Dear Attorney Harris:

This is to advise that the Commission’s Secretarial Letter dated November 16, 2016, and the Notice in the Pennsylvania Bulletinpublished on December 3, 2016, at 46 Pa.B.7605, in this matter are being supplemented by the provisions herein, as follows:

  • The Petition to Intervene, filed November 22, 2016, by Gulf Operating, LLC (Gulf), is granted.

Gulf’s Motion to Extend the Deadline for Protest is granted, in part, as set forth in this Secretarial Letter. The date for filing formal protests and petitions to intervene in this matter is extended. Such pleadings must be filed and served by 4:30 PM on or before Wednesday, February1, 2017. Pleadings may be filed electronically[2] or in hard copy[3].

  • Laurel Pipe Line Company, LP, shall serve a copy of its Application, dated November 14, 2016, on the following entities, if not already served, and file certificates of service, by December19, 2016:
  • Current customers using the subject pipeline.
  • Former customers who used the subject pipeline during the period from January 1, 2015, through the date of filing.
  • Prospective and committed customers Laurel expects to use the subject pipeline if the flow direction of the line is changed.

Pursuant to 52 Pa. Code §5.14, the Commission will proceed with publishing the attached notice in the Pennsylvania Bulletin. This notice will appear in the Saturday, December 17, 2016 issue.

This matter will receive the attention of the Commission, and you will be advised of any further necessary procedure.

APPEAL RIGHTS

If you disagree with this determination, you may file a petition for reconsideration from staff action (appeal petition) pursuant to 52 Pa.Code § 5.44 to: Secretary, PA Public Utility Commission, P.O. Box 3265, Harrisburg, PA 17105-3265. The appeal petition must be filed with the Commission within twenty (20) days of the date of this letter. If no timely request for reconsideration is made, this action will be deemed to be a final action of the Commission.

Formal protests and petitions to intervene in this matter must be filed in accordance with Title52 of the Pennsylvania Code, on or before February 1, 2017, by 4:30 PM. This date extends the original due date for such pleadings.

All pleadings must be filed[4] with the Secretary of the Pennsylvania Public Utility Commission, P. O. Box 3265, Harrisburg, PA 17105-3265, with a copy served on the Applicant. The parties may agree to electronic service among themselves.
