provisions of Decree No. 90-203/P-RM of
May 18, 1990 on the organization and working methods of the DirectorateNational Economic Affairs.
ARTICLE 22: The Minister of Industry, Trade and Handicrafts, the Minister of Administration
Territorial and Security and the Minister of Finance are responsible, each in what concerns theexecution of this decree shall be registered and published in the official gazette.

ESTABLISHING THE NATIONAL DIRECTORATE OF TRADE AND COMPETITION.
THE PRESIDENT OF THE REPUBLIC
Mindful of the Constitution;
VU Law No. 98-051 of 3 August 1998 authorizing the Government to take some action by ordinances;
Mindful of Decree No. 97-263/P-RM of 13 September 1997 appointing a Prime Minister;
Mindful of Decree No. 97-282/P-RM of 16 September 1997 appointing the members of the
Government;
The Supreme Court heard;
RULING COUNCIL OF MINISTERS
ORDERS:
ARTICLE 1: There is hereby established a central service called National Directorate of Trade and
Competition
ARTICLE 2: The National Trade and Competition mission developmentelements of the national policy in the field of trade and competition andimplementation of this policy.
As such, it is responsible for:
The organizing, developing and supporting trade promotion activities to increase their role in the economic and social development of the country;
- Develop regulations on trade and competition in relation to other relevant structures;
- Ensure the implementation of national and international regulations on trade and competition.
ARTICLE 3: The National Trade and Competition is headed by a Directorappointed by decree of the Council of Ministers upon proposal of the Minister of Commerce.
ARTICLE 4: A decree of the Council of Ministers shall determine the organization and proceduresoperation of the National Directorate of Trade and Competition.
SECTION 5: This Ordinance repeals Ordinance No. 82-ll/P-RM 1 June 1982establishment of the National Directorate of Economic Affairs.
SECTION 6: This Ordinance shall be registered and published in the Official Journal.
